Application to Operate a Food Stall (Đơn Ghi Danh Gian Hàng Hội Chợ Tết 2013)- Terms and Conditions

(Form F)

1. No alcohol shall be sold or consumed during the event;

2. The Organising Committee shall designate the location of stalls as appropriate. The Committee may consider any

stall holders’ requests but reserves the right to make the final decision;

3. Stall holders selling FOOD and/or DRINKS are required to attend a meeting to go over the Terms and Conditions

and to determine the location of the stalls. (A representative from the Organising Committee will contact you to

advise of the date and time);

4. All stall holders providing food need to complete the Application Form for a Trading in Public Places Licence

from the COW. If you don’t have a copy of Food Act 2008 Registration Certificate, you will also need to

complete ‘Notification Form for an Exempt Food Business’

5. All stall holders providing food are to be supplied with a hand wash facility in accordance with the Compliance

Services- Information Sheet 1;

6. All stall holders providing food are required to have a Fire Extinguishers within their stall;

7. All gas cookers and BBQs must meet the standards of the relevant authority in WA;

8. All stall holders providing food are required to have a fridge or a facility to store food at below 5 C as stated in

the Environmental Health Requirements Food Handling At Temporary Functions guidelines (attached below)

9. All stall holders providing food are to adhere to the requirements set out in the Environmental Health

Requirements Food Handling At Temporary Functions and Guidelines – Barbecue Cooking –Sausage Sizzles

(attached below);

10. Stall holders must clear all materials from their stalls and perform a thorough clean-up in and around their own

stalls on the closing night of the event, Sat 16 February 2013;

11. The Organising Committee reserves the right to assess and refuse any application(s) that is deemed not to be in

accordance with the theme of the Tet Festival, and/or does not comply with these Terms and Conditions. The

Committee's decision shall be final.

12. The Organising Committee shall not be directly or indirectly liable for any loss, damage or injury to any person

or property as a result of any act or omissions by any stall holder during the duration of the festival.

13. Tet Festival is communal and family social event operated by the Vietnamese Community in WA for the

celebration of the traditional Vietnamese New Year. No charitable, religious or political fundraising activity be

allowed within the festival showgrounds.

1. Không được bán hay uống rượu, bia trong khuôn viên hội chợ

2. Vì số gian hàng ghi danh ngày càng nhiều, Ban Tổ Chức dành toàn quyền sắp xếp vị trí của các gian hàng để đạt được kết quả tốt nhứt cho các gian hàng và người đến tham dự HCT

3. Mỗi gian hàng ghi danh bán thức ăn trong hội chợ, được yêu cầu tham dự một buổi họp để được hướng dẫn về

những điều kiện bán thức. Đại diện ban tổ chức hội chợ sẽ liên lạc quý vị về thời gian và điạ điểm họp nội trong tháng 1 năm 2013

4. Tất cả gian hàng nào bán thực phẩm phải điền vào bản mẫu (Application for Special Events Permit: Food

Vehicles and Temporary Food Outlets)

5. Tất cả những gian hàng bán thực phẩm phải cung cấp phương tiện rửa tay theo luật định đính kèm (Compliance Services Information Sheet 1), đính kèm

6. Tất cả những gian hàng bán thực phẩm phải có bình chữa lửa tại lều của mình

7. Tất cả lò nấu bằng gas và lò BBQ phải đúng tiêu chuẩn an toàn theo luật định của cơ quan thẩm quyền tại

11. Ban Tổ Chức Hội Chợ Tết có quyền cứu xét và dứt khoát từ chối những đơn xin không phù hợp với chủ đích của Hội Mừng Tết, hay không theo đúng những điều lệ trên.

12. Ban Tổ Chức Hội Chợ Tết sẽ không trực tiếp hay gián tiếp chịu trách nhiệm về các thiệt hại xảy ra cho con người

hay vật sở hữu của bất cứ một người nào, do hành động bất cẩn hay sơ xuất của người muớn gian hàng hoặc nhân viên của người mướn gian hàng trong thời gian Hội Chợ Tết.

13. Hội Chợ Tết 2013 là một sinh hoạt Văn Hóa Chung mang đặc tính Gia đình, do Ban Chấp Hành Cộng Đồng

Người Việt Tự Do Tây Úc tổ chức để Mừng Ngày Tết truyền thống Việt Nam. Đây không phải là một dịp để gây quỹ quyên góp từ thiện, vì thế không cá nhân nào được quyên tiền hay phẩm vật trong khu vực hội chợ cho những mục đích kể trên.

Important Information on food traders: Food businesses wishing to operate under this Trading Licence must be classified as exempt under the Food Act 2008 or hold a Registration Certificate. An exempted food business is exempted from registration only. They are still required to comply with the remaining requirements of the Food Act 2008 and Australia New Zealand Food Standards Code. In particular they must have provided Notification to the Local Authority. For each exempt food business operating under this licence a ‘Notification Form for an Exempt Food Business’ is to also be submitted to the City. Where notification has previously been provided a copy of any notification acknowledgement from the Local Authority may be provided instead. Businesses holding a Food Act 208 Registration Certificate should include a copy of the certificate. Types of Exempt food business: Food business is a charity or community group not involving the handling of potentially hazardous food (PHF - food requiring temperature control to prevent the growth of pathogenic microorganisms or the formation of toxins). Food business is a charity or community group whereby food is for immediate consumption after being appropriately cooked e.g. sausage sizzle. Food business consists solely of selling food that is not potentially hazardous food and is contained in a closed package so that it can not be handled in the course of conducting the food business e.g. lollies, chocolate . Food business consists solely of providing complimentary drinks in conjunction with another business conducted at those premises. Forms to Complete: All stall holder need to complete the “Application_Form_for_a_Trading_in_Public_Places_Licence” from the COW. If you have a Food Act 208 Registration Certificate, please include this in your application. If you don’t have one, please submit the ‘Notification Form for an Exempt Food Business’.

ENVIROMENTAL HEALTH REQUIREMENTS

FOOD HANDLING AT TEMPORARY FUNCTIONS SPECIAL EVENTS PERMIT No food handling is permitted until the premises have been issued with a Special Events Permit by the Council. Permits will only be issued to premises officially authorised by the event organiser and approved by the Council prior to the event, subject to compliance with any requirements imposed for the event. In the event of the permit being withdrawn, all food handling in the premises will cease forthwith (i.e. immediately) 2. FOOD STAFF

2.1 To be clean and free from infectious disease. 2.2 To wear clean washable protective clothing, i.e. uniform, aprons or ethnic costumes. 2.3 To have head adequately covered, i.e. hat, net, cap, scarf. 2.4 To wear disposable or use utensils for food handling where practical. 2.5 To have access to a wash hand basin, soap nailbrush and disposable towels. 2.6 To have access to an approved sanity facility. 3. FOOD HYGIENE

3.1 All food to be protected from dust, flies, sunlight, human breath and touch. (The public must not be permitted to service themselves with unwrapped food).

3.2 Potentially hazardous food, i.e. meat, egg products, dairy products, poultry and rice to be maintained at temperature below 5C or above 60C. Cold food to be reheated on a stove or microwave oven prior to placement in Bain Maries.

3.3 Raw food and cooked food to be stored and handled separately to prevent cross contamination. 3.4 All food to be stored clear of the floor or ground covering. 3.5 Food is to be delivered to temporary functions in approved food handling vehicles or containers.

The delivery of unprotected food in private cars or wagons is not permitted. 3.6 All rubbish from temporary and food premises is to be removed frequently and not allowed to

accumulate. 3.7 All food and drink to be dispensed in disposable containers or disposable plates with disposable

utensils as required. 3.8 All food to be prepared or cooked in approved food handling premises, a domestic kitchen is not

approved.

GUIDELINES BARBECUE COOKING – SAUSAGE SIZZLES

These guidelines only apply to small scale, short term charity, club or promotional barbecues of a non-commercial nature.

1. APPROVAL 1.1 Events which are held on Council controlled property require approval from the

Council prior to the event. 1.2 Events help on private property do not require Council approval.

Special event permits are not required for these events.

2. FACILITIES 2.1 Barbecue facilities should be clean and well maintained and isolated from the

public using barricades or ropes. 2.2 An adequate number of tables, storage units and insulated containers to be

provided 2.3 A suitable shelter or shade to protect food from the direct rays of the sun is

required. 2.4 A supply of clean water for hand washing to be provided if facilities are not

available within 50 meters of the cooking area. 2.5 Waste bins to be provided adjacent to the barbecue area.

3. FOOD HANDLING

3.1 All food should be covered and not stored on the ground. 3.2 Meat products must not be a stored below 5C in an insulated container. 3.3 Food handlers should use utensils and gloves where practical, and wear clean

washable protective clothing. 3.4 Food should be fully cooked and served immediately. Serving undercooked meat at

such events or holding products hot without the proper facilities is potentially hazardous and must be avoided.

3.5 Rolls or similar products should only be handled on clean surfaces. Wooden trestle or tables should be covered with clean clothes or plastic sheets.

Advice on food handling is available from the Council’s Environmental Health Officers.

Application Form for a Trading in Public Places Licence (Street Market, Street Trading, Street Entertainment or Outdoor Dining)

Trading in Public Places Local Law 1999

This Form is to be used for the purposes of obtaining a trading licence under the City of Wanneroo’s Trading in Public Places Local Law 1999. Licences may be in the form of an Outdoor Dining Licence, Street Market Licence, Street Trading licence or Street Entertainment Licence. Applications should be lodged at least 2 weeks prior to the event to allow sufficient time for processing. Applications providing insufficient information or less than 2 weeks notice may be refused. This is a:

Copy of current public liability insurance in a sum not less than $10 million. Written confirmation of consent by the property owner where land is privately owned but not by the

This Form is to be used for the purposes of satisfying the requirements, under the Food Act 2008, of an exempted food business to provide notification to the Local Authority. Food business is a charity or community group not involving the handling of potentially hazardous food (PHF - food requiring temperature control to prevent the growth of pathogenic microorganisms or the formation of toxins).

Food business is a charity or community group whereby food is for immediate consumption after being appropriately cooked e.g. sausage sizzle.

Food business consists solely of selling food that is not potentially hazardous food and is contained in a closed package so that it can not be handled in the course of conducting the food business e.g. lolly counter at a chemist or newsagent.

Important Information: An exempted food business is exempted from registration only. They are still required to comply with the remaining requirements of the Food Act 2008 and Australia New Zealand Food Standards Code. In particular food handlers should have sufficient skills and knowledge to ensure only safe and suitable food is provided. Adequate measures should be taken to ensure the premises and all equipment is maintained in a clean and hygienic condition and food is protected from contamination. Food must also comply with the labelling requirements of the Australia New Zealand Food Standards Code. Food businesses operating as stalls at events must also comply with the City’s Trading in Public Places Local Law 1999. A separate trading in public places application may also be required.
