¶2. (C) For the past three years, theCroatian State Prosecutor’s Office forthe Suppression of Organized Crimeand Corruption (USKOK) has beenratchetingupitsactivityincorruptioncases.Untilthisyear,however,itscaseshad involvedmid-level bureaucrats inservices such as the land registry, orhealth and education systems. Fewindictees could be described as being

politically-well connected. Since thissummer, however, a series of caseshave been playing out in both themediaandthe policeandprosecutors’offices. These cases have begun toreachpolitically-connectedindividuals.Casesunderinvestigationhavealreadyled to significant changes inmanagement, and detention of somekeyplayers,atthestate-ownedelectric

company HEP, and the 25-percentstate-owned food producer Podravka.In another case, a long-awaitedinvestigationofamilitaryprocurementfrom2004ininvolvingformerDefense(and later Interior) Minister BerislavRoncevic was launched followingSanader’s July resignation, withindictments issued against RoncevicandacloseaideonOctober28(reftel).

(C) All of these cases havereportedly created strains within theruling HDZ party, with senior partymembersarguingthatthegovernmentshouldnot rush to judgment, and thatKosor was being too quick to seekdismissal of those tainted by variousallegations. The Prodravka casepresents the latest challenge in this

regard. Minister of Economy (andDeputyPrimeMinister)DamirPolancecis a former Podravka executive and issuspected of participation in thealleged scheme by which themanagement board was usingembezzled funds to buy a controllinginterestinthecompany.Sixmanagerswerearrestedlastweekfor theirrolesin the scheme,but Polancec has not

been publicly named by investigatorsasasuspect.OppositionpartiesandthemediacalledvociferouslyforPolancec’sresignation, and the leader of a juniorpartnerintherulingcoalitionpubliclystated that his party, the IndependentSerb Democratic Party (SDSS), wouldnot support Polancec if parliamentvoted on a motion for his dismissal.Polancec suddenly resigned his

positiontoday(October30).¶4. (C) Many well-informed sourceshave commented in particular on theshift in attitudes toward corruptionbetween Kosor and her predecessor,IvoSanader.MFAStateSecretaryDavorBozinovic told the Ambassador onOctober 26 that Kosor potentially iscommencing an historic shift in

governance in Croatia. He and othershave noted that President Mesic is

quietlysupportingKosor,hiserstwhilepresidentialopponent,againsttheHDZoldguard.Bozinovicregrettedthattheopposition is not supporting her anti-corruption efforts, which could sparethemadifficulttaskwhentheyreturntopower.¶5. (C) Chamber of CommercePresidentNadanVidosevic,along-timeHDZ member and now independentcandidateforpresidentofCroatia,toldtheAmbassadoronOctober27thathealso saw a change in approach. He

claimed Sanader and Kosor hadrecentlyarguedoverKosor’sapproachtothecorruptioninvestigations.Kosorinsisted that Chief State ProsecutorBajic be allowed to pursue all leads,while Sanader saw this as a threat tohimandotherpartycronies.ZAGREB00000644002OF002(NOTE: Bajic himself has toldtheAmbassador that he has the

authority to investigate anybody asevidence dictates, and that he wouldpursue an investigation againstPolancec in the Podravka case. ¶6. (C) Luka Madjeric, Head of theGovernment’s Office for HumanRightsand a former assistant to Kosor, toldPoloff that Kosor rose quietly throughthe ranks of the HDZ. Therefore, hesaid, she does not have as manypolitical IOUs, nor is she complicit inthescandalsnowplaguingotherpartymembers. This allows her to address

corruption issues in a morestraightforward manner than her

proceduramazaistraguikrivično

predecessor.Sinceshedoesnothavetoworry about being personallyimplicated inthescandals,sheismorewilling than Sanader was to allowprosecutorsandpolicetopursueleadsthatmayimplicatetoppartyofficials.¶7. (SBU) The new political will totarget corruption coincides withimproved procedures for investigatingandprosecuting cases, many ofwhichhavebeendesignedandadvocatedforunderUSandotherdonors’assistanceprograms. In September, the national

policeofficiallyopenedtheirownOfficefor theSuppression ofCorruption andOrganized Crime (PN-USKOK), whichservesasapartnertotheprosecutor’sUSKOK division. Both the police andprosecutorUSKOKshaveofficesinthefourlargestcities,Zagreb,Split,Rijeka,and Osijek, and jurisdiction forinvestigating organized crime andcorruption cases. Courts in these

fourcitiesalsohavespecializedUSKOKcourts, created in early 2009, withcleared panels of experienced judgesspeciallytrainedtohearthesecomplexcriminal cases. And, as of July 1,Croatia’s new Law on CriminalProceduregrantedUSKOKprosecutorsmany of the functions previously heldbyinvestigativejudges.Prosecutorscannow question suspects and witnesses

without going through lengthyproceduresinthecourts.Bajichastoldus that these changes have greatlyincreasedthepaceofinvestigationsandhelped minimize leaks and thepotentialforwitnesstampering.¶8.(C)COMMENT:Kosor’swillingnesstoconfrontcorruptionappearsgenuine.Butitalmostcertainly

includessomeelementsofpoliticalcalculation.First,thestrategyofsimply

¶8.(C)Komentar:KosorspremnostdasesuprotstavikorupciJiizgledaoriginalan.AliJeskorosigurnoobuhvatanekeelementepolitičkogobračuna.Prvo,strategiJaJednostavnonegira,ignorišeilikrute-naoružavaistragamakorupciJeraslaJesvetežedaseodrži,posebnoimaJućiuviduUSKOKJepovećanjeefikasnosti.PokušavaJući

dasede-FangUSKOK,kaoštosunekeHDZ-atvrdoliniJašimanavodnoJe

denying,ignoringorstiff-armingcorruptioninvestigationswasgrowingincreasinglyhardtosustain,especiallygivenUSKOK’sincreasingeffectiveness.Tryingtode-fangUSKOK,assomeHDZ

hard-linershavereportedlysuggested,wouldhavemetwithstronginternationalcondemnationanddamagedCroatia’sEUaspirations.Second,Kosor,whorosetothetopofthepartywithoutamandatefromthevotersandwithlesslong-standingtiesthanmanyoftheparty’sbarons,maywellbequitehappytoseeintra-partyrivalsweakenedbymoreaggressive

andfree-ranginginvestigationsintocorruption.Finally,giventheHDZ’scurrentunpopularity,Kosormaysimplyhavecalculatedthatshehadlittletolose,andthatitwasbesttostartrightawayinhopesofchangingtheHDZ’spublicimagebeforethenextelections,whichmustbeheldbyfall2011butcouldcomeasearlyasspring2010ifthegoverningcoalitionfractured.So,whilethedevelopmentsof

thepastfewmonthssignalprogress,itisprematuretodeclarevictoryinthefightagainstcorruptioninCroatia.No“bigfish”convictionshaveyetbeensecured.AndKosormayyetfindthatthestrainscreatedbyanti-corruptioncasesmaycomplicatedealingwithchallengessuchastheeconomiccrisisandcompletingtherequirementsforEUaccession.Nonetheless,thisispotentiallythebeginningofawatershedmomentinCroatia,madepossiblebyanunexpectedleaderwhosepartycannotatthemomentaffordtodispersewithher.ENDCOMMENT.FOLEY
