General Provisions

;C%"N @. Title. — %!ese Rules s!all be *no+n as t!e =,,7

<epartment of Agrarian Reform Ad0udication >oard (<ARA>) Rules of 

#rocedure.

;C%"N =. Construction. — %!ese Rules s!all be liberall&

construed to carr& out t!e ob0ecti'es of t!e agrarian reform program and to

 promote 0ust$ e1peditious and ine1pensi'e ad0udication and settlement of 

agrarian cases$ disputes$ or contro'ersies.

All references in t!ese Rules to t!e ?embers of t!e >oard or t!e

Ad0udicators in t!e masculine (!e$ !im$ or !is) s!all be construed to also mean

t!e feminine form (s!e$ !er$ or !ers).

;C%"N 3. Technical Rules Not Applicable. —  %!e >oard and

its Regional and #ro'incial Ad0udication ffices s!all not be bound b& tec!nical

rules of procedure and e'idence as prescribed in t!e Rules of Court$ but s!all

 proceed to !ear and decide all agrarian cases$ disputes or contro'ersies in a most

e1peditious manner$ emplo&ing all reasonable means to ascertain t!e facts of 

e'er& case in accordance +it! 0ustice and euit&. a<A%c

a. "f and +!en a case comes up for ad0udication +!erein

t!ere is no applicable pro'ision under t!ese rules$ t!e

 procedural la+ and 0urisprudence generall& applicable to

agrarian disputes s!all be applied.

 b. %!e Ad0udication >oard (>oard)$ and its Regional

Agrarian Reform Ad0udicators (RARA<s) and #ro'incial

Agrarian Reform Ad0udicators (#ARA<s) !ereinafter referred

to as t!e Ad0udicators$ s!all !a'e t!e aut!orit& to adopt an&

appropriate measure or procedure in an& gi'en situation or

matter not co'ered b& t!ese rules. All suc! special measures

or procedures and t!e situations to +!ic! t!e& !a'e beenapplied must be reported to t!e >oard.

c. %!e pro'isions of t!e Rules of Court s!all not appl&

e'en in suppletor& c!aracter unless adopted !erein or b&

resolution of t!e >oard.

;C%"N 4.  Doubts to Be Resolved in Favor of the

 Beneficiary. — An& reasonable doubt in t!e interpretation of t!ese rules$ as +ell

as in t!e interpretation of contracts and stipulations bet+een t!e contending

 parties$ s!all be resol'ed in fa'or of t!e beneficiar&$ potential beneficiar&$ tenant

farmer$ farm+or*er$ agricultural lessee$ farmers2 cooperati'e$ association or 

organiation.

 No order of t!e Ad0udicators on an& issue$ uestion$ matter$ or incident

raised before t!em s!all be ele'ated to t!e >oard until t!e !earing s!all !a'e

 been terminated and t!e case decided on t!e merits.

;C%"N 3.  Annul$ent of "ud'$ent of Ad#udicators. — 

Annulment of final 0udgment of Ad0udicators s!all be initiated b& filing a

'erified complaint or petition +it! t!e >oard attac!ing t!ereto certified copies

of t!e assailed decision and alleging t!erein +it! particularit& t!e facts and t!e

la+ relied upon for said annulment.

%!e annulment ma& be based onl& on grounds of e1trinsic fraud and

lac* of 0urisdiction. "f based on e1trinsic fraud$ t!e action must be filed +it!in

t!ree (3) &ears from its disco'er& and if based on lac* of 0urisdiction$ before it

is barred b& laches or estoppel.

;C%"N 4.  Referral to ffice of the !ecretary (!%C).  — "n

t!e e'ent t!at a case filed before t!e Ad0udicator s!all necessitate t!e

determination of a pre0udicial issue in'ol'ing an agrarian la+ implementationcase$ t!e Ad0udicator s!all dismiss t!e case +it!out pre0udice to its refiling$

and$ for purposes of e1pedienc&$ refer t!e same to t!e ffice of t!e ;ecretar& or 

!is aut!oried representati'e in t!e localit&.

#re0udicial issue is defined as one t!at arises in a case t!e resolution of 

+!ic! is a logical antecedent of t!e issue in'ol'ed t!erein$ and t!e 0urisdiction

o'er +!ic! pertains to t!e ffice of t!e ;ecretar&.

%!e pre0udicial issue must be determinati'e of t!e case before t!e

>oard or t!e Ad0udicator but t!e 0urisdiction to tr& and resol'e t!e uestion is

lodged +it! t!e ffice of t!e ;ecretar&.

;C%"N .  Role of the RARAD. — %!e RARA< s!all be t!e

1ecuti'e Ad0udicator in !is Region directl& responsible to t!e >oard. As suc!$

and$ in t!e absence of t!e #ARA< concerned$ t!eir personnel$

an important precedent affecting regional interest as

ma& be recommended b& t!e concerned RARA< and

documents and ans+ers to interrogatories$ and to issue subpoena duces

tecu$+ +rits of possession$ +rits of e1ecution$ and ot!er +rits to enforce its

orders and decisions t!roug! t!eir ;!eriffs or dul& deputied officers.
