true democratic self-government under yourwarmencouragement andmuch interest.

●서대문구명칭은 1394년조선왕조한양천도시도성축조와 4대문중의하나인돈의문(서대문)이건립되면서지역명호칭●서대문구행정구역은조선조한성부 5부 52방중서부지역의반송방,반석방과북부의상평방,연희방,영은방 5개의일부지역으로이루어져시작되었으며,

● 1940. 7. 1. 경성부서부출장소설치→서대문사무소서대문구역소개칭(1943.6.10)● 1945.10. 16. 구제실시로서대문구역소를구청으로개칭

▶의원의회는구민의보통,평등,직접,비밀선거에의해선출된 13명의지역구의원과 2명의비례대표의원으로서총 15명으로구성되었다.

▶의장·부의장의회는의장,부의장각 1인을두되본회의에서무기명투표로선출하며,임기는각 2년으로한다.

▶상임위원회상임위원회는집행기관의부서별소관업무에따라운영위원회등 3개상임위원회로구성되어있으며의안과청원등을심사처리한다.특별한안건이나수개의상임위와관련되는안건의심사를위해서특별위원회를본회의의결로설치할수있다.

▶의회사무국의회의사무를처리하기위하여사무국을설치하고사무국장과필요한직원을두고있다.

▶MembersTheCouncil is composed of 15members elected by general, equal, secret election.

▶Chairman·Vice Chairman of councilEach one out of members is elected at the general meeting room by a secret vote for chairman and vice chairman.Their term lasts 2years, but, one and a half year pertaining to the second councilmembers only.

▶Standing committeeThe standing committee is consisted of three departments (includes administration) depending on the department’s responsibilities. The committee takes care of pending bills and petitions. If there are special bills pending, thestanding committee can organize a special committee to take care of those special cases.

구의원의무·임기 · | Responsibilities Termof District Council Members

▶의원의의무

의원은구민의대표자로서공공의이익을우선하여양심에따라그직무를수행함은물론,청렴의의무와품위를유지하여야하며,그지위를남용하여지방자치단체,공공단체또는기업체와의계약이나그처분에의하여재산상의권리,이익또는직위를취득하거나타인에게그취득을알선하여서는안된다.또한법령에규정한일정한직을겸할수없다.

▶의원의임기

의원의임기는 4년으로총선거에의한전임의원임기만료일의다음날로부터개시된다.다만,보궐선거에의한의원의임기는당선이확정된때부터개시되며,전임자의잔임기간으로한다.

▶Responsibilities ofMembersMembers of local council shall execute their duties for the good of public benefit to all one's conscience. Members

of local council shall lead an honest life and keep their fignities as represenrative. Members of local council shall

not abuse their position to gain right, profit for gaining property or position by entering into a contract with of a local

government, a public or an enterprise or offer an acquisition for others.

In addition, they shall not hold concurrently specific position prescribed by the law.

▶Termof MembersThe term of members shall be 4-years which begins on the neat the term of the predecessors hava expored due to

their being elected in general election.

▶윤리강령

의원은주민의대표로서양심에따라그직무를성실히수행하여주민으로부터신뢰를받을수있도록준수해야할윤리

강령은다음과같이정한다.

1.주민의대표자로서인격과식견을함양하고예절을지킴으로써의원의품위를유지하며,주민의의사를충실히대변한다.2.주민을위한봉사자로서주민의복리의증진을위하여공익우선의정신으로성실하게직무를수행한다.3.공직자로서직무와관련하여부정한이득을도모하거나,부당한영향력을행사하지아니하며,청렴하고검소한생활을솔선수범한다.

4.의회의구성원으로서상호간에기회균등을보장하고충분한토론으로문제를해결하며,적법절차를준수한다.

5.책임있는의원으로서모든공사행위에관하여주민에게책임진다.

▶PLATFORMOFETHICSAs the representative of inhabitants, we, the members of Assembly, hereby fix the siplatform of thefollowing Ethics to be observed so that we canwin the inhabitants by performing or duties according tothe dictates of our conscience:

1. As the representative of inhabitants, we will ennoble ourselves and reflect the will of the people faithfully bycultivating characters and exalted ideas and observe the proprieties.

2. For the promotion of inhabitants welfare, we will perform our duties with all sincerity under the publicinterests first principle.

3. As the public post holders, wewill take the lead of upright and frugal life and neverwork for oblique dealingsor exercise unfair influence related to our duties.

4. As the members of Assembly, we will secure the equality in opportunity, settle problems after muchdiscussion and observe due formalities.

5. As the members of Assembly with strong sense of responsibility, we will deal with all public and privatematters on our own responsibility,

지방의회는조례의제·개정또는폐지,예산의심의·확정및결산승인,중요사항에대한동의·승인등의의결권이있어정책집행에관여하게되고행정사무의감사및조사활동을통하여집행부의행정집행에대한통제기능도가지고있다.그밖에청원의수리,기타법령및조례에의하여그권한에속한사항들을처리한다.

▶조례제·개정및폐지조례란지방자치단체가지방의회의결을거쳐제정하는법형식으로서대문구조례는서대문구의법률이라할수있는것이다.조례는법령의범위안에서그사무에관하여조례를제정할수있으므로법령에저촉되어서는안됨은물론,법령이정하는이상으로주민에게불리한내용을담아서도안된다.현행법은주민의권리제한또는의무부과에관한사항이나벌칙을정할때에는법률의위임이있어야한다라고규정하고있다.

The local council holds resoultion as legislation · revison or abolishment of an ordinance or deliberation·confrimation

and settlement acknowledgement of budget, agreement· acknowledgement upon impertant issues, etc. so that itmay

engage in policy execution and also via inspection and survey activity on administrative office work, may have control

function over administrative execution of the executive organ. In addition, it deals with tasks belong to the authority by

means of acceptance of petition, and in accordancewith other laws and ordinances.

▶Legislation andRevisionAbolishment of OrdinanceLegislation and Revision Abolishment of Ordinance For the ordinance is a law form legislated throughlocal council resolution by the local government, Seodaemun District's ordinance may be called the law ofSeodaemunDistict.Since the ordinance may be legislated only with in the scope of law conceming the office work, ot shall notviolate the law and shall not contain contents unfavorable to inhabitants beyond the regulation of the law.The surrent law specifies that when deciding issues such as restrictions on inhabitant's right, or charging ofliability,mandation of the law is required.

조례제정절차 | Procedures of HandlingOrdinance bill

의회는의결에대한구청장의재의요구시재의에붙여재적의원과반수출석과출석의원 2/3이상의찬성으로전과같은의결을하면그조례안은조례로써확정된다.

When the recinsideration is requested by the head of district office toward the resolution of the council, and ifthe council puts it onto recinsideration, with the attendance of themajority of the regesteredmembers and theapproval of two third of the attended members are required in order to reach the resolution same as before,then the ordinance bill shall be acknowledged as the ordinance.

▶예산안의심의·확정및결산승인

예산은서대문구의한해동안의살림규모라할수있다.예산안은구청장이편성하고,의회에서심의확정하며,결산은구청장이예산을집행한후의회승인을받도록하고있다.구민들이내는세금이한푼도낭비되지않도록하기위하여엄격한심의의결절차를거치고있다.

▶Deliberation·Confirmation Settlement Acknowledgement of BudgetThe budget can be regerred as one year's expenditure estimate of SeodaemunDistrict. The budget is compiledby District head, and is investigated and confirmed by theDistrict council. The settlement of the budget shall beacknowledged by theDistrict council after district head executes the budget.For the budget to be compiled and executed without waste of tax from District inhabitants, the District councilfollows strict examination and dicision procedires.

예산안편성·제출(구청장) |Preparation and Submission of Budget(Head of District office)

•회계연도개시 40일전까지의회에제출

Submission to the council 40days before starting of the fiscal year.

종합심사(예산결산특별위원회) |General Examination(Budget·Settlement Special Committee)

•의회는구청장의동의없이지출예산각항의금액을증액하거나새비목을설치할수없다.

The council increase the amount of each account of expense budget or install new account without approvalhead of District office.

•구청장은예산안을제출한후부득이한사유로그내용의일부를수정하고자할때는수정예산안을작성하여제출한다.

In case content of budget needmodification after submission og budget bill, the head of district office shallprepare and submitmoditied budget.

심의의결(본회의) |Deliberation Decision(GeneralMeeting)

•회계연도개시 10일전까지의결

Decide 10days before starting fiscal year.

•의장은의결된예산안을 3일이내에구청장에게이송

The chariman shall transfer decided to the head of district officewithin 3days.

승인요구(구청장) |Request of Acknowledgement(Head of District office)

•구청장은출납폐쇄후 80일이내에결산서작성

The head of district office shall prepare a settlement report within 80 days after closing the account

심의의결승인(본의회) |Examination Determination Acknowledgement(GeneralMeeting)

•결산승인은한회계연도의수입과지출에대한실적을사후통제받는것으로의회의승인절차를거쳐야한다.

Budget acknowledgement is an ex-pos-facto control of the performance on income and expense of a fiscal year, andthismust become receiving an acknowledgement of the council.

•이미집행된예산을무효또는취소시킬수는없으나장래에있어서구재정계획의효율적운영을위한참고자료로활용된다.

Budget already disposed cannot nullified or canceled, but used for reference for efficient operation of districtadminstration in the future.

▶행정사무감사및조사

의회는집행기관에대하여매년정례회기간중에 9일이내로행정사무감사를실시하고,특정사안에관하여는재적의원 3분의 1이상의서면발의에의하여본회의의결로행정사무조사를할수있다.

감사또는조사시에는현지확인,서류제출요구,구청장또는관계공무원이나그사무에관계되는자를출석하게하여증인으로선서한후증언하게하거나참고인으로서의의견의진술을요구할수있다.

증언에있어허위증언을한자에대하여는고발할수있으며,출석요구에응하지아니하는경우및서류를정해진기한까지제출하지아니한경우에는 300만원의과태료를부과하며,증인이선서및증언을거부하는경우에는 200만원의과태료를부과한다.구청장또는관계공무원은의회나그위원회에출석하여행정사무의처리상황을보고하거나의견을진술하고,질문에응답할수있다.

▶Supervising andExaminingAdministrationDeskWorkThe council implements administrative affairs auditing to the executive organ within 9days during the annualordinarymeeting, and it is possible to take an investigation of administrative affairs for a specific agenda by thedecision of this council with thewritten suggestion of one-third of enrolledmembers.

If needed, the councilmay perform site investigation or ask submission of dicuments.The council may have District hede, concerned offcials or responsible person attend to the meeting totestimony or state opinion as awithess.

When it comes to testimony, it can be accused of the person giving false testimony, in the cases of the personwho doesn’t accept the attendance requirement, and who doesn’t submit documentaries on time, we willcharge a fine of 3 million won, in the case that witness rejects oath and testimony, we will charge a fine of 2millionwon.

▶청원의수리및처리청원은구민이구정에관한희망이나개선사항을구의회의원의소개를받아서면으로제출하는제도이다.

▶Reception andProcessing of PetitonPetitioning is a system for the Gu citizens to file what they think desirable or what to be improved of the Guadministration inwriting through the introduction by a councilmember.

The member introducing a petition shall explain purport of the petition asrequested by the concerned committee or Generalmeeting.

•본회의에 부의할 필요가 없다고 결정할 때, 그 처리결과를 의장에게 보고하고, 의장은청원인에게통지

In case of deciding as not necessary to send a petition to the generalmeeting,the result of processing shall be reproted to chariman, and the chairmanshallmotify the result to the titioner

구의회운영 | District Council Operation

▶본회의

의회의의사를최종적으로결정하는본회의는재적의원 3분의 1이상의출석으로개의하며,특별한경우를제외하고는재적의원과반수의출석과출석의원과반수의찬성으로의결한다.의원이발언하고자할때에는미리의장의허가를받아야하며질의,보충발언,의사진행발언및신상발언을할수있다.의장은의결에있어서표결권을가지며,가부동수일때는부결된것으로본다.

의회의회의는공개한다.다만의원 3인이상의발의로출석의원 3분의 2이상의찬성이있거나의장이사회안녕질서유지를위하여필요하다고인정한경우공개하지아니할수있다.의회에제출된의안은회기중에의결되지못한이유로폐기되지아니한다.다만,의원의임기가만료된경우에는그러하지아니한다.의회에서부결된의안은같은회기중에다시발의또는제출할수없다.

▶상임위원회

상임위원회는각종의안을전문적이고능률적으로심사하기위하여의회내에설치되는회의기관으로서회기중에위원장이

필요하다고인정하거나재적위원 3분의 1이상의요구가있을때개회한다.다만,폐회중에는위원회의의결이있거나의장이필요하다고인정할때,구청장의요구가있을때개회하여안건등을심사할수있다.서대문구의회에는의회운영위원회,행정복지위원회,재정건설위원회가있다.

▶특별위원회

의회는특정한안건을심사하기위하여필요한때에는본회의의의결로써특별위원회를구성할수있으며,예산결산특별위원회및행정사무조사특별위원회등이있다.

▶GeneralMeetingThe Generalmeeting where the proceedings of the council are finally decided opened by the presence ofmorethan 1/3 of the registered members, and the passage of bill, except in special cases, requires the majorityattendance of members and the majority votes of the members present, Members desiring to make speechmust obtain prior approval of the chairman, and members may present questions, make supplementaryspeech, speak on proceedings or present personal opinions. The chairman has votes with respect to dicisionmaking, and in case of a tie vote, thematter is regarded as rejected.Council meeting are opened to the general public. However, if agreed by more than 2/3 of the attendingmembers at themotion ofmore than 3 council members, or if deemed necessary by the chairman tomaintainsecurity and order,meetingsmay beheld in closed session.Bill presented to council meetings remain alive when they are not decided during the session, except in thethat case the office terms of councilmembers have expired.Bils rejected at themeeting cannot bemoved or submitted again during the same session.

▶StandingCommitteeAn institution established within the council to examine professionally and efficiently a variety of bills, thestanding committee is opened during the session when it is deemed necessary by the chairman of theregistered members. However, if the session is over, a meeting may be convened to examine bills at theresolution passed by the committee, or when deemed necessary by the chairman or requested by District head.



At present, there are three committees at(Seodaemun District Council, Council steering committee,Adminstration andWelfare Committee, Financial and Construction Committee.)

▶Special CommitteeMay be Convened to examine bill at resolution padded by the committee, or when deemed necessary bythe chairman or requested by District head. At present, there are three committees at Seodaemun DistrictCouncil, Council steering committee, general affairs committee and civic construction committee.

구의회운영 | District Council Operation

주민대표기관,의결기관,입법기관,감사기관으로서의지위를갖는지방의회는정례회와임시회로나누어회의를진행하며,의회운영은본회의,상임위원회,특별위원회활동으로운영되고있으며정례회는매년 6월세번째목요일과 11월세번째금요일에개회된다.임시회는구청장이나재적의원 3분의 1이상의요구가있을때에는의장이 15일이내의기간으로소집하며다만,총선거후최초로소집되는임시회는구청장이구의회의원임기개시일로부터 25일이내에소집한다.연간회의총일수는정례회및임시회를합하여 120일을초과할수없다.임시회의소집공고는집회일 5일전에하며,구청장이의회에부의할안건은구청장이공고한다.

A local council which has a role of Representative organization of citizens, Deliberative organ, Legislativeorgan, and Auditing institution advances conference dividing into the ordinary meeting and the temporarymeeting, for the operation of national assembly, it is advanced by Regular session, Standing committee, andSpecial committee’s activities, the ordinary meeting is hold on the third Thursday of June, and the third Fridayof November every year.In case that there is an ask by more than one thired of registered members, a temporary meeting shall beconvoked within 15days for the period of 15 days or less. But the first temporary meeting after the generalelection shall be convoked within 25 days from the starting date of the tenure of the council member. Totalmeeting dates including regular and temporary meeting shall not exceed 120 days. For the announcement oncall of Temporary conference, it will be done before 5 days of assembly, the agenda which the head of Gu willsuggest to the council is announced by the head of Gu.
