    Politica de concuren este general recunoscut ca un factorcrucial pentru crearea condiiilor adecvate necesare asigurriicreterii economice sustenabile i pentru prosperitate. Prininfluenarea deciziilor privind investiiile, procesele deconcentrare economic, preuri i performana economic,politica de concuren are o contribuie esenial la asigurarea

    progresului economic i la bunstarea cetenilor. Ca efect al manifestrii concurenei, firmelesunt obligate s devin mai competitive, fapt care ar trebui s conduc la diminuarea saumcar la meninerea nivelului preurilor pe pia.

    n condiiile crizei economico-financiare pe care o traversm, asigurarea unui mediuconcurenial normal este un obiectiv major, dar dificil, pentru toate statele i autoritile deconcuren. n acest context, protejarea efectiv a cadrului concurenial, n vederea scderiipreurilor finale, devine esenial pentru resuscitarea consumului populaiei, ca factor derelansare i depire a perioadei de criz.

    ntr-un an n care efectele crizei economico-financiare au fost pe deplin resimite att demediul de afaceri ct i de consumatori, activitatea Consiliului Concurenei s-a axat pe

    intensificarea identificrii i sancionrii practicilor anticoncureniale, precum i perespectarea tuturor obligaiilor rezultate din statutul de stat membru al Uniunii Europene,att n domeniul concurenei ct i al ajutorului de stat.

    n calitatea sa de supraveghetor i garant al funcionrii mecanismelor unei economii depia, Consiliul Concurenei a avut n anul 2009 un rol extrem de important i n ceea ceprivete asigurarea prevalenei legislaiei concurenei asupra legislaiei mediului de afaceri.Participarea pro-activ de pn acum a reprezentanilor Consiliului Concurenei la edinelepregtitoare de Guvern a permis eliminarea din cuprinsul proiectelor de acte normative a

    prevederilor cu caracter anticoncurenial.

    Prin meninerea echidistanei i comportamentului apolitic, Consiliul Concurenei trebuie s-indeplineasc misiunea care i-a fost ncredinat, fundamentat pe valorile promovate de legislaianaional n domeniu i n deplin acord cu prevederile comunitare, respectiv aceea de asigurarea unui mediu concurenial normal, pentru aprarea intereselor economice ale consumatorului.

    Nu pot ncheia fr a mulumi conducerii anterioare a instituiei, care, alturi de noul Plenal Consiliului Concurenei, a contribuit nemijlocit la buna desfurare a activiti a autoritiide concuren pe tot parcursul anului 2009.

    FORWARD

    Competition policy is generally known to be a crucial factorin creating the adequate conditions for sustainable economicgrowth and prosperity. By influencing investment decisions,economic concentrations, prices and economic performance,competition policy has an essential contribution to theeconomic progress and citizens welfare. Competition makesundertakings more competitive, leading to the preservation or to the diminishment ofmarket prices.

    In the present economic and financial crisis, a secure normal competition environment isa major objective for all the states and competition authorities. In this context, the effectiveprotection of the competition framework aiming at lowering final prices is becomingessential for resuscitating the consumption, which is an important factor in overcomingthe crises period.

    During a year when the effects of the economic and financial crises were fully experiencedby the business environment and by consumers, the Competition Councils activity focusedintensively on identifying and sanctioning anticompetitive practices, as well as on fulfilling

    all the commitments on competition and State aid - resulted from Romanias status of EUMember State.

    As supervisor and guarantor of the mechanisms of a functioning market economy, in 2009the Competition Council had an extremely important role in ensuring the prevalence ofthe competition legislation over the business legislation. The proactive participation of theCompetition Councils representatives at the preparing reunions of the Governmentmeetings offered the opportunity of eliminating the anticompetitive provisions from thedraft normative acts.

    By preserving the equidistance and its apolitical behaviour, the Competition Council mustfulfil its entrusted mission, based on the values promoted by the national specific legislation,which is fully complying with the community rules, namely to ensure a normal competitiveenvironment in order to protect consumers economic interests.

    I can not conclude without thanking the former management of the institution, which,alongside the new Plenum of the Competition Council, contributed to the well functioningof the hole activity of the competition authority in 2009.

    COMPETITION COUNCIL AUTONOMOUS ADMINISTRATIVEAUTHORITY

    As autonomous administrative authority part of the specialized public central authorities , theCompetition Council carries out its activity based on the attributions entrusted byCompetition Law no.21/1996, republished, aiming at protecting, maintaining and stimulatinga normal competition environment so as to promote consumers interests.

    Headquarters of the Competition Council:Piaa Presei Libere nr.1, corp D1, Sector 1, Bucharest, Romania.

    The Plenum of the Competition Council is a collegial body and is made up of 7 members, as follows:on president, 2 vice-presidents and 4 competition counsellors. The President of Romania appointsthe members of the Competition Council plenary session, at the proposal of the Government. Starting

    INTRODUCERE

    Anul 2009 a nsemnat pentru Consiliul Concurenei intensificarea eforturilor depuse n vedereandeplinirii atribuiilor legale, att n domeniul concurenei, ct i al ajutorului de stat.

    n domeniul concureneiau fost deschise 27 de investigaii, un numr dublu fa de anul2008. Activitatea pro-activ a autoritii de concuren n identificarea i sancionareapracticilor anticoncureniale a avut ca efect creterea semnificativ a investigaiilor deschiseprin autosesizare, numrul acestora majorndu-se n 2009 cu 130% fa de anul anterior.Totodat, au fost efectuate inspecii inopinate la 50 de ageni economici activi pe pieelesupuse investigaiilor autoritii de concuren.

    Este de menionat c mai mult de jumtate din totalul investigaiilor deschise suntinvestigaii declanatepentru posibila nclcare a legislaiei naionale i comunitare

    n domeniul concurenei. Prin comparaie, n anii 2008 i 2007, astfel de investigaii aureprezentat 20% din totalul investigaiilor deschise pentru practici anticoncureniale.

    n anul 2009, o atenie sporit a fost acordat activitii de monitorizare pro-activ apieelor, n acest sens fiind declanate 5 investigaii sectoriale fa de 2 n anul 2008 i doaruna singur n anul 2007. Pieele selectate pentru analiz n anul 2009 sunt: serviciile de

    transport maritim, comercializarea laptelui n stadiul economic productor-procesator, pieselede schimb pentru automobile, distribuia angro de medicamente i energia electric.

    Au fost finalizate 3 investigaii sectoriale iniiate n anii anteriori, viznd domenii cu unimpact deosebit asupra consumatorilor: cerealele de panificaie, comerul cu amnuntul alproduselor agroalimentare i piaa imobiliar i a serviciilor conexe tranzaciilor imobiliare.

    n urma finalizrii acestora, Consiliul Concurenei a formulatrecomandri i a intervenitla nivelul instituiilor publice competente n aceste domenii. Rezultatele analizelorsectoriale viznd distribuia angro de medicamente, respectiv comercializarea cu

    amnuntul a produselor alimentare, au constituit un punct de plecare n deschiderea unorinvestigaii privind posibila nclcare a legislaiei de concuren.

    n anul 2009, au fost aplicate amenzi n valoare de 8.755.512 lei (2.377.471 euro), dincare 90% reprezint amenda aplicat n urma investigaiilor n cazurile coli de oferi ipiaa pinii. Au fost sancionai 80 de ageni economici i o asociaie pentru nelegeriprivind fixarea de pre/tarif.

    Numrul celor sancionai n anul 2009 pentru implicarea n nelegeri anticoncureniale, dar

    i pentru omisiunea sau punerea n practic a unor operaiuni de concentrare economic, afost de 87 de operatori economici i o asociaie, comparativ cu 20 operatori economici nanul 2008 i doar 3 n anul 2007.

    INTRODUCTIVE REMARKS

    In 2009, the Competition Council intensified its efforts for implementing its legal attributionsin the field of competition and State aid.

    In the field of competition,27 de investigations were initiated, a double number comparedto 2008. The proactive activity of the competition authority for identifying and sanctioning theanticompetitive practices had as a result the significant increase of the ex-officio investigations,which increased in 2009 by 130% compared to the previous year. At the same time, dawnraids were carried out at the headquarters of 50 undertakings operating on the marketsanalysed within the competition authoritys investigations.

    It is worth mentioning that more that half of the total number of the openedinvestigations is envisaging possible infringements of the national and Communitylegislation on competition. Compared to2008 and 2007, such investigations represented20% of the total initiated investigations envisaging anticompetitive practices.

    In 2009, a special attention was paid to the proactivemarket monitoring;as a result, 5sector inquires were initiated, compared to 2 in 2008 and to only one in 2007. The marketsselected in 2009 to be analysed are: maritime transport services, commercialisation of

    milk between producers and processors, auto spare parts, drug wholesale distribution andelectrical energy.

    3 sector inquires opened in the previous years were finalised. These procedures envisagedfields with a special impact over consumers: bread grains market, food productscommercialization and real estate market and the interconnected services to the real estatetransactions. As a result of the concluded investigations, the Competition Councilformulated recommendations and intervened to the competent public institutions inthese fields. The results of the sector inquires in drug wholesale distribution and

    food products commercialization were the starting point for certain investigations onpossible competition law infringements.

    In 2009, fines of 8,755,512 Lei ( 2,377,471) were applied, out of which 90%represented the fines applied in the driving schools and bread market cases. In thiscases, 80 undertakings and an association were sanctioned for tariff/price fixingpractices.

    In total, 87 undertakings and an association were sanctioned in 2009 for theinvolvement in anticompetitive agreements and for failing to notify or for implementingcertain economic concentrations, compared to 20 undertakings in 2008 and to only3 in 2007.

    Valoarea taxelor de autorizare, stabilite pe baza deciziilor de neobieciune i de autorizarea anumitor concentrri economice, s-a ridicat n anul 2009 la 8.577.085 lei, respectiv2.329.021 euro.

    Amenzile i taxele de autorizare au adus la bugetul de stat un plus de 17.332.597 lei(4.706.492 euro).

    n vederea depistrii i sancionrii celor mai grave nclcri ale legislaiei de concuren,Consiliul Concurenei a iniiat procesul de reformare a programului de clemen. Programul

    i propune s pun n practic politica de clemen, revizuit dup modelul Reelei Europenede Concuren. n acest scop, n luna august 2009, au fost revizuite i puse n aplicareInstruciunile privind condiiile i criteriile de aplicare a politicii de clemen. Reglementareatranspune n legislaia de concuren din Romnia noile prevederi comunitare n domeniu.

    n plus, prin aceste instruciuni, aria de aplicare a politicii de clemen este extins i asupra

    anumitor nelegeri anticoncureniale verticale.

    n domeniul ajutorului de stat, activitatea Consiliului Concurenei a fost subsumat respectriiobligaiilor ce decurg din calitatea Romniei de stat membru al Uniunii Europene, precum ide ndeplinire a atribuiilor specifice dobndite de autoritatea de concuren dup momentul1 ianuarie 2007. n acest sens, Consiliul Concurenei a ncurajat colaborarea dintre instituii

    In 2009, the value of the authorising taxes established based on the non-objection andauthorising decisions of certain economic concentrations was of 8,577,085 Lei, namely 2,329,021.

    The authorising taxes and the fines brought 17,332,597 Lei ( 4,706,492 euro) to theState budget.

    In order to detect and sanction hard core infringements of the law, the Competition Councilinitiated the process of reforming the leniency programme. The programmes objective isto put in application the leniency policy, reviewed according to the model of the EuropeanCompetition Network. In this respect, in August 2009, the Guidelines regarding theconditions and application criteria of the leniency policywere reviewed and put into effect.The guidelines transposed the new Community provisions into the Romanian competitionlegislation. In addition, by these guidelines, the application aria of the leniency policy was

    extended over certain vertical anticompetitive agreements.

    In 2009, the activity of the Competition Council on State aidwas subsumed to the generalactions designed to ensure the fulfilment of Romanias commitments as EU Member State,as well as to implement the specific attributions acquired by the competition authority afterthe 1st of January 2007. In this respect, the Competition Council encouraged the cooperationbetween institutions for elaborating the initial draft State aid scheme, granted specialisedassistance and fulfilled its role of national contact authority in the field between theEuropean Commission and the State aid suppliers and beneficiaries.

    In 2009, 13 formal opinions were issue concerning 2 information sheets and 11notificationsof State aids; 33 State aid support measureswere elaborated (from nationaland Community funds) based on the temporary rules related to the economic and financialcrisis, as well according the typical Community regulations.

    In 2009, based on the provisions of the EU Accession Treaty or at the request of theEuropean Commission, the Competition Council drafted and transmitted to the EuropeanCommission the following reports:

    The situation on existing State aids;

    Biannually reports on the monitoring of the State aids granted for thebeneficiaries in the motor vehicle sector which are operating in deprived areasand free zones;

    The Report on the monitoring of the State aids granted to undertakingsoperating in free zones;

    The Report on the fulfilment of the granting conditions of the State aids indeprived area and on the measures taken in nonobservance cases;

    The situation on the State aids for research, development and innovation.

    Totodat, n baza reglementrilor naionale, Consiliul Concurenei a elaborat:

    n scopul crerii unui colectiv de lucrula nivel naional, care s grupeze experii n ajutor de stat dincadrul Consiliului Concurenei i pe cei angajai n cadrul instituiilor furnizoare de ajutor de stat,Consiliul Concurenei a pus accent n anul 2009 pe dezvoltarea Reelei Naionale de Ajutor de Stat.

    Din punctul de vedere al recuperrilor/rambursrilor de ajutoare de stat ilegale, suma totalrecuperat de ctre furnizorii de ajutor de stat n cursul anului 2009 a fost de 15.021,00lei, iar valoareatotal cumulat a recuperrilor efectuate n perioada 2005-2009 a fost de 256.742.945,81 lei.

    Promovarea legislaiei concurenein rndul tuturor factorilor implicai n procesul de elaborare aactelor normative, precum i a importanei respectrii acesteia a reprezentat o activitate permanenta autoritii de concuren pe tot parcursul anului 2009. n acest sens, Consiliul Concurenei aemis un numr de 8 avize, din care 50% cu observaii i propuneri de modificare, 9 punctede vedere i 10 intervenii de modificare a unor acte normative deja n vigoare.

    Activitatea n domeniul relaiilor externes-a concretizat n participri active la reuniuni pe diferitetematici, precum i la grupurile i subgrupurile de lucru din cadrul ECN, ICN, UNCTAD, OCDE. Lasfritul anului 2009, implicarea activ a autoritii romne de concuren n activitile OCDE,precum i eforturile susinute ale instituiei pentru mbuntirea continu a activitilor sale depromovare i aplicare eficient a politicii concurenei au fost recunoscute de ctre acest forinternaional de excelen n domeniul concurenei. Comitetul de Concuren al OCDE a recomandatConsiliului OCDE rennoirea, pn la sfritul anului 2011, a statutului de observator alRomniei la structurile de lucru ale organizaiei din domeniul concurenei.

    n domeniul promovrii culturii concurenei, la nivelul anului 2009, s-au organizat peste 1.100de aciuni, sub forma seminariilor, meselor rotunde, a dezbaterilor inter-intradepartamentale, amanifestrilor n cadrul Proiectului de Twinning, precum i ntlniri cu autoriti dereglementare i alte instituii, n cadrul protocoalelor de colaborare ncheiate cu acestea.

    Formarea profesional a personalului Consiliului Concurenei a deinut i n anul 2009 oimportan major. n acest sens au fost organizate un numr de 19 cursuri de perfecionareprofesional la care au participat 165 de angajai, din care 89% funcionari publici i 11%personal contractual. De asemenea, au fost organizate un numr de 60de seminarii, dincare 50% realizate n cadrul Proiectului de Twinning.

    Transparena activitiia fost asigurat prin actualizarea permanent a site-ului oficial al instituieicu informaii legate de activitatea autoritii de concuren. Relaia cu mass-media a fostintensificat, numrul de apariii n pres fiind de 1859, din care 80% n presa central.

    At the same tine, based on the national legislation, the Competition Council drafted:

    The Report on the State aids granted in Romania during 2005-2007;

    The Report on the monitoring of the State aids for rescuing and recoveringfirms in difficulty;

    Report on the transparency of the financial relations between the publicauthorities and the public undertakings, as well as the financial transparencywithin certain undertakings for the period 2007-2008.

    Aiming to create a working groupat national level, to cluster State aid experts from theCompetition Council and from the State aid granting institutions, in 2009, the CompetitionCouncil focused on developing the State aid National Network.

    As regards the recovery/reimbursement of unlawful State aids,the total sum recoveredfrom the State aid suppliers in 2009 was of 15,021.00Lei, and the aggregated value ofthe recoveries during 2005-2009 was of 256,742,945.81 lei.

    Promoting the legal frameworkon competitionand the importance of its compliance withinall the involved factors in the process of elaborating normative acts was a permanentactivity of the competition authority during 2009. In this respect, the Competition Councilissued 8 binding opinions, out of which 50% with observations and opinions, 9 pointsof view and 10 interventions for amending certain normative acts in force.

    The foreign relations activitywas concretised in active participation at various reunios, andin the working groups and subgroups of ECN, ICN, UNCTAD, OECD. At the end of 2009, theactive participation of the competition authority to the OECD reunions and the efforts ofthe institution on the improvement of the competition advocacy and concerning the efficientenforcement of the competition policy were recognised by this international body oncompetition. The OECD Competition Committee recommended to the OECD Council therenewal, up to the end of 2011, of the Observatory status of Romania within theworking structures on competition of the organisation.

    In the field of competition advocacy, in 2009, over1,100 actions were organised - seminars,round tables, inter/intradepartmental debates, events within the Twinning Project, and meetingswith regulatory bodies and other institutions within the collaboration protocols concluded.

    The professional trainingof the Competition Councils personnel continued to play animportant role in 2009. Thus, 19 training sessions were organised which were attendedby 165 employees, out of which 89% public servants and 11% contractual personnel.Moreover, 60 seminars were carried out, out of which 50% within the TwinningProject.

    The transparency of the activitywas provided by updating permanently the official site ofthe institution with information on the activity of the competition authority. The relationwith the mass-media was intensified: the number of the postings in the press was of1859, out of which 80% in the central press.

    n vederea depistrii i sancionrii celor mai grave nclcri ale legislaiei de concuren,Consiliul Concurenei a iniiat procesul de reformare a programului de clemen. Programul

    i propune s pun n practic politica de clemen, revizuit dup modelul Reelei Europene

    de Concuren (ECN).

    n acest scop, n luna august 2009, au fost revizuite i puse n aplicare Instruciunile privindcondiiile i criteriile de aplicare a politicii de clemen. Reglementarea transpune n legislaiade concuren din Romnia noile prevederi comunitare n domeniu. n plus, prin acesteinstruciuni, aria de aplicare a politicii de clemen este extins i asupra anumitor nelegerianticoncureniale verticale.

    n esen, prin politica de clemen, companiile implicate n astfel de practici anticoncureniale

    au posibilitatea de a beneficia de imunitate total la amenzi sau de o reducere a cuantumuluiacestora.

    Pentru a putea beneficia de acest tratament preferenial, aceste companii trebuie s iniiezecolaborarea cu autoritatea romn de concuren, s-i pun la dispoziie toate informaiiledeinute i s o sprijine pn la finalizarea cazului.

    La sfritul anului, Consiliul Concurenei a nfiinat Modulul de Clemen, cu rolul de a asigurainterfaa dintre autoritatea de concuren i agenii economici care depun solicitri pentru

    clemen.

    1.1. Evolutions in the field of competition

    a) Legal novelties

    In a nutshell, the leniency policy permits to the undertakings involved in such anticompetitive

    practices to benefit from total fine immunity or from a reduction of its amount.

    In order to benefit from this preferential treatment, these undertakings must initiate thecooperation with the Romanian competition authority, submit all the information andsupport the institution until the end of the procedures related to the respective case.

    At the end of the year, the Competition Council established the Leniency Module, aimingat providing the interface between the competition authority and the undertakings applyingfor leniency.

    n cursul anului 2009, Consiliul Concurenei a deschis 27 de investigaii, din care85,2% prin autosesizare (23 de investigaii) i 14,8% ca urmare a unor plngeri(4 investigaii). Comparativ cu anul anterior, autoritatea de concuren i-a intensificatactivitatea de monitorizare a pieelor, numrul investigaiilor deschise prin autosesizarefiind mai mare cu 92,9% (Graficul nr. 1).

    Investigations on the possible infringement of the competition law

    During 2009, the Competition Council initiated 27 de investigations, out of which85.2% were ex-officio procedures (23 investigations) and 14.8% were openedfollowing certain complaints (4 investigations). The competition authority intensifiedits market monitoring activities: the number of ex-officio investigations increased by 92.9%,compared to the previous year. (Graph no.1).

    Autoritatea de concuren din Romnia i-a concentrat atenia i asupra mecanismelor defuncionare a unor piee, deschiznd, n acest scop, 5 investigaii utile pentru cunoatereaurmtoarelor piee (fa de dou n anul 2008 i doar una singur n anul 2007):

    Comercializarea laptelui n stadiul economic productor procesator; Piesele de schimb pentru automobile;

    Distribuia angro de medicamente;

    Out of the 27 investigations initiated in 2009, 45% have as object the possibleinfringement of art.5 of Competition Law no.21/1996, republished, and of art.101 ofthe Treaty on the functioning of the European Union ; the rest of 55% are envisagingpossible infringements of the national legislation.

    Sector inquiries

    The Romanian competition authority focused on the functioning mechanisms of certainmarkets too, by initiating 5 sector inquiries (compared to two in 2008 and to only one in2007)envisaging:

    Maritime transport services;

    Commercialization of milk between producers and processors; Auto spare parts;

    Wholesale drug distribution;

    Electric energy.

    Pentru autoritatea de concuren, acest tip de investigaie reprezint un instrument demonitorizare pro-activ a pieei, respectiv o analiz complex prin care este evaluat, la unmoment dat, situaia concurenei pe o pia naional sau ntr-un sector de activitate. nurma unor astfel de investigaii, Consiliul Concurenei poate stabili n ce msur problemeleidentificate sunt cauzate de anumite practici anticoncureniale, precum i care este impactulacestora asupra pieei.

    Rezultatele a dou dintre investigaiile utile finalizate n cursul anului 2009 s-au concretizat n deschiderea a 8 investigaii de posibil nclcare a prevederilor Legii concureneinr.21/1996, republicat, din care 4 n domeniul retail-ului i 4 n domeniul farmaceutic.Totodat, concluziile investigaiilor au permis formularea de recomandri factorilor implicai

    n supravegherea pieelor analizate.

    For the competition authority, this type of investigation represents a pro-active marketmonitoring instrument, namely a complex analysis used to evaluate at a certain pointin time the competition on a national market or on an activity sector. Following suchinvestigations, the Competition Council can establish to what extend the identifiedproblems have as source anticompetitive practices, and their impact over thesemarkets.

    Two of the sector inquires carried out in 2009 were concretized in the initiation of 8investigations on possible infringements of Competition Law no. 21/1996, republished, outof which 4 in the retail sector and 4 in the pharmaceutics field. Moreover, the conclusionsof the finalized sector inquiries allowed the formulation of recommendations to theresponsible factors involved in surveying the analyzed markets.

    Diminuarea cu 25% a numrului de investigaii finalizate n anul 2009 comparativ cu 2008

    este consecina complexitii pieelor analizate, volumului ridicat de informaii ce au fostanalizate, precum i a numrului de ageni economici activi pe pieele investigate.

    The reduction by 25% of the number of the finalised investigations in 2009 compared to 2008

    is a consequence of the complexity of the analysed markets, the high volume of processedinformation and of the number of undertakings operating on the investigated markets.

    Investigaii utile pentru cunoaterea pieelor

    Consiliul Concurenei a finalizat 3 investigaii utile pentru cunoaterea pieelor,respectiv a:

    Pieei cerealelor de panificaie;

    Sectorului comercializrii produselor alimentare;

    Pieei imobiliare i a serviciilor conexe tranzaciilor imobiliare.

    Fa de concluziile acestor investigaii utile, autoritatea de concuren a iniiat un proces dedezbatere public a rapoartelor i a sesizat factorii decideni cu privire la problemeleidentificate. Soluionarea acestora ine n primul rnd de necesitatea respectrii i aplicriilegislaiei n vigoare, precum i de monitorizarea permanent a sectoarelor analizate, n

    vederea evitrii manifestrii unor posibile distorsiuni pe pia.

    Piaa cerealelor de panificaie

    n septembrie 2007, prin Ordinul preedintelui nr. 264/06.09.2007, Consiliul Concurenei a deschis oinvestigaie util pentru cunoaterea pieei cerealelor de panificaie, al crei scop a fost de a pune n evidenorganizarea sectorului cerealelor de panificaie, modul de funcionare i mecanismele acestui sector.Investigaia s-a concentrat asupra pieei grului, ntruct aceasta deine o pondere covritoare n sectorulanalizat, iar rezultatele obinute pot fi cu uurin extinse i asupra celorlalte piee ce fac parte, fie n mod

    tradiional, fie cu caracter de noutate, din sector. De asemenea, a fost analizat i modul de organizare ifuncionare a pieei serviciilor de depozitare a grului, servicii care prezint o importan deosebit asupramodului de funcionare a pieei grului, n special prin influenarea comportamentului ofertei de gru.

    Din perspectiva scopului urmrit n cadrul investigaiei utile, raportul elaborat de autoritatea de concurena pus n eviden o serie de caracteristici i trsturi specifice, dintre care putem aminti urmtoarele:

    Att n sectorul grului de panificaie, ct i n sectorul serviciilor de depozitare a grului, preulse formeaz liber pe pia, ca rezultat al interaciunii ntre cerere i ofert, fr ca statul sintervin direct n mecanismul de formare a preurilor;

    Analiza pieei denumit generic a produciei i comercializrii grului de panificaie nu aidentificat bariere semnificative la intrare. Totui, se poate afirma c pe aceast pia se

    nregistreaz importante economii de scar i, de asemenea, c operatorii economici careintegreaz mai multe tipuri de activiti specifice sectorului beneficiaz de avantaje competitivesemnificative datorate acestei diversificri a activitii;

    O caracteristic definitorie a pieei grului de panificaie, chiar a ntregului sector agricol dinRomnia, o reprezint frmiarea proprietii agricole, care se concretizeaz n existena unuinumr foarte mare de exploataii agricole individuale (de dimensiuni foarte mici). Aceastfrmiare are un impact direct asupra eficienei i profitabilitii n sector;

    O alt trstur a pieei grului este reprezentat de asimetria puterii de negociere ntreproductorii agricoli individuali, n calitate de purttori ai ofertei, i purttorii cererii pe pia,asimetrie cu o influen semnificativ asupra formrii preurilor. Situaia este relativ similari pe piaa serviciilor de depozitare a grului, pia pe care micii productori agricoli au calitateade purttori ai cererii de astfel de servicii. Cu toate acestea, nu considerm necesar intervenia

    Sector inquiries

    The Competition Council concluded 3 sector inquires,envisaging:

    Bread grains market;

    Food products commercialization;

    Real estate market and the interconnected services to the real estatetransactions.

    The conclusions of these sector inquires were put to public consultation, with theinvolvement of all decision making factors which cam resolve the identified problems. Thisrequires the observance and the application of the legislation in force and the permanent

    monitoring of the analyzed sectors so as to prevent any market distortions.

    Bread grains market

    In September 2007, by Order of the President of the Competition Council no.264/06.09.2007,the competition authority initiated a sector inquiry in the bread grains market, aiming athighlighting the organization and the functioning mechanisms of this sector. The inquiry focusedon the bread wheat market because it holds a paramount weight in the analyzed sector, and forthe reason that the conclusions can be easily extended over the other markets included

    traditionally or recently in the sector. Moreover, the wheat storage market was analyzed too,because the services provided on this market have a crucial importance in the well functioningof the whole wheat market, especially by influencing the behaviour of the wheat demand.

    Taking into account these objectives, the report of the competition authority highlighted a seriesof characteristics and specific features, out of which we are mentioning the following ones:

    The price is formed freely on the bread wheat market and on the wheat storage services sector,as a result of the interaction between the offer and the demand, and without the directintervention of the State;

    The analysis of the market, generically named the market of wheat production andcommercialization, did not identify significant market entry barriers. However, on this marketthere are important scale economies and the undertakings integrating more types of specificactivities in the sector are benefiting from significant competitive advantages, as a result ofthis diversification of the activity;

    A defining characteristic of the bread wheat market and of the whole agricultural sector ofRomania is the disintegration of the agricultural property, which generates a very large numberof individual agricultural exploitations (of a very small dimension). This crumbling has a directimpact over the efficiency and the profitability of the sector;

    Another feature of the wheat market is the asymmetry of the bargaining power between theindividual agricultural producers - representing the offer - and the representatives of thedemand on the market; this asymmetry has a significant influence over the price formation.This situation is relatively similar on the wheat storage market, where the small agriculturalproducers constitute the demand for these services. However, a public intervention is not

    public pentru atenuarea acestei asimetrii (att timp ct nu se constat existena unor practicianticoncureniale), avnd n vedere c singurele rezultate plauzibile ale unei astfel de interveniiar fi denaturarea concurenei i ncetinirea sau chiar blocarea procesului de consolidare aproprietii agricole i de eficientizare a activitii;

    Piaa produciei i comercializrii grului n Romnia pare a fi afectat ntr-o msursemnificativ de existena unei piee negre, ponderea ridicat a acestei piee fiind invocat demuli participani la pia. Apreciem c, pentru limitarea i eradicarea acestui fenomen, caredistorsioneaz funcionarea corect a pieei, este necesar identificarea de ctre autoritilede resort a unor metode mai eficiente de control a produciei i tranzaciilor cu gru, n vedereafiscalizrii urgente;

    Formarea preurilor pe piaa grului de panificaie este puternic influenat de situaia pieelorinternaionale i de cotaiile nregistrate pe pieele bursiere externe;

    Trebuie remarcat c, n condiiile substituibilitii extrem de reduse a grului de panificaie,

    eventualele nelegeri asupra preurilor pot produce efecte de amploare asupra pieei respectivei a celor din aval. Aceste efecte pot fi amplificate i de asimetria preurilor, caracteristicpieelor agricole, care se manifest prin majorarea preurilor produselor din aval odat cumajorarea preului grului, dar i prin meninerea la cote ridicate a preului produselor din aval

    n cazul diminurii preului grului;

    Piaa serviciilor de depozitare a grului se caracterizeaz prin existena unor bariere legalesemnificative la intrarea pe pia, bariere justificate, pe de o parte, de necesitatea asigurriiunui serviciu de calitate i, pe de alt parte, de importana acestui serviciu n tranzacionareagrului, avnd n vedere c certificatele de depozit sunt titluri negociate pe piaa bursier.

    necessary for lowering this asymmetry (if anticompetitive practices are not identified). This isbecause the only results of such interventions would consist of harming competition andslowing or even blocking the consolidation process of the agricultural property and the effortof making this activity more efficient;

    The Romanian market of wheat production and commercialization seems to be affected in asignificant manner by the black market; its high weight is invoked by many market players.For limiting and eradicating this phenomenon which distorts the proper functioning of themarket, the responsible authorities must identify more efficient control methods concerningthe wheat production and transactions, so as to be taxed immediately;

    The price formation on the bread wheat market is influenced powerfully by the internationalmarkets and by the quotations registered on the external commodities exchange markets;

    We must underline that, taking into account the extremely low substitutability of the breadwheat, the possible price agreements can produce large effects on the respective market and

    on the downstream markets. These effects can be amplified by the asymmetry of the prices,which is a characteristic of the agricultural markets, including for the market of wheatproduction and commercialization. The result consists in increased prices for the downstreamproducts and for the wheat, as well as in maintaining the prices of the downstream productsat high levels, whilst the wheat price is lowering;

    The market of wheat storage services has certain significant legal market entry barriers justifiedby the necessity of quality services, by the importance of this service in the wheat transactions,taking into account that the storage certificates are negotiable titles on the commoditiesexchange market.

    Piaa imobiliar i a serviciilor conexe tranzaciilor imobiliare

    Declanat prin Ordinul Preedintelui Consiliului Concurenei nr.115/1.04.2008, investigaia utilpentru analizarea pieei imobiliare i a serviciilor conexe tranzaciilor imobiliare s-a axat, nprincipal, pe:

    prezentarea mecanismelor care guverneaz piaa imobiliar, a surselor de ineficien economici a riscurilor la care este expus aceasta;

    descrierea elementelor specifice pieei imobiliare din Romnia i a eventualelor riscurisuplimentare generate de acestea;

    evaluarea gradului de concuren i a efectelor acestuia asupra consumatorilor pe piaaserviciilor de natur juridic prestate de notarii publici, pe piaa serviciilor de intermediereprestate de ageniile imobiliare, pe piaa serviciilor cadastrale prestate de experii geodezi,precum i pe piaa serviciilor de evaluare imobiliar prestate de experii Asociaiei Naionale aEvaluatorilor din Romnia (ANEVAR).

    Raportul investigaiei a pus n eviden urmtoarele concluzii, aferente fiecrui serviciu analizat,respectiv:

    Servicii notariale.Serviciile notariale reprezint un cost obligatoriu al tranzaciilor imobiliare. nRomnia, acestea sunt caracterizate prin existena dreptului de exclusivitate de prestare deinut

    de notarii publici, bariere cantitative la intrarea pe pia i tarife minime stabilite de reprezentaniicorpului profesional al notarilor publici i aprobate de Ministerul Justiiei. Limitarea posibilitatilorde promovare i alocarea geografic a notarilor reprezint restricii suplimentare ale concureneipe aceast pia. n condiiile n care gradul de reglementare este mult mai ridicat nivelul deprotecie real a consumatorilor msurat de indicele aferent este mai sczut dect media stateloreuropene cu sisteme notariale similare.

    Restricionrile constatate nu i gsesc justificarea n raport cu principiul proporionalitii i auefectul de a proteja notarii care nu sunt supusi dect n mic msur jocului liber al cererii si alofertei, ceea ce dezavantajeaz consumatorii.

    Romnia are, raportat la venitul mediu pe cap de locuitor, unul dintre cele mai scumpe sistemede servicii notariale aferente tranzaciilor imobiliare.     Serviciile de intermediere.Serviciile de intermediere imobiliar nu sunt reglementate, iarcompetiia ntre ageniile imobiliare se desfoar pe o pia cu structur concurenialdeterminat n primul rnd de lipsa barierelor la intrare. Cu toate acestea concurena prinpre este destul de sczut, acest fapt datorndu-se unor factori care in de specificulactivitii.

    Real estate market and the interconnected services to the real estate transactions

    The sector inquiry in the real estate market and the interconnected services to the real estate

    transactionswas initiated by Order of the President of the Competition Council no.115/1.04.2008

    and focused mainly on:

    presenting the mechanisms governing the real estate market, the source of the economic

    inefficiencies and the involved risks;

    describing the specific elements of the Romanian real estate market and of the possible

    additional risks generated by them;

    assessing the competition level and its effects for consumers on the market of legal services

    provided by public notaries, on the market of intermediating services provided by the realestate agencies, on the market of cadastral services provided by geodesists, as well as on

    the market of real estate evaluation provided by the experts of the National Association of

    Evaluators from Romania (ANEVAR).

    The report of the sector inquiry highlights the following conclusions, specific for each analyzedsector, namely:

    Notary services. Notary services are a mandatory cost in the real estate transactions. InRomania, these services are characterized by the exclusivity right hold by public notaries,

    quantitative entry barriers and minimum tariffs established by the representative of the

    profession and approved by the Ministry of Justice. The promotion restrictions and the

    geographical allocation of notaries are additional restrictions of competition. The regulation

    level is much higher, whilst the level of the real protection of consumers measured by the

    associated index is lower compared to the average registered by the European states having

    similar notary systems.

    The identified restrictions are not justified by taking into account the proportionality principle and

    have the aim of protecting the notaries interests, which are not subject to the free interaction

    between demand and offer, and thus disadvantaging the interests of consumers.

    Compared to the average income per capita, Romania has one of the most expensive notary

    systems concerning the real estate transactions. Thus, the necessity of increasing competition

    on the market of notary services is obvious, at least through eliminating the restrictions on

    the number of notaries and the minimum tariffs. In addition, it was concluded that the

    exclusivity relations between notaries and banks are not transparent. Thus, consumers are not

    informed on the tariffs that must be paid for the services provided by the notaries, who are

    imposed by banks.

    Intermediating services. Real estate intermediating services are not regulated and thecompetition between real estate agencies is manifesting on a competitive market, characterized

    mostly by the lack of market entry barriers. Nevertheless, price competition is quite low, most

    probably because of certain factors related to the specific of the activity.

    Accesul unui segment tot mai mare de populaie la Internet i utilizarea acestuia ca platform decutare i promovare a proprietilor imobiliare, reprezint un fenomen care va avea un impactsemnificativ asupra profitabilitii pe termen lung n sectorul de intermediere. Acest lucru vadetermina, cel mai probabil, o cretere a gradului de concuren i, drept consecin, scderi depreuri i o cretere de ansamblu a calitii serviciilor.

    Serviciile cadastrale. Piaa serviciilor cadastrale este caracterizat de un grad ridicat deconcuren, n absena tarifelor reglementate i a barierelor cantitative la intrarea pe pia. nacelai timp, restriciile calitative de acces n profesie ndeplinesc principiul proporionalitii. Cutoate acestea, exist riscul apariiei unor acte cu caracter anticoncurenial care s stabileasclimite minime i/sau maxime ale onorariilor. Aceast situaie de incertitudine se datoreaz decizieiCurii Constituionale prin care Legea nr. 16/2007 a fost declarat neconstituional, i interpretrii

    Asociaiei Naionale de Cadastru i Publicitate Imobiliar (ANCPI) conform creia O.G. 10/2000 afost repus n vigoare.

    n absena unui astfel de risc, concurena ntre geodezi se poate manifesta att prin pre, ct iprin calitate (precizie i siguran), nivelul de concentrare de pe pia fiind foarte sczut. Aceastsituaie se reflect, n prezent, n nivelul onorariilor care este unul dintre cele mai reduse dinUniunea European (vezi Anexa XI). n Romnia, tarifele serviciilor cadastrale pentru locuinereprezint aproximativ 1/3 din media european.

    Un alt element cu impact anticoncurenial datorat legislaiei din acest domeniu este prevedereareferitoare la stabilirea limitelor minime i maxime pentru servicii cadastrale avnd ca finalitate

    nscrierea n cartea funciar a terenurilor agricole i forestiere, prevzut n Legea nr. 217/2007. n acest sens, proiectul de lege, care coninea la momentul transmiterii numai nivelul maxim al

    acestor onorarii, a fost avizat nefavorabil de Consiliul Concurenei n anul 2007. Cu toate acestea,el a fost adoptat ntr-o form care cuprinde i limite minime ale onorariilor, avnd astfel un caracteranticoncurenial mai pronunat dect forma iniial avizat nefavorabil.

    Serviciile de evaluare.Piaa serviciilor de evaluare n Romnia nu este reglementat. Cu toateacestea, putem afirma faptul c asociaia profesional reprezentativ, respectiv ANEVAR, dominaceast pia, apartenena la aceasta nefiind obligatorie, dar constituind un avantaj major pentrudesfurarea activitii de evaluare. Aceast asociaie nu impune tarife sau bariere cantitative laintrarea pe pia. Singurele bariere sunt cele calitative, legate de pregtire i experien profesional,i acestea nu au un caracter disproporionat n raport cu necesitatea asigurrii unui anumit standard

    de calitate.

    Structura pieei de evaluare imobiliar are un caracter concurenial datorat, n special, numruluimare de evaluatori raportat la volumul pieei (concentrare sczut a pieei) i puterii mari denegociere a bncilor care sunt de fapt beneficiarii acestor servicii. Aceste constatri se refer lasituaia actual i nu exclud apariia unor probleme de concuren n viitor, n special datoritcapacitii mari de coordonare prin intermediul asociaiei profesionale. Astfel de practici sunt nsdificil de meninut pe termen lung n absena unor bariere la intrarea pe pia.
