    INTERNATIONALTELECOMMUNICATION

    REGULATIONS

    PREAMBLE

    1 WhilethesovereignrightofeachStatetoregulateitstelecommunicationsis

    fullyrecognized,theprovisionsofthepresentInternationalTelecommunicationRegulations

    (hereafterreferredtoasRegulations)complementtheConstitutionandtheConventionofthe

    InternationalTelecommunicationUnion,withaviewtoattainingthepurposesoftheInternational

    TelecommunicationUnioninpromotingthedevelopmentoftelecommunicationservicesandtheir

    mostefficientoperationwhileharmonizingthedevelopmentoffacilitiesforworldwide

    telecommunications.

    MemberStatesaffirmtheircommitmenttoimplementtheseRegulationsina

    mannerthatrespectsandupholdstheirhumanrightsobligations.

    TheseRegulationsrecognizetherightofaccessofMemberStatesto

    internationaltelecommunicationservices.

    ARTICLE1

    PurposeandscopeoftheRegulations

    2 1.1 a) TheseRegulationsestablishgeneralprincipleswhichrelatetothe

    provisionandoperationofinternationaltelecommunicationservicesofferedtothepublicaswell

    astotheunderlyinginternationaltelecommunicationtransportmeansusedtoprovidesuchservices.TheseRegulationsdonotaddressthecontent-relatedaspectsoftelecommunications.

    2A abis) TheseRegulationsalsocontainprovisionsapplicabletothoseoperating

    agencies,authorizedorrecognizedbyaMemberState,toestablish,operateandengagein

    internationaltelecommunicationsservicestothepublic,hereinafterreferredas"authorized

    operatingagencies".

    3 b) TheseRegulationsrecognizeinArticle9therightofMemberStatesto

    allowspecialarrangements.

    4 1.2 IntheseRegulations,thepublicisusedinthesenseofthepopulation,

    includinggovernmentalandlegalbodies.

    5 1.3 TheseRegulationsareestablishedwithaviewtofacilitatingglobal

    interconnectionandinteroperabilityoftelecommunicationfacilitiesandtopromotingthe

    harmoniousdevelopmentandefficientoperationoftechnicalfacilities,aswellastheefficiency,

    usefulnessandavailabilitytothepublicofinternationaltelecommunicationservices.

    6 1.4 ReferencestoRecommendationsoftheITUTelecommunication

    StandardizationSector(ITU-T)intheseRegulationsarenottobetakenasgivingtothose

    RecommendationsthesamelegalstatusastheseRegulations.

    7 1.5 WithintheframeworkoftheseRegulations,theprovisionandoperationof

    internationaltelecommunicationservicesineachrelationispursuanttomutualagreementbetweenauthorizedoperatingagencies.

    8 1.6 InimplementingtheprinciplesoftheseRegulations,authorizedoperating

    agenciesshouldcomplywith,tothegreatestextentpracticable,therelevantITU-T

    Recommendations.

    9 1.7 a) TheseRegulationsrecognizetherightofanyMemberState,subjectto

    nationallawandshoulditdecidetodoso,torequirethatauthorizedoperatingagencieswhich

    operateinitsterritoryandprovideaninternationaltelecommunicationservicetothepublicbe

    authorizedbythatMemberState.

    10 b) TheMemberStateconcernedshall,asappropriate,encouragetheapplicationofrelevantITU-TRecommendationsbysuchserviceproviders.

    11 c) TheMemberStates,whereappropriate,shallcooperateinimplementing

    theseRegulations.

    12 1.8 TheseRegulationsshallapply,regardlessofthemeansoftransmissionused,so

    farastheRadioRegulationsdonotprovideotherwise.

    ARTICLE2

    Definitions

    13 ForthepurposeoftheseRegulations,thefollowingdefinitionsshallapply.

    Thesetermsanddefinitionsdonot,however,necessarilyapplyforotherpurposes.

    14 2.1 Telecommunication:Anytransmission,emissionorreceptionofsigns,signals,

    writing,imagesandsoundsorintelligenceofanynaturebywire,radio,opticalorother

    electromagneticsystems.

    15 2.2 Internationaltelecommunicationservice:Theofferingofatelecommunication

    capabilitybetweentelecommunicationofficesorstationsofanynaturethatareinorbelongto

    differentcountries.16 2.3 Governmenttelecommunications:Telecommunicationsoriginatingwithany:

    HeadofState;Headofagovernmentormembersofagovernment;Commanders-in-Chiefof

    militaryforces,land,seaorair;diplomaticorconsularagents;theSecretary-GeneraloftheUnited

    Nations;HeadsoftheprincipalorgansoftheUnitedNations;theInternationalCourtofJustice,or

    repliestogovernmenttelecommunicationsmentionedabove.

    17 2.4 Servicetelecommunication:Atelecommunicationthatrelatestopublic

    internationaltelecommunicationsandthatisexchangedamongthefollowing:

    MemberStates;

    authorizedoperatingagencies;and

    theChairmanoftheCouncil,theSecretary-General,theDeputySecretary-General,theDirectorsoftheBureaux,themembersoftheRadioRegulationsBoard,andother

    representativesorauthorizedofficialsoftheUnion,includingthoseworkingonofficial

    mattersoutsidetheseatoftheUnion.

    SUP 2.5

    21 2.5 Internationalroute:Technicalfacilitiesandinstallationslocatedindifferent

    countriesandusedfortelecommunicationtrafficbetweentwointernationaltelecommunication

    terminalexchangesoroffices.

    22 2.6 Relation:Exchangeoftrafficbetweentwoterminalcountries,alwaysreferring

    toaspecificservice,ifthereisbetweentheirauthorizedoperatingagencies:

    23 a) ameansfortheexchangeoftrafficinthatspecificservice:

    overdirectcircuits(directrelation),or

    viaapointoftransitinathirdcountry(indirectrelation),and

    24 b) normally,thesettlementofaccounts.

    25 2.7 Accountingrate:Therateagreedbetweenauthorizedoperatingagencies,ina

    givenrelationthatisusedfortheestablishmentofinternationalaccounts.

    26 2.8 Collectioncharge:Thechargeestablishedandcollectedbyanauthorized

    operatingagencyfromitscustomersfortheuseofaninternationaltelecommunicationservice.

    SUP 2.10

    ARTICLE3

    Internationalnetwork

    28 3.1 MemberStatesshallendeavourtoensurethatauthorizedoperatingagencies

    cooperateintheestablishment,operationandmaintenanceoftheinternationalnetworkto

    provideasatisfactoryqualityofservice.

    29 3.2 MemberStatesshallendeavourtoensuretheprovisionofsufficient

    telecommunicationfacilitiestomeetthedemandforinternationaltelecommunicationservices.

    30 3.3 Authorizedoperatingagenciesshalldeterminebymutualagreementwhich

    internationalroutesaretobeused.Pendingagreementandprovidedthatthereisnodirectroute

    existingbetweentheterminalauthorizedoperatingagenciesconcerned,theoriginauthorized

    operatingagencyhasthechoicetodeterminetheroutingofitsoutgoingtelecommunication

    traffic,takingintoaccounttheinterestsoftherelevanttransitanddestinationauthorized

    operatingagencies.

    31 3.4 Subjecttonationallaw,anyuser,byhavingaccesstotheinternational

    network,hastherighttosendtraffic.Asatisfactoryqualityofserviceshouldbemaintainedtothe

    greatestextentpracticable,correspondingtotherelevantITU-TRecommendations.

    31A 3.5 MemberStatesshallendeavourtoensurethatinternational

    telecommunicationnumberingresourcesspecifiedinITU-TRecommendationsareusedonlyby

    theassigneesandonlyforthepurposesforwhichtheywereassigned;andthatunassigned

    resourcesarenotused.

    31B 3.6 MemberStatesshallendeavourtoensurethatinternationalcallingline

    identification(CLI)informationisprovidedtakingintoaccounttherelevantITU-T

    Recommendations.

    31E 3.7 MemberStatesshouldcreateanenablingenvironmentfortheimplementation

    ofregionaltelecommunicationtrafficexchangepoints,withaviewtoimprovingquality,increasing

    theconnectivityandresilienceofnetworks,fosteringcompetitionandreducingthecostsof

    internationaltelecommunicationinterconnections.

    ARTICLE4

    Internationaltelecommunicationservices

    32 4.1 MemberStatesshallpromotethedevelopmentofinternational

    telecommunicationservicesandshallfostertheiravailabilitytothepublic.

    33 4.2 MemberStatesshallendeavourtoensurethatauthorizedoperatingagencies

    cooperatewithintheframeworkoftheseRegulationstoprovide,byagreement,awiderangeof

    internationaltelecommunicationserviceswhichshouldconform,tothegreatestextent

    practicable,totherelevantITU-TRecommendations.

    34 4.3 Subjecttonationallaw,MemberStatesshallendeavourtoensurethat

    authorizedoperatingagenciesprovideandmaintain,tothegreatestextentpracticable,asatisfactoryqualityofservicecorrespondingtotherelevantITU-TRecommendationswithrespect

    to:

    35 a) accesstotheinternationalnetworkbyusersusingterminalswhichare

    permittedtobeconnectedtothenetworkandwhichdonotcauseharmto

    technicalfacilitiesandpersonnel;

    36 b) internationaltelecommunicationfacilitiesandservicesavailabletousersfor

    theirdedicateduse;

    37 c) atleastaformoftelecommunicationservicewhichisreasonablyaccessibleto

    thepublic,includingthosewhomaynotbesubscriberstoaspecific

    telecommunicationservice;and

    38 d) acapabilityforinterworkingbetweendifferentservices,asappropriate,to

    facilitateinternationaltelecommunicationservices.

    38A 4.4 MemberStatesshallfostermeasurestoensurethatauthorizedoperating

    agenciesprovidefree-of-charge,transparent,up-to-dateandaccurateinformationtoenduserson

    internationaltelecommunicationservices,includinginternationalroamingpricesandthe

    associatedrelevantconditions,inatimelymanner.

    38B 4.5 MemberStatesshallfostermeasurestoensurethattelecommunication

    servicesininternationalroamingofsatisfactoryqualityareprovidedtovisitingusers.

    38C 4.6 MemberStatesshouldfostercooperationamongauthorizedoperating

    agenciesinordertoavoidandmitigateinadvertentroamingchargesinborderzones.

    38E 4.7 MemberStatesshallendeavourtopromotecompetitionintheprovisionofinternationalroamingservicesandareencouragedtodeveloppoliciesthatfostercompetitive

    roamingpricesforthebenefitofendusers.

    ARTICLE5

    Safetyoflifeandpriorityoftelecommunications

    39 5.1 Safety-of-lifetelecommunications,suchasdistresstelecommunications,shall

    beentitledtotransmissionasofrightand,wheretechnicallypracticable,haveabsolutepriority

    overallothertelecommunications,inaccordancewiththerelevantarticlesoftheConstitutionand

    theConventionandtakingdueaccountoftherelevantITU-TRecommendations.

    40 5.2 Governmenttelecommunications,includingtelecommunicationsrelativetothe

    applicationofcertainprovisionsoftheUnitedNationsCharter,shall,wheretechnically

    practicable,enjoypriorityovertelecommunicationsotherthanthosereferredtoinNo.39(5.1)

    above,inaccordancewiththerelevantprovisionsoftheConstitutionandtheConventionand

    takingdueaccountoftherelevantITU-TRecommendations.

    41 5.3 Theprovisionsgoverningthepriorityenjoyedbyanyothertelecommunication

    servicesarecontainedintherelevantITU-TRecommendations.

    41A 5.4 MemberStatesshouldencourageauthorizedoperatingagenciestoinformall

    users,includingroamingusers,ingoodtimeandfreeofcharge,ofthenumbertobeusedforcalls

    totheemergencyservices.

    ARTICLE5A

    Securityandrobustnessofnetworks

    41B MemberStatesshallindividuallyandcollectivelyendeavourtoensurethesecurityand

    robustnessofinternationaltelecommunicationnetworksinordertoachieveeffectiveusethereof

    andavoidanceoftechnicalharmthereto,aswellastheharmoniousdevelopmentofinternational

    telecommunicationservicesofferedtothepublic.

    ARTICLE5B

    Unsolicitedbulkelectroniccommunications

    41C MemberStatesshouldendeavourtotakenecessarymeasurestopreventthe

    propagationofunsolicitedbulkelectroniccommunicationsandminimizeitsimpacton

    internationaltelecommunicationservices.

    MemberStatesareencouragedtocooperateinthatsense.

    ARTICLE6

    Chargingandaccounting

    42A Internationaltelecommunicationarrangements

    42B 6.1 Subjecttoapplicablenationallaw,thetermsandconditionsforinternational

    telecommunicationservicearrangementsmaybeestablishedthroughcommercialagreementsor

    throughaccounting-rateprinciplesestablishedpursuanttonationalregulation.

    42C 6.1.1 MemberStatesshallendeavourtoencourageinvestmentsininternational

    telecommunicationnetworksandpromotecompetitivewholesalepricingfortrafficcarriedon

    suchtelecommunicationnetworks.

    42D Accounting-rateprinciples

    42DA Termsandconditions

    42E 6.2 Thefollowingprovisionsmayapplywherethetermsandconditionsof

    internationaltelecommunicationservicearrangementsareestablishedthroughaccounting-rateprinciples,establishedpursuanttonationalregulation.Theseprovisionsdonotapplyto

    arrangementsestablishedthroughcommercialagreements.

    42F 6.2.1 Foreachapplicableserviceinagivenrelation,authorizedoperatingagencies

    shall,bymutualagreement,establishandreviseaccountingratestobeappliedbetweenthem,in

    accordancewiththeprovisionsofAppendix1andtakingintoaccounttherelevantITU-T

    Recommendations.

    42G 6.2.2 Unlessotherwiseagreed,partiesengagedintheprovisionofinternational

    telecommunicationservicesshallfollowtherelevantprovisionsassetoutinAppendices1and2.

    42H 6.2.3 Intheabsenceofspecialarrangementsconcludedbetweenauthorized

    operatingagencies,themonetaryunittobeusedinthecompositionofaccountingratesfor

    internationaltelecommunicationservicesandintheestablishmentofinternationalaccountsshallbe:

    eitherthemonetaryunitoftheInternationalMonetaryFund(IMF),currentlythe

    SpecialDrawingRight(SDR),asdefinedbythatorganization;

    orfreelyconvertiblecurrenciesorothermonetaryunitagreedbetweentheauthorized

    operatingagencies.

    42HA Collectioncharges

    42I 6.2.4 Thechargesleviedoncustomersforaparticularcommunicationshouldin

    principlebethesameinagivenrelation,regardlessoftheinternationalrouteusedforthat

    communication.Inestablishingthesecharges,MemberStatesshouldtrytoavoiddissymmetrybetweenthechargesapplicableineachdirectionofthesamerelation.

    42J Taxation

    42K 6.3 Where,inaccordancewiththenationallawofacountry,afiscaltaxisleviedon

    collectionchargesforinternationaltelecommunicationservices,thistaxshallnormallybe

    collectedonlyinrespectofinternationalservicesbilledtocustomersinthatcountry,unlessother

    arrangementsaremadetomeetspecialcircumstances.

    42KA 6.4 Servicetelecommunications

    42KB 6.4.1 Authorizedoperatingagenciesmayinprincipleforgotheinclusionofservicetelecommunicationsininternationalaccounting,undertherelevantprovisionsoftheConstitution

    andtheConventionandtheseRegulations,havingdueregardfortheneedforreciprocal

    arrangements.Authorizedoperatingagenciesmayprovideservicetelecommunicationsfreeof

    charge.

    42KC 6.4.2 Thegeneraloperational,chargingandaccountingprinciplesapplicableto

    servicetelecommunicationsshouldtakeaccountoftherelevantITU-TRecommendations.

    ARTICLE7

    Suspensionofservices

    55 7.1 IfaMemberStateexercisesitsrightinaccordancewiththeConstitutionand

    theConventiontosuspendinternationaltelecommunicationservicespartiallyortotally,that

    MemberStateshallimmediatelynotifytheSecretary-Generalofthesuspensionandofthe

    subsequentreturntonormalconditionsbythemostappropriatemeansofcommunication.

    56 7.2 TheSecretary-Generalshallimmediatelybringsuchinformationtothe

    attentionofallotherMemberStates,usingthemostappropriatemeansofcommunication.

    ARTICLE8

    Disseminationofinformation

    57 8.1 Usingthemostsuitableandeconomicalmeans,theSecretary-Generalshall

    disseminateinformationprovided,ofanadministrative,operational,orstatisticalnature,

    concerninginternationaltelecommunicationservices.Suchinformationshallbedisseminatedin

    accordancewiththerelevantprovisionsoftheConstitutionandtheConventionandofthisArticle,

    onthebasisofdecisionstakenbytheCouncilorbycompetentITUconferences,andtaking

    accountofconclusionsordecisionsofITUassemblies.IfsoauthorizedbytheMemberState

    concerned,theinformationmaybetransmittedtotheSecretary-Generaldirectlybyanauthorized

    operatingagency,andshallthenbedisseminatedbytheSecretary-General.MemberStatesshouldtransmitsuchinformationtotheSecretary-Generalinatimelymanner,takingintoaccountthe

    relevantITU-TRecommendations.

    ARTICLE8A

    Energyefficiency/e-waste

    57B 8.2 MemberStatesareencouragedtoadoptenergy-efficiencyande-wastebest

    practices,takingintoaccounttherelevantITU-TRecommendations.

    ARTICLE8B

    Accessibility

    57D 8.3 MemberStatesshouldpromoteaccessforpersonswithdisabilitiesto

    internationaltelecommunicationservices,takingintoaccounttherelevantITU-T

    Recommendations.

    Specialarrangements

    58 9.1 a) PursuanttoArticle42oftheConstitution,specialarrangementsmaybe

    enteredintoontelecommunicationmatterswhichdonotconcernMemberStatesingeneral.

    Subjecttonationallaws,MemberStatesmayallowauthorizedoperatingagenciesorother

    organizationsorpersonstoenterintosuchspecialmutualarrangementswithMemberStatesand

    authorizedoperatingagencies,orotherorganizationsorpersonsthataresoallowedinanother

    countryfortheestablishment,operationanduseofspecialinternationaltelecommunication

    networks,systemsandservices,inordertomeetspecializedinternationaltelecommunication

    needswithinand/orbetweentheterritoriesoftheMemberStatesconcerned,andincluding,as

    necessary,thefinancial,technicaloroperatingconditionstobeobserved.

    59 b) Anysuchspecialarrangementsshallendeavourtoavoidtechnicalharmto

    theoperationofthetelecommunicationfacilitiesofthirdcountries.60 9.2 MemberStatesshould,whereappropriate,encouragethepartiestoany

    specialarrangementsthataremadepursuanttoNo.58(9.1)abovetotakeintoaccountrelevant

    provisionsofITU-TRecommendations.

    ARTICLE10

    Finalprovisions

    61 10.1 TheseRegulations,ofwhichAppendices1and2formintegralparts,shallenterintoforceon1January2015,andshallbeappliedasofthatdate,consistentwithalltheprovisions

    ofArticle54oftheConstitution.

    62 10.2 IfaMemberStatemakesreservationswithregardtotheapplicationofoneor

    moreoftheprovisionsoftheseRegulations,otherMemberStatesshallbefreetodisregardthe

    saidprovisionorprovisionsintheirrelationswiththeMemberStatewhichhasmadesuch

    reservations.

    INWITNESSWHEREOF,thedelegatesoftheMemberStatesoftheInternational

    TelecommunicationUnionnamedbelowhave,onbehalfoftheirrespectivecompetent

    authorities,signedonecopyofthepresentFinalActsintheArabic,Chinese,English,French,

    RussianandSpanishlanguages.Incaseofdiscrepanciesordispute,theFrenchtextshallprevail.

    ThiscopyshallbedepositedinthearchivesoftheUnion.TheSecretary-Generalshallforwardone

    certifiedcopytoeachMemberStateoftheInternationalTelecommunicationUnion.

    Generalprovisionsconcerningaccounting

    1/1 1 Accountingrates

    1/2 1.1 Foreachapplicableserviceinagivenrelation,MemberStatesshallendeavour

    toensurethatauthorizedoperatingagencies,bymutualagreement,establishandrevise

    accountingratestobeappliedbetweenthem,takingintoaccountITU-TRecommendationsand

    trendsinthecostofprovidingthespecifictelecommunicationservice,anddividesuchratesinto

    terminalsharespayabletotheauthorizedoperatingagenciesofterminalcountriesand,where

    appropriate,intotransitsharespayabletotheauthorizedoperatingagenciesoftransitcountries.

    1/3 1.2 Alternatively,intrafficrelationswhereITU-Tcoststudiescanbeusedasa

    basis,theaccountingratemaybedeterminedinaccordancewiththefollowingmethod:

    1/4 a) authorizedoperatingagenciesshallestablishandrevisetheirterminaland

    transitsharestakingintoaccountITU-TRecommendations;

    1/5 b) theaccountingrateshallbethesumoftheterminalsharesandanytransit

    shares.

    1/6 1.3 Whenoneormoreauthorizedoperatingagenciesacquire,eitherbyflat-rate

    remunerationorotherarrangements,therighttoutilizeapartofthecircuitand/orinstallationsof

    anotherauthorizedoperatingagency,theformerhavetherighttoestablishtheirshareas

    mentionedin1.1and1.2above,forthispartoftherelation.

    1/7 1.4 Incaseswhereoneormoreinternationalrouteshavebeenestablishedby

    agreementbetweenauthorizedoperatingagenciesandwheretrafficisdivertedunilaterallybythe

    authorizedoperatingagencyoforigintoaninternationalroutewhichhasnotbeenagreedwith

    toinvitethe2014plenipotentiaryconferencetoconsiderthisresolutionanddecidetotakethe

    necessaryactionstoconveneperiodically(forexampleeveryeightyears)aworldconferenceon

    internationaltelecommunicationstorevisetheITRs,takingintoaccountthefinancialimplications

    fortheUnion,

    instructstheSecretary-General

    1 tobringthisresolutiontotheattentionofthePlenipotentiaryConference;

    2 toprovideinformationtoenablethePlenipotentiaryConferencetoconsiderthecost

    implicationsofconveningWCIT,

    invitesMemberStates

    tocontributetotheworkoutlinedinthisresolution.

    Internationaltelecommunicationservicetrafficterminationandexchange

    TheWorldConferenceonInternationalTelecommunications(Dubai,2012),

    considering

    a) thatthetransitionfromdedicatedphoneanddatanetworkstoconvergedIP-based

    networksraisesregulatory,technicalandeconomicissueswhichneedtobetakeninto

    consideration;

    b) thatmanyMemberStateshaveexpressedaneedfortheinitiationand

    implementationofcommercialagreementsbetweenauthorizedoperatingagenciesandservice

    providersofinternationalservices,withtheobjectiveofempoweringalltheparticipantsinthe

    newvaluechain,

    noting

    a) thatsomeMemberStatesareobservingadeteriorationinthequalityofinternational

    servicesandvoicetraffic;

    b) thatStudyGroup3oftheITUTelecommunicationStandardizationSector(ITU-T)is

    mandatedtostudythedevelopmentofRecommendations,resolutionsandguidelinesrelatedto

    theseissues;

    c) thatthereisaneedforbroaderunderstandingofalternativedisputeresolution

    mechanismsarisingoutofcommercialarrangements;

    d) thatsomeMemberStateshaveconcernsforthepreventionandmitigationoffraudin

    internationaltelecommunications,

    resolvestoinviteconcernedMembersStates

    tocollaboratesothat:

    i) eachpartyinanegotiationoragreementrelatedtoorarisingoutofinternational

    connectivitymatterscanseekthesupportofrelevantauthoritiesoftheotherpartys

    Stateinalternativedisputeresolution;

    ii) theirregulatoryframeworkspromotetheestablishmentofcommercialagreements

    betweenauthorizedoperatingagenciesandtheprovidersofinternationalservicesin

    alignmentwithprinciplesoffaircompetitionandinnovation,

    instructstheDirectoroftheTelecommunicationStandardizationBureau

    totakenecessaryactioninorderthatITU-TStudyGroup3studyrecentdevelopmentsand

    practiceswithregardtotheterminationandexchangeofinternationaltelecommunicationtraffic

    undercommercialagreements,soastodevelopaRecommendation,ifappropriate,andguidelines

    forconcernedMemberStates,fortheuseofprovidersofinternationaltelecommunication

    servicesinregardtoissuestheyconsiderrelevant,suchas:

    telecommunicationservicestrafficterminationandexchange,includinginparticular,invoicing.
