The question of illegal proving means: and the use of these in front of the

courts, penal and civil, is multidimensional. In the frames of this project it will

be attempted to analyze the theory, legislation and jurisprudence regarding

the use of illegal proving means in the civil law suit. So much before the

reform of the constitution of 2001 and the addition of paragraph 3 in the article

19 of the constitution as after this and the ostensibly as far as the letter of

article 19 paragraph 3 is concerned absolute prohibition of use of illegal

proving means a bending of this absolute prohibition can be identified. In the

frames of civil law suit the judge is able based on article 2 paragraph 1 of

the constitution to make acceptable illegal proving means by proceeding in

evaluation of legal goods and by applying the principle of proportionality.
