Why has it taken so long

• Some countries initially were worried it would change the balance between employers and employees for OH&S matters

• Others have working practices that could involve significant costs if universal OHS& practices are adopted

• Some international bodies consider that standards bodies are not competent to develop OH&S documents

Background

• According to the ILO*, 2.3 million people worldwide die annually as a result of occupational illnesses and accidents at work.

• In addition, there are 860,000 occupational accidents every day, with consequences in terms of injuries. The direct or indirect cost of occupational illness and accidents at work is estimated at US$2.8 trillion worldwide.**

ISO 45001 objective

• The purpose of an OH&S management system is to provide a framework for managing the prevention of injury and ill-health.

• An organization’s activities can pose a risk of injury or ill-health, consequently it is critically important for the organization to eliminate or minimize OH&S risks by taking appropriate preventive measures.

• OH&S マネジメントシステムの目的は、疾病や障害の防止を管理するためのフレームワークを提供することである。

The first safety legislation

This is an example of what is now thought of as good ‘contemporary’ legislation, as it incorporates the notion of ‘goal driven’ action.

Hamorabi doesn’t specify a standard for safe house construction, rather he places a duty on builders to “get it right”.

When accidents happen

• There is often a mistaken belief by senior managers that they are working in safe organisations.

• Managers did not know how to seek out/recognise symptoms of unsafe organisations

• Managers look for “who to blame” and not root cause

In reality :

• human factors are critical:

• There are often underlying causes (latent as well as active failures)

• Complacency because of a low perceptions of risk

• Poor safety culture

There is often a tendency to find someone to blame rather that understand the root causes. A simplistic approach may well not lead to a long term solution

Example

When a plane crashes, what is the cause - pilot error?, engine failure?

The air traffic controller is still alive and he can make sure he avoids blame.

In reality was the pilot competent; was he trained. Why did the engine fail etc.?

80% of accidents are a result of management failure.

The concept of a single primary accident cause is usually a simplification of a complex multi-causal process. Moreover the term unsafe act embraces a wide range of human errors, including both unintentional errors and intentionally risky behaviour (violations).

The distinction between the contribution of unsafe conditions and unsafe acts sometimes hides the more important distinction between the relative contribution of conditions and behaviour in prevention.

Accident investigations have traditionally focused almost exclusively on the errors made by the people who have had the accidents, not the managers whose errors may have created a climate and a physical environment where errors by people at risk are made more likely or more serious.

Unsafe acts create conditions where further unsafe acts may lead to accidents.

The remote errors by managers are called latent or decision failures, and the errors by people directly at risk are called active failures.



事故の調査を行うと、ほぼ事故を起こしてしまった人が犯した間違いに焦点をあてがちであるが、事故を起こした風土や物理的環境を作ってしまったマネージャーに焦点をあてないことがより深刻である。

Rules and safeguards devised after accidents are sometimes not well considered. Moreover the measures taken to prevent one specific accident may conflict with the measures adopted to prevent a different accident, and with production-oriented rules.

Rule books (and indeed legislation) drawn up in this way are likely to become in time both incomprehensible and contradictory.

At least two company rules may exist for any situation: the rule to get the job done in time, and a more demanding rule that may be invoked when things go wrong.

• Whilst an organisation’s safety policies and procedures may look well-considered, they may not relate to the risks and not be “fit for purpose”

• It is vital that the perceptions and beliefs of workers are considered and that they commit to the policies and procedures.

To date most MSS start with requirements for a Policy and objectives

Question: Where do the policy and objectives come from ?

Answer: The business needs of the organization, after examining its operating environment, market place, its “interested parties” etc., i.e. its “context”.

Annex SL now starts from the “context”, in order to integrate the MS more closely with an organization’s business practices and to align it with its “strategic direction”

Leadership and commitment

Top management shall demonstrate leadership and commitment with respect to the OH&S management system by ensuring processes are established for:

• taking overall responsibility and accountability for the protection of worker´s health and safety and for the effectiveness of the OH&S management system;

• ensuring that knowledge of the organization’s context as well as OH&S risks and OH&S opportunities are considered when establishing the OH&S management system;

OH&S management traditionally uses a risk-based approach to evaluate and address the risk of harm, which ISO 45001 maintains

ISO’s (Annex SL) format for management system standards now requires organizations to also consider the risk that the OH&S management system itself may not be effective, and to look for opportunities for improvement

Risk and No “preventive action”

The Annex SL text does not include a clause on “Preventive action”, as it is now assumed that the whole system will be a preventive tool. The concept of “risk-based” thinking has also been extended into drafting the requirements in ISO 45001. While ISO 45001 addresses risks and opportunities, this will not require organizations to implement a full risk management system (as described in ISO 31000). Risks will be required to be identified, and appropriate controls put in place.

This is partly to move away from the bureaucratic

paper based systems from the past, and to emphasize that an OH&SMS is a strategic tool.

Also, with the risk requirements, “documented

procedures” are seen as one form of risk control. The standards should not be prescriptive in demanding

them; instead an organization should decide when they are needed.

ISO 45001 uses the following hierarchy of controls:

a) eliminate the hazard;

b) substitute with less hazardous materials, processes, operations or equipment;

c) use engineering controls;

The ILO and some NSBs want the standard to require compliance with legal requirements

ISO C/S has rejected this, on the basis that legal compliance is an expectation with all standards, which are, in any case, used voluntarily.

Often they take short cuts with safety equipment and processes in order to get the job done more quickly, or to save on costs.

What can ISO do to help address this situation ?

It seems that a formal OH&SMS such as required for OHSAS 18001 or the future ISO 45001 will be too complicated or expensive for such organizations to implement.

There are already OH&S programmes such as the Safety Contractor Certificate (from the Netherlands) focussing on small businesses

Small businesses - continued

In the past, standards such as ISO 9001, were also supported by less rigorous standards such as ISO 9002 and ISO 9003

While ISO/PC 283 is currently focussing on developing ISO 45001 at the moment, and trying to ensure that it is generic and can be applied by any size of organization, it will return to considering the needs of small businesses in more detail.

It may look at following a ISO 9001/2/3 approach, or adopting a safety contractor certificate approach.

Other issues

Not all countries participating in ISO/PC 283 have adopted the ILO’s conventions.

Some have expressed concern that the development of ISO 45001 could be a back-door way of enforcing them, and that this could be disadvantageous particularly to developing countries

Others have stated that they consider OH&S to be a core human right, and have suggested that the standard should be written in such a way to enhance such rights.

Other issues

OHSAS 18001 was the first management system standard to include requirements about “performance” (this has since been adopted by ISO through Annex SL).

The OHSAS Project Group wanted organizations to think about what they really needed to do to ensure the health and safety of their staff, beyond what regulations or legal requirements demand.

A number of discussions in PC 283 focussed on prescriptive issues more related to legal compliance, such as requirements for reporting incidents

• ISO/PC 283 initially agreed a 3 year development “timeframe” for ISO 45001

• This targeted publication of ISO 45001 is for October 2016

• The approval of the second CD means that the PC is now working to prepare the Draft International Standard (DIS).

• The PC completed its review of comments at its meeting in September. Following editing and translation, the DIS is expected to be available in late January / early February 2016.

Transition from OHSAS 18001

The OHSAS Project Group will be developing “Migration” planning advice on moving from using OHSAS 18001 to ISO 45001.

It will be recommending a 3 year “migration” period for any accredited certification.

The migration planning is more complex than for ISO 9001 or ISO 14001, as some countries have adopted OHSAS 18001 in their legal requirements.
