    Mr Braulio Gonzales was employed by Gurus Nepal Restaurant from 2009

    to 2009. He worked from 9:30/10:00 am to 2:30pm and from 5:00 pm

    to 9:00/9:30 pm, sometimes leaving early when there were no late

    customers. He had at least 30 minutes for each of his meals, with lunch and

    dinner provided by Gurus Restaurant. Braulio worked six days a week with

    the inclusion of 2 Sundays, for a total of 24 days.

    Braulios duties were to vacuum the carpeted area of the dining room and

    mop the tiled area each morning. During lunch and dinner hours he washeddishes but as winter business has been quite slow he also assisted with

    cleaning the kitchen area when there was nothing to do.

    Braulio said his son was getting married and he needed to send money and

    requested his pay in advance. I agreed and gave him a paycheck # for

    $600.00 and $500.00 in cash with the agreement that at the end of the work

    period I would issue him a paycheck of $500.00 for my records and he would

    cash it and return the $500 cash to me. He came to my apartment some

    time later and asked for more money saying he would leave his guitar. I told

    him I could not give him money at the time and that the guitar was of no useto me, but the weather was bad so he decided to leave the guitar so that it

    wouldnt get wet and collect it later. However within a couple of days he was

    no longer working. I had been warning him several times about his attitude

    as he would throw dishes down and break them and shout at other

    employees who were not doing anything to cause this behavior. So finally I

    told him that I would have to let him go. He complained to others that I had

    his guitar but he did not in fact return to the restaurant to collect it himself. I

    returned it to him via a third party when asked. We never met again to

    discuss the $500 cash or any settling of his wages.

    Braulio was paid a total of $2391.82 net plus the $500.00 cash. I issued pay

    checks for the gross amounts and deducted taxes. {Braulio also worked for

    the restaurant the first part of this year. At that time he was issued checks

    #1089 on Jan 21 for and #1086 on Feb 29 for $1015, from which I also paid

    the taxes and I have the copies of the cancelled checks. He quit his job

    because he said he didnt want to do the work any longer so I said that was

    okay as I had made it clear from the start that he was free to go any time as

    long as he let me know and I would pay him the amount agreed upon.} He

    initially came to my restaurant seeking work and I said I had the kitchen job

    but as business was slow I could only afford to pay $1,100.00 net and

    Braulio said that was good for him and that he wanted the job. I provide good

    friendly working conditions without any pressure and although we are of

    different nationalities we seemed to be able to communicate satisfactorily.

    {He returned a few weeks later and asked for work again and I again hired

    him as he was familiar with the day-to-day operations.}

    However, I have learned some things from this episode and am keeping

    more strict records to verify that I am in compliance. Currently I am paying a

    straight $7.50 per hour, with 2 meals furnished. The employees are provided

    with a work description. They are keeping a time card signed by them and

    me each week, and also providing proof of identity and legality, and filling

    out the I-9 form.
