INITIAL INFORMATION:
On Wednesday, March 06, 2013 about 2220 hours, I, Ofc. Cairns heard Ofc. Herrera attempt to make a traffic stop on a
vehicle in the area of 10th Ave. and Collyer St. The vehicle was failing to yield.
INVESTIGATION:
I was near 17th Ave. and Pace St. when Ofc. Herrera aired the vehicle was not stopping. He was in the area of 17th and
Collyer St. going northbound. I then heard the vehicle was eastbound on 19th Ave. at Atwood St. Ofc. Herrera had
stopped trying to conduct the traffic stop. Ofc. Herrera then aired the vehicle must have doubled back and was now
eastbound on 17th Ave. in the wrong lanes of travel approaching Main St. Ofc. Deal corrected Ofc. Herrera stating
westbound, and Ofc. Herrera confirmed westbound. A moment later Ofc. Herrera stated the vehicle had collided with
another vehicle in the intersection.
At this time, I was westbound 17th Ave. near Meadow St. and could see flashing Police vehicle lights ahead of me. Icontinued to the intersection of 17th Ave. and Main St. I parked my marked patrol vehicle on the east side of Main St.
blocking westbound traffic. I noticed one vehicle on the northwest corner of the intersection and one on the west side of
the intersection near the center of 17th Ave.
I immediately went to the vehicle located at the northwest corner. Ofc. Deal and Ofc. Johnston were attempting to get the
driver out of the vehicle. The driver appeard to be partially in the back seat. Ofc. Deal was at the back door and Ofc.
Johnston was at the front door. Ofc. Deal was lifting up the driver's head and Ofc. Johnston and I pulled the driver out
onto the ground. Ofc. Johnston began CPR.
I then went to the other vehicle, and heard Ofc. Hererra instructing the driver, later identified as ARR-Pablo Bustillos
(Bustillos), to exit the vehicle. Bustillos unbuckled his seatbelt, exited the vehicle and layed flat, facedown on the ground.
Bustillos was handcuffed utilizing two pair of handcuffs.
I noticed a female in the front seat on the passenger side, who appeared to be stuck as she was partially under the
dashboard and most of the way off the seat. I walked around to the passenger side of the vehicle to talk to her. She
kept asking for help, and asked that I move the seat back. I informed her the fire department was on their way and would
help her.
I noticed a female in the back seat, sitting in the middle. I could see blood on her face, and she appeared to be
unconscious. I shook her, touching her right shoulder. She opened her eyes, and looked at me with a blank stare.
Medical arrived and began to look at the two female passengers.
I walked back around to the driver's side. Sgt. Buchholtz informed me I needed to stay with Bustillos, and go to Longmont
United Hospital (LUH)when he is transported. Medical Personnel advised I needed to keep Bustillos talking. I told
Bustillos this and stated he should just keep talking about anything. Bustillos told me the following. He was not working.
He did not stop for the officer because he had a warrant for parole violation. He had gone to prision for selling drugs
here in Longmont. I asked if he was selling drugs now. Bustillos stated he was not selling, only using.
Medical personnel then came over to Bustillos, placed him on a backboard, then on the gurney, and took him to the
ambulance. I then followed the ambulance to LUH. While I was walking into the Hospital, Ofc. Deal was walking out and
showed me a small vile with what was presumed Methamphetamine. Ofc. Deal stated the vile was found in the female
that was already transported to LUH. Bustillos was then put in a room in the Emergency Department and was being
treated by Hospital.
I was informed we needed to get a felony blood draw. The Lab Assistant OTH-Amanda Lamb (Amanda) completed the
blood draw at 2307 hours, and I took custody of the kit at 2312 hours. I placed the two blood viles which were sealed and
placed in the plastic container and sealed, into the box and sealed the box. I kept custody of the blood draw box until I
gave it to Ofc. Ford around 0030 hours on March 07, 2013.
I later logged Bustillos clothes, which were cut off by LUH Personnel, into Longmont Property and Evidence.
