Announcement of the Official Information Commission specifying that information on the environment and health are information that must be available for the people to monitor, as 

stipulated in Section 9 (8) of the Official Information Act B.E. 2540 (1997) 

                                 ‐‐‐‐‐‐‐‐‐‐‐‐‐‐‐‐‐‐‐‐‐‐‐‐‐‐‐‐‐‐‐‐‐‐‐‐‐‐‐‐‐‐‐‐‐‐‐‐‐‐‐‐‐‐‐‐‐‐‐‐‐‐‐‐‐‐‐‐‐‐‐‐‐‐‐‐‐‐‐ 

 The Thai Environmental Institute and its allied organizations have requested the Official Information Commission to use its powers derived from Section 9(8) of the Official Information Act B.E. 2540 (1997) to issue an announcement specifying that information on environment and health are information that state agencies have to make available to the people so they can look into and monitor, as stipulated in Section 9 (8). The request was contained in a letter to the Official Information Commission dated 18 September 2009 and in a document containing proposals and information on the environment and health. 

The Official Information Commission has considered this request and the opinions of related state agencies and has agreed to specify the types of environmental and health information that the state has to prepare, or has to arrange to be made available to the public, or to be in its possession, in accordance with its legal obligation as a state agency and in accordance with its obligation under international conventions and agreements signed. Such information to be made available is by authority of Section 9(8) of the Official Information Act B.E. 2540 (1997). The information to be made available are of the following categories: 

1. Reports, data, and information concerning analyses of the impact of activities and implementation performed at every level by entities, on the environment, health, and society.  This is to include also reports on the opinions of people connected with such activities and implementation, as well as data and information involved in the preparation of such reports. 

2. Reports on measures to prevent and solve environmental, health, and social problems, including reports related to measures to monitor and check on the quality of the environment, as well as related information and news. 

3. Reports related to data and information on the amount of pollutants released into the environment, and reports on the impact that has occurred or might occur from it on the environment and health. Such reports to be made available are also to include data and information in connection with the preparation of the reports as well, depending on the circumstances. 

4. Situation reports and or data related to the measurement and monitoring of pollutants toxic substances, dangerous objects, and or the quality of the environment, including data or reports on health conditions, or to factors impacting on health conditions, that arises from pollutants, dangerous objects, and or those relating to the quality of the environment. 

5. Study or research or analytical reports on the degree of contamination by poisonous substances in plants or food produced from plants, and effects of such contamination. This is to include monitoring reports or reports on the impact of the use of chemicals in agriculture that affect the environment and health. 

6. Study or research reports on the level of contaminants in various environmental settings, especially those that have an impact on the environment and health, this to include other relevant data and information as well. 

7. Impact reports and or studies and research done in connection with surveillance data and other forms of information, especially those relating to health, occupational health, and environmental health conditions. 

8. Study reports or analyses of dangerous risks that occur or might occur from industrial processes, especially those that relate to environment and health, including studies on results of industrial activities that impacts on standards of protection for safety in industrial operations. 

9. Monitoring reports on the effects of operations that have or might have an impact on the environment and health, including studies of activities to ensure safety standards that have to be done on a continuing basis, as deemed by the law or which are conditions for issuance of permission or approval. Examples of these are reports monitoring the treatment of wastewater flowing out from industrial plants or other monitoring reports that cover similar topics. 

10. Reports that are related to the preparation and implementation of general urban plans and specific urban plans that cover every level, including data and information involved in such preparation, especially relating to environmental, health, and or social impacts. 

11. Contracts, concessions, and permits connected with enterprises and bodies and that related to operations that have or might have an impact on the environment, health, or society. This would include contracts, concessions, and permits related to the use of and the seeking of benefit from natural resources. 

12. Negotiating frameworks, drafts of agreements, and or international agreements that are associated with the environment and health, and this is to include negotiating frameworks, drafts of agreements, and or international agreements that are associated with the use of and the seeking of benefit from natural resources, and also to include the result of activities that were performed as part of a relevant commitment made.  

13. Policies, work plans, projects, and budgets associated with implementation activities affecting environment and health. 

14. Reports of meetings and resolutions related to the environment and health including those that have a societal impact, that emanate from committees appointed or set up legally, or by resolution of the cabinet. 

15. Data and information and or reports connected with changes in environment conditions that have an impact on the environmental and health situation. 

16. Other data and information that are relevant, including statistical data, maps, and others. 

In the process of arranging for information to be available, the state agencies are to organize such data and information, and indices to facilitate searches, both in the form of books, documents, and electronic form, such that the people can access them at a place which is to be determined by the state, in accordance with Section 9 of the Official Information Act B.E. 2540. And or it could be made accessible in electronic form from the normal channels of distribution of each state agency as deemed appropriate.   These measures are to be completed within 90 days after the date of this announcement.
