    Meeting of the Ohio State Board of Pharmacy

    Monday, April 7, 2008

    9:07 a.m. The Ohio State Board of Pharmacy convened at the University of Findlay TLB Auditorium,Weinbrenner Theological Seminary, Findlay, Ohio, with the following members present:

    Gregory Braylock, R.Ph., President; Elizabeth I. Gregg, R.Ph.; Nathan S. Lipsyc, R.Ph.; KevinJ. Mitchell, R.Ph.; Dorothy S. Teater, Public Member; James E. Turner, R.Ph.; and Jerome J.

    Wiesenhahn, R.Ph.

    Also present were William T. Winsley, Executive Director; Timothy Benedict, AssistantExecutive Director; William McMillen, Licensing Administrator; Mark Keeley, Legislative AffairsAdministrator; David Rowland, Legal Affairs Administrator; and Sally Ann Steuk, AssistantAttorney General.

    The Board members and staff introduced themselves and President Braylock explained thefunction and duties of the Board to the staff and students present from the College of Pharmacyat the University of Findlay.

    Mr. McMillen discussed the Licensing Report with the Board.

    Mr. Keeley presented the Legislative Report.

    10:09 a.m. The Board recessed briefly.

    10:21 a.m. The Board was joined by Assistant Attorney General Sally Ann Steuk to conduct anadjudication hearing in accordance with the Ohio Revised Code Chapters 119. and 4729. in thematter of Sarah Elizabeth Lloyd,Intern (06-0-03861), Mason, Ohio.

    11:38 a.m. The hearing ended and the record was closed.

    Pharmacy Board Compliance Specialist Ann Abele explained a request from PSC MedSupply,LLC, Greensboro, North Carolina, and passed out information for the Board to review.

    11:55 a.m. The Board recessed for lunch.

    1:05 p.m. The Board reconvened with the following members present:

    Gregory Braylock, R.Ph., President; Elizabeth I. Gregg, R.Ph.; Nathan S. Lipsyc, R.Ph.; KevinJ. Mitchell, R.Ph.; Dorothy S. Teater, Public Member; James E. Turner, R.Ph.; and Jerome J.Wiesenhahn, R.Ph.

    Because there was a new group of students attending the afternoon session, Board and staffagain introduced themselves and President Braylock discussed the Board's function.

    8:30 a.m. The Ohio State Board of Pharmacy convened in room East B, 31st

    Floor, of the Vern RiffeCenter for Government and the Arts, 77 South High Street, Columbus, Ohio, with the followingmembers present:

    Nathan S. Lipsyc, R.Ph., Vice-President; Elizabeth I. Gregg, R.Ph.; Kevin J. Mitchell, R.Ph.;Dorothy S. Teater, Public Member; James E. Turner, R.Ph.; and Jerome J. Wiesenhahn,R.Ph.

    8:39 a.m. Mrs. Gregg moved that the Board go into Executive Session for the purpose of the investigationof complaints regarding licensees and registrants pursuant to Section 121.22(G)(1) of the Ohio

    Revised Code and to confer with an attorney for the Board regarding pending or imminent courtaction pursuant to Section 121.22(G)(3) of the Ohio Revised Code. The motion was secondedby Mr. Wiesenhahn and a roll-call vote was conducted by Vice-President Lipsyc as follows:Gregg yes; Lipsyc yes; Mitchell yes; Teater yes; Turner yes; and Wiesenhahn yes.

    9:31 a.m. The Executive Session ended and the meeting was opened to the public.

    R-2008-159 After discussion, Mrs. Teater moved that the requestfrom Theodore Perry, R.Ph. (03-2-15670), Cincinnati, Ohio, to withdraw his application for examination as a pharmacist beaccepted. The motion was seconded by Mr. Turner and approved by the Board:Aye 6.

    R-2008-160 Subsequently, Mr. Wiesenhahn moved that the Notice of Opportunity for a Hearing issued toMr. Perry be withdrawn. Mrs. Gregg seconded the motion and it was approved by the Board:

    Aye 6.

    R-2008-161 After discussion, the Board deemed that a request from Mark Alan Bremick, R.Ph. (03-1-20673), Worthington, Ohio, to be allowed to work in a location where there would be no accessto drugs is not a violation of his February 6, 2008, Board Order. Mrs. Gregg moved that therequest be approved. It was seconded by Mr. Wiesenhahn and approved by the Board:Aye 5/Nay - 1.

    R-2008-162 The Board deemed that a request from Barney T. Dotson, R.Ph. (03-3-20222), Cincinnati,Ohio, to be allowed to work as a customer service representative in a location where he wouldhave no access to drugs was not a violation of his November 6, 2007, Board Order. Mr.Wiesenhahn moved that the request be approved. The motion was seconded by Mr. Turner

    and approved by the Board:Aye 6.

    R-2008-163 After discussion, Mr. Turner moved that a proposed Cease and Desist order drafted by Boardstaff be issued in the matter of Vann Healthcare Services, Glasgow Kentucky. The motionwas seconded by Mrs. Gregg and approved by the Board:Aye 6.

    R-2008-164 After discussion, Mr. Turner moved that a proposed Cease and Desist order drafted by Boardstaff be issued in the matter of RXBids/Kelvin Bradley, Las Vegas, Nevada. The motion wasseconded by Mr. Lipsyc and approved by the Board:Aye 6.

    R-2008-165 The Board considered a request for an exemption to Ohio Administrative Code Rule 4729-5-10(Prescription pick-up station) received for the following sites:

    Teregen Laboratories, Willoughby, Ohio (02-1235150)Various Physician Offices on the letter of request

    After discussion, Mrs. Gregg moved that the Board approve the request as long as the partiesto the request comply with the requirements in the rule for such an exemption. The motion was

    seconded by Mr. Turner and approved by the Board:Aye 6.

    R-2008-166 Mrs. Gregg moved that Board staff be authorized to approve requests for exceptions from therequirements of OAC 4729-5-10 Pickup Stations in those cases involving the delivery ofchemotherapeuticagents to prescribers offices for direct administration of the drugs. Themotion was seconded by Mrs. Teater and approved by the Board:Aye 6.

    Mrs. Droz discussed the Prescription Drug Monitoring Program with the Board.

    R-2008-167 Mr. McMillen presented a request from pharmacy intern Maria Vladimirovna Wolf (06-0-06884), Marrow, Ohio, for permission to extend her internship one additional year due toextraordinary circumstances pursuant to Rule 4729-3-04 (Pharmacy Intern Identification CardRenewal). After discussion, Mr. Turner moved that the request be approved. The motion was

    seconded by Mrs. Teater and approved by the Board:Aye 6.

    Mr. Keeley gave an additional brief review of the Legislative Report.

    10:21 a.m. The Board recessed briefly.

    FINDINGS OF FACT

    After having heard the testimony, observed the demeanor of the witnesses,considered the evidence, and weighed the credibility of each, the State Board ofPharmacy finds the following to be fact:

    (1) Records of the State Board of Pharmacy indicate that Sarah ElizabethLloyd submitted an Application For Examination As A Pharmacist on orabout January 8, 2008.

    (2) Records further indicate that Sarah Elizabeth Lloyd was originally licensed

    as a pharmacy intern in Ohio on June 20, 2002 and that her license (06-0-03861) to practice as an intern lapsed September 15, 2006.

    (3) Sarah Elizabeth Lloyd did, from September 16, 2006, through April 19,2007, while not a pharmacist or pharmacy intern, dispense drugs and/orotherwise engage in the practice of pharmacy, to wit: after allowing herintern license to lapse, Sarah Elizabeth Lloyd lied to her employer, SkilledCare Pharmacy, about her examination status, and Sarah Elizabeth Lloydcontinued to practice pharmacy as a registered intern. Such conduct is inviolation of Section 4729.28 of the Ohio Revised Code.

    (4) Sarah Elizabeth Lloyd did, on or about July, 2005, while being a registeredpharmacy intern, fail to notify the Board of her change in her mailingaddress within 30 days of the effective date, to wit: after getting marriedand moving, on two different occasions, Sarah Elizabeth Lloyd did notnotify the Board of the changes. Such conduct is in violation of Rule 4729-5-06(A) of the Ohio Administrative Code.

    (5) Sarah Elizabeth Lloyd did, on or about August, 2005, while being a

    registered pharmacy intern, fail to notify the Board of her change in herplace of employment within 30 days of the effective date, to wit: afterchanging employment from Kroger Pharmacy to Skilled Care Pharmacy onJuly 8, 2005, Sarah Elizabeth Lloyd did not notify the Board of the change.Such conduct is in violation of Rule 4729-5-06(B) of the OhioAdministrative Code.

    CONCLUSIONS OF LAW

    (1) The State Board of Pharmacy concludes that paragraph (3) of the Findingsof Fact constitutes not being of good moral character and habits asprovided in paragraph (C) of Rule 4729-5-04 of the Ohio AdministrativeCode.

    (2) The State Board of Pharmacy concludes that paragraphs (3) through (5) ofthe Findings of Fact constitute being guilty of dishonesty andunprofessional conduct in the practice of pharmacy as provided in Division(A)(2) of Section 4729.16 of the Ohio Revised Code.

    (3) The State Board of Pharmacy concludes that paragraphs (3) through (5) ofthe Findings of Fact constitute being guilty of willfully violating, conspiringto violate, attempting to violate, or aiding and abetting the violation ofprovisions of Chapter 4729. of the Revised Code as provided in Division(A)(5) of Section 4729.16 of the Ohio Revised Code.

    DECISION OF THE BOARD

    Pursuant to Section 4729.16 of the Ohio Revised Code, and after considerationof the record as a whole, the State Board of Pharmacy hereby approves theApplication For Examination As A Pharmacist submitted by Sarah ElizabethLloyd; however, she may not sit for the examinations before July 1, 2008.

    Mr. Turner seconded the motion and it was approve by the Board:Aye 6.

    FINDINGS OF FACT

    After having heard the testimony, observed the demeanor of the witnesses,considered the evidence, and weighed the credibility of each, the State Board ofPharmacy finds the following to be fact:

    (1) Records of the Board of Pharmacy indicate that Lloyd Neal Fisk wasoriginally licensed by the State of Ohio as a pharmacist on July 30, 1992,pursuant to examination, and that his license to practice pharmacy in Ohiowas summarily suspended effective September 10, 2007.

    (2) Lloyd Neal Fisk is addicted to the use of controlled substances, to wit:Lloyd Neal Fisk has admitted to Board agents that he is and has beenaddicted to oxycodone for some time now. Lloyd Neal Fisk has

    admittedly stolen drugs from his employer, Columbus Childrens Hospital,and consumed oxycodone as often as four to six times per day whilepracticing pharmacy. Such conduct indicates that Lloyd Neal Fisk is withinthe ambit of Sections 3719.121 and/or 4729.16(A)(3) of the Ohio RevisedCode.

    (3) Lloyd Neal Fisk did, from January 30, 2007, through August 28, 2007, withpurpose to deprive, knowingly obtain or exert control over dangerousdrugs, the property of Columbus Childrens Hospital, by deception, to wit:Lloyd Neal Fisk has admittedly created false computer records so as tosteal oxycodone tablets from the hospitals PyxisCII safe. On at least 40different occasions, Lloyd Neal Fisk surreptitiously entered the computer tosteal a total of 3,710 oxycodone tablets. Such conduct is in violation of

    Section 2913.02 of the Ohio Revised Code.

    (4) Lloyd Neal Fisk did, from January 30, 2007, through August 28, 2007,knowingly gain access to a computer and/or computer system beyond thescope of the express or implied consent of the owner of the system orperson authorized to give consent, to wit: Lloyd Neal Fisk admittedly usedhis position as the Information Services Pharmacist at ColumbusChildrens Hospital to set up an account using anothers name and LloydNeal Fisk's ring finger (for positive ID purposes) so Lloyd Neal Fisk couldsteal oxycodone without detection. Such conduct is in violation of Section2913.04(B) of the Ohio Revised Code.

    CONCLUSIONS OF LAW

    (1) The State Board of Pharmacy concludes that paragraphs (3) and (4) of theFindings of Fact constitute being guilty of a felony and gross immorality asprovided in Division (A)(1) of Section 4729.16 of the Ohio Revised Code.

    (2) The State Board of Pharmacy concludes that paragraphs (3) and (4) of theFindings of Fact constitute being guilty of dishonesty and unprofessionalconduct in the practice of pharmacy as provided in Division (A)(2) ofSection 4729.16 of the Ohio Revised Code.

    (3) The State Board of Pharmacy concludes that paragraph (2) of the Findingsof Fact constitutes being addicted to or abusing liquor or drugs or impaired

    physically or mentally to such a degree as to render him unfit to practicepharmacy as provided in Division (A)(3) of Section 4729.16 of the OhioRevised Code.

    DECISION OF THE BOARD

    Pursuant to Section 3719.121 of the Ohio Revised Code, the State Board ofPharmacy hereby removes the Summary Suspension Order issued to Lloyd NealFisk on September 10, 2007.

    Pursuant to Section 4729.16 of the Ohio Revised Code, and after considerationof the record as a whole, the State Board of Pharmacy hereby suspendsindefinitely the pharmacist identification card, No. 03-2-19476, held by Lloyd NealFisk and such suspension is effective as of the date of the mailing of this Order.

    (A) Lloyd Neal Fisk, pursuant to Rule 4729-9-01(F) of the Ohio AdministrativeCode, may not be employed by or work in a facility licensed by the StateBoard of Pharmacy to possess or distribute dangerous drugs during such

    period of suspension.

    (B) Lloyd Neal Fisk, pursuant to Section 4729.16(B) of the Ohio Revised Code,must return his identification card and license (wall certificate) to the officeof the State Board of Pharmacy within ten days after receipt of this Orderunless the Board office is already in possession of both. The identificationcard and wall certificate should be sent by certified mail, return receiptrequested.

    Further, after one year from the effective date of this Order, the Board willconsider any petition filed by Lloyd Neal Fisk for a hearing, pursuant to OhioRevised Code Chapter 119., for reinstatement. The Board will only considerreinstatement of the license to practice pharmacy in Ohio if the following

    conditions have been met:

    (A) Lloyd Neal Fisk must enter into a new contract, signed within thirty daysafter the effective date of this Order, with an Ohio Department of Alcoholand Drug Addiction Services (ODADAS) treatment provider or a treatmentprovider acceptable to the Board for a period of not less than five yearsand submit a copy of the signed contract to the Board office. The contractmust provide that:

    (1) Random, observed urine drug screens shall be conducted at leastonce each month.

    (a) The urine sample must be given within twelve hours ofnotification. The urine drug screen must include testing forcreatinine or specific gravity of the sample as the dilutionalstandard.

    (b) Results of all drug screens must be negative. Refusal of adrug screen or a diluted drug screen is equivalent to a positiveresult. Any positive results, including those which may haveresulted from ingestion of food, but excluding false positiveswhich resulted from medication legitimately prescribed,indicates a violation of the contract.

    (2) The intervener/sponsor shall submit reports to the Board, in a format

    acceptable to the Board, indicating drug screens and their results ina timely fashion. Actual copies of drug screens shall be madeavailable to the Board upon request.

    (3) Attendance is required a minimum of three times per week at anAlcoholics Anonymous, Narcotics Anonymous, and/or similar supportgroup meeting.

    (4) The program shall immediately report to the Board any violations ofthe contract and/or lack of cooperation.

    (B) Lloyd Neal Fisk must demonstrate satisfactory proof to the Board that he isno longer addicted to or abusing drugs or impaired physically or mentally tosuch a degree as to render him unfit to practice pharmacy.

    (C) Lloyd Neal Fisk must provide, at the reinstatement petition hearing,documentation of the following:

    (1) Compliance with the contract required above (e.g.-proof of giving the

    sample within twelve hours of notification and copies of all drugscreen reports, meeting attendance records, treatment programreports, etc.);

    (2) Compliance with the continuing pharmacy education requirementsset forth in Chapter 4729-7 of the Ohio Administrative Code asapplicable and in effect on the date of petitioning the Board forreinstatement;

    (3) Compliance with the terms of this Order.

    (D) If reinstatement is not accomplished within three years of the effective dateof this Order, Lloyd Neal Fisk must also show successful completion of the

    North American Pharmacist Licensure Examination (NAPLEX)examination.

    (E) Upon such time as the Board may consider reinstatement, Lloyd Neal Fiskwill be afforded a Chapter 119. hearing. At such time, the Board mayconsider reinstatement with or without restrictions and/or conditions as theBoard deems appropriate under the circumstances.

    Mr. Wiesenhahn seconded the motion and it was approved by the Board:Aye 6.

    Lorraine Marie Kaup, R.Ph. (03-1-13596), of Kaup Pharmacy Inc., met with the Board torequest a change in the use of the Parata electronic prescribing system, approved December3, 2007, to include after-hours use in a new pharmacy in Arcanum, Ohio. After discussing herproposal with her, Mr. Braylock thanked her for meeting with the Board and said that the Boardwould reach a decision during the meeting and then notify her of the result.

    11:51 a.m. Mr. Mitchell said the Medical Board Physician Assistant Policy Committee did not meet thismonth.

    Mr. Braylock said the Nursing Board Committee on Prescriptive Governance meeting wascancelled this month.

    Mr. Benedict did not have a Medical Board Prescribing Committee report for this month.

    11:54 a.m.

    R-2008-170 Mr. Keeley discussed a request from workflow.com, Westlake, Ohio, concerning its electronicprescribing system. After discussion, Mr. Lipsyc moved that the system be found approvablepending final inspection. Mr. Turner seconded the motion and it was approved by the Board:

    Aye 6.

    (1) Records of the State Board of Pharmacy indicate that Steven Holtel wasoriginally licensed by the State of Ohio as a pharmacist on December 2,1980, pursuant to reciprocity, and is currently licensed to practice

    pharmacy in Ohio. Records further reflect during the relevant time periodsstated herein, Steven Holtel was the Responsible Pharmacist at StoltzLeader Drug, 40 Watkins Street, Nelsonville, Ohio, pursuant to Sections4729.27 and 4729.55 of the Ohio Revised Code and Rule 4729-5-11 of theOhio Administrative Code.

    (2) Steven Holtel did, from October 17, 2005, through February 14, 2006,knowingly sell or offer to sell a controlled substance when the conduct wasnot in accordance with Chapters 3719., 4729., and 4731. of the OhioRevised Code, to wit: Steven Holtel admittedly sold the followingprescriptions pursuant to internet sales without a valid physician-patientrelationship: alprazolam 0.25 mg.
