Prior the hearing, Mr. Jarreau and Counselor Reggie concluded that Mr. Jarreau acceptedthe following Consent Judgment which was recommended by the Chairman at the pre-hearing held on September9, 2013, if accepted and ratified by the Commission. CONSENT JUDGMENT

After considering the entire record in this matter and the interest of the parties in amicably resolving it, the parties haveconsented to a judgment in favor of the Louisiana Motor Vehicle Commission based upon alleged violations by Proride Trailers,LLC of LSA-R.S.32:1258.A. (1), (2), (4), (6), &(8) Denial, revocation, grounds, imposition of a civil penalty, or suspension oflicense; grounds; expiration; LSA-R.S.32:705.A.(1) Delivery of certificate of purchaser of vehicle; and LSA-R.S. 47:306.E.Returns and payment of tax; penalty for absorption. Therefore, based on the parties’ mutual consent;

IT IS HEREBY AGREED by and between Proride Trailers, LLC and the Louisiana Motor Vehicle Commission thatrespondent waives:

A. Any further procedural rights or remedies afforded under the law;

B. The requirement that the Commission's judgment recites statement of a findings of fact andconclusions of law; and

C. All rights to seek judicial review or otherwise to challenge or contest the validity of the judgmententered pursuant to this agreement

IT IS HEREBY FURTHER AGREED the Notice of Hearing may be used in construing the terms of the order. Noagreement, understanding, representation or interpretation not contained in the order or the agreement may be used to varyor contradict the terms of the order.

IT IS ORDERED, ADJUDGED, AND DECREED that Proride Trailers, LLC, 3253 Phillips Way Drive, Port Allen,Louisiana 70767, in complete satisfaction of all above-referenced violations, pay a fine to the Louisiana Motor VehicleCommission in the amount of TWENTY-SIX THOUSAND ($26,000.00) DOLLARS.

IT IS FURTHER ORDERED, ADJUDGED, AND DECREED that THIRTEEN THOUSAND ($13,000.00) DOLLARSof the fine be suspended conditioned upon Proride Trailers, LLC, 3253 Phillips Way Drive, Port Allen, Louisiana 70767, beingplaced on ONE (1) YEAR probation beginning the date this Consent Judgment is rendered and signed and adhering to allRules and Regulations of this Commission and Louisiana laws applicable to this Commission during the probationary period.In the event of a violation during the probationary period, the suspended portion of the fine shall become due and payable infull.

IT IS FURTHER ORDERED, ADJUDGED, AND DECREED that Proride Trailers, LLC, 3253 Phillips Way Drive, PortAllen, Louisiana 70767, pay the cost of the pre-hearing conference to the Louisiana Motor Vehicle Commission in the amountof THREE HUNDRED ($300.00) DOLLARS.

HOUSE BILL NO. 232 BY REPRESENTATIVE PONTI SUNSET LAW: Re-creates certain entities transferred to or placed within the office of the governor

AN ACT

To enact R.S. 49:191(7)(a) and to repeal R.S. 49:191(5)(l), relative to certain agencies within the office of the governor,including provisions to provide for the re-creation of such agencies; to provide for the effective termination date for all statutory authority for the existence of such statutory entities; and to provide for related matters.

Be it enacted by the Legislature of Louisiana:

Section 1. Pursuant to R.S. 49:193, the agencies transferred to the office of the governor pursuant to R.S. 36:4.1,to wit: the Louisiana State Board of Cosmetology, the Office of Financial Institutions, the Louisiana State Racing

Commission, the Louisiana Cemetery Board, the State Board of Certified Public Accountants of Louisiana, the State Boardof Architectural Examiners, the Louisiana Real Estate Commission, the Louisiana State Board of Home Inspectors, theState Licensing Board for Contractors, the Board of Examiners of Certified Shorthand Reporters, the Louisiana AuctioneersLicensing Board, the State Board of Examiners of Interior Designers, the Louisiana Real Estate Appraisers Board, theState Boxing and Wrestling Commission, the Louisiana Motor Vehicle Commission, the Louisiana Used Motor VehicleCommission, and the Louisiana State Polygraph Board shall be re-created effective June 30, 2014, and all statutoryauthority therefor is continued in accordance with the provisions of Part XII of Chapter 1 of Title 49 of the LouisianaRevised Statutes of 1950.

Section 2. All statutory authority for the existence of the aforementioned agencies and the statutory entities madea part of them as re-created by Section 1 of this Act shall cease as of July 1, 2019, pursuant to R.S. 49:191. However, theaforementioned agencies may be re-created prior to such date in accordance with the provisions of Part XII of Chapter1 of Title 49 of the Louisiana Revised Statutes of 1950.

Section 3. The provisions of R.S. 49:193 are hereby superseded to the extent that those provisions are in conflictwith the provisions of this Act.

Section 4. R.S. 49:191(7)(a) is hereby enacted to read as follows:

§191. Termination of legislative authority for existence of statutory entities; phase10 out period for statutory entities;table of dates Notwithstanding any termination dates set by any previous Act of the legislature, the statutory entities setforth in this Section shall begin to terminate their operations on July first of each of the following years, and all legislativeauthority for the existence of any statutory entity, as defined in R.S. 49:190, shall cease as of July first of the following year,which shall be the termination date:

(7) July 1, 2018:

(a) Those entities transferred to or placed within the office of the governor pursuant to R.S. 36:4.1.

Section 5. R.S. 49:191(5)(l) is hereby repealed in its entirety.

Section 6. This Act shall become effective on June 30, 2014; if vetoed by the governor and subsequently approvedby the legislature, this Act shall become effective on June 30, 2014, or on the day following such approval by thelegislature, whichever is later.

Present law provides that all legislative authority for such entities shall cease as of July 1, 2015, unless legislation isenacted which authorizes the re-creation of those entities prior thereto.

Proposed law provides for re-creation of those agencies, effective June 30, 2014, in accordance with the "sunset" law.Supersedes the provisions of the "sunset" law which sets out the procedure for review and re-creation and which requiresa separate bill to re-create each statutory entity within those agencies along with additional provisions. July 1, 2019, is thenew termination date, and termination will begin July 1, 2018, unless the agency is again re-created.

Effective June 30, 2014.

HOUSE BILL NO. 945 BY REPRESENTATIVE DOVEMOTOR VEHICLES: Exempts certain persons who engage in the sale or lease of certain trailers fromcertain definitions in the law pertaining to motor vehicle and similar products dealership, sales, and lessorlicensing.

AN ACT

To enact R.S. 32:1252(35)(b)(v), (36)(b)(v), 46(b)(vii), 65(b)(v) relative to motor vehicle leases and sales; to exempt certainpersons from the definitions of "motor vehicle dealer", "motor vehicle lessor", "recreational products dealer", and "usedmotor vehicle dealer"; and to provide for related matters.


Section 1. R.S. 32:1252(35)(b)(v), (36)(b)(v), 46(b)(vii), 65(b)(v) are hereby enacted to read as follows:

§1252. Definitions

The following words, terms, and phrases, when used in this Chapter, shall have the meanings respectivelyascribed to them in this Section, except where the context clearly indicates a different meaning:

Proposed law provides that persons who sell or offer to sell trailers with equipment attached thereto to a lessor at the endof a lease term and do not hold a bona fide franchise in effect with a manufacturer or distributor of new motor vehiclesexcept for trailers with equipment attached thereto not be included in the definition of "motor vehicle dealer" as defined inpresent law.

Present law defines "motor vehicle lessor" as any person or the subsidiary of any entity engaged in the motor vehicle,recreational products, or specialty vehicle leasing or rental business and provides for persons not included in the definitionof the term.

Proposed law provides that persons who sell or offer to sell trailers with equipment attached thereto to a lessor at the endof a lease term and do not engage in the lease or sale of any other motor vehicle, recreational product, except for trailerswith equipment attached thereto, or specialty vehicle leasing or rental business not be included in the definition of "motorvehicle lessor" as defined in present law.

Present law defines "recreational products dealer" as any person who, for a commission or with intent to make a profit orgain of money or other thing of value, buys, sells, brokers, exchanges, auctions, offers, or attempts to negotiate a sale orexchange of an interest in recreational products and who is engaged wholly or in part in the business of buying and sellingrecreational products in La. and provides for persons not included in the definition of the term.

Proposed law provides that persons who sell or offer to sell trailers with equipment attached thereto to a lessor at the endof a lease term and do not for a commission or with intent to make a profit or gain of money or other thing of value, buy,sell, broker, exchange, offer, or attempt to negotiate a sale or exchange of an interest in any other recreational productexcept trailers with equipment attached thereto and who are not engaged wholly or in part in the business of buying andselling recreational products, except for trailers with equipment attached thereto, in La. not be included in the definition of"recreational products dealer" as defined in present law.

Present law defines "used motor vehicle dealer" as any person, whose business is to sell, or offer for sale, display, oradvertise used motor vehicles, recreational products, or specialty vehicles, or any person who holds a license from the La.Motor Vehicle Comm. and provides for persons not included in the definition of the term.

SENATE BILL NO. 139 BY SENATOR MARTINYCOMMERCIAL REGULATIONS. Provides relative to marine products. (8/1/14)

AN ACT

To amend and reenact R.S. 32:1252(71) and 1270.1(1)(k) and to enact R.S. 32:1252(72) and 1270(G), relative to marineproducts; to provide for definitions; to provide relative to unauthorized acts; to provide for exemptions; to provide for certainterms and conditions; and to provide for related matters.


Section 1. R.S. 32:1252(71) and 1270.1(1)(k) are hereby amended and reenacted and R.S. 32:1252(72) and1270(G) are hereby enacted to read as follows:

§1252. Definitions

The following words, terms, and phrases, when used in this Chapter, shall have the meaningsrespectively ascribed to them in this Section, except where the context clearly indicates a different meaning:

(71) "Watercraft" means any contrivance used or designated for navigation on water, includingbut not limited to a personal watercraft as in R.S. 34:855.2.

(72) "Wrecker" means any motor vehicle equipped with a boom or booms, winches, slings, tilt beds, orsimilar equipment designed for towing or recovery of vehicles and other objects which cannot operate under their ownpower or for some reason must be transported by means of towing.

§1270. Establishment of new marine dealerships or relocations; protests; procedure

G. The provisions of this Section shall not apply when the marine products consist of a trolling motor,boat trailer, or watercraft trailer.

§1270.1. Unauthorized acts; marine products It shall be a violation of this Part:

(1) For a manufacturer, a distributor, a wholesaler, distributor branch, or factory branch of marine productsor any officer, agent, or other representative thereof:

(k) To fail to designate and provide to the commission in writing the community or territory assigned toa licensee. The provisions of this Subparagraph shall not apply when the marine products consist of a trollingmotor, boat trailer, or watercraft trailer.

Proposed law exempts from present law marine products consisting of trolling motors, boat trailers, and watercraft trailers.

Present law provides that it is a violation of law for a manufacturer, a distributor, a wholesaler, distributor branch, or factorybranch of marine products or any officer, agent, or other representative thereof to fail to designate and provide to thecommission in writing the community or territory assigned to a licensee.

Proposed law exempts from present law marine products consisting of trolling motors, boat trailers, and watercraft trailers.

Effective August 1, 2014.

SENATE BILL NO. 318 BY SENATOR GARY SMITHWARRANTIES. Provides relative to the performance of warranty repairs. (8/1/14)

AN ACT

To amend and reenact R.S. 32:1261(A)(1)(t), relative to warranty repairs; to provide relative to unauthorized acts; toprovide for exemptions; to provide for certain terms and conditions; and to provide for related matters.


Section 1. R.S. 32:1261(A)(1)(t) is hereby amended and reenacted to read as follows:

§1261. Unauthorized acts

A. It shall be a violation of this Chapter:

(1) For a manufacturer, a distributor, a wholesaler, distributor branch, factory branch, converteror officer, agent, or other representative thereof:

(t) To operate a satellite warranty and repair center, to authorize a person to perform warrantyrepairs who is not a motor vehicle dealer, or to authorize a motor vehicle dealer to operate a satellite warranty and repaircenter within the community or territory of a same-line or make motor vehicle dealer. This Subparagraph shall not applyto recreational any of the following:

(i) Recreational product manufacturers.

(ii) Emergency service of a motor vehicle with a gross vehicle weight rating of twelvethousand pounds or more manufactured or sold by the manufacturer or distributor who is authorizing thewarranty work to be performed.

(iii) A fleet owner or governmental entity that is authorized to perform warranty repairs ona vehicle owned by the fleet owner or governmental entity, provided that such fleet owner or governmental entityreceives written permission to perform the repairs from the motor vehicle dealer in whose community or territorythe fleet or governmental entity is located.

(iv) For the purposes of this Subparagraph, "fleet owner or governmental entity" shall meana person or unit of government who owns or leases for its own use or a renting or leasing company who rentsto a third party, ten or more motor vehicles with a gross vehicle weight rating of twelve thousand pounds or moremanufactured or sold by the manufacturer or distributor who authorizes the warranty repairs to be performed.Warranty repairs that are subject to the provisions of this Subparagraph shall meet the same requirements forfacilities and technician certification as are required for a franchise dealer.

(2) A fleet owner or governmental entity that is authorized to perform warranty repairs on a vehicle owned by thefleet owner or governmental entity provided such fleet owner or governmental entity receives written permission to performsuch repairs from the motor vehicle dealer in whose community or territory the fleet owner or governmental entity islocated.

Proposed law defines "fleet owner or governmental entity" as a person or unit of government who owns or leases for itsown use or a renting or leasing company who rents to a third party, 10 or more motor vehicles with a gross vehicle weightrating of 12,000 lbs or more manufactured or sold by the manufacturer or distributor who authorizes the warranty repairsto be performed.

Part V. Subpart 1. Chapter 7. Advertising §703A. General Prohibition,§705A. Specific Rules, and §723A. Advertising at Cost or Invoice. In attendance representing Julian FoyMotors, Inc. was Marshall Harper, Vice-President and representing the Commission were: Chairman RaymondJ. Brandt; Counselor Adrian LaPeyronnie; Mike Laviolette, Commission Investigator Supervisor; Amy Lawson,Commission Investigator; Ingya Cattle, Assistant Executive Director; and the Executive Director. The ExecutiveDirector advised the Commission Members the following Consent Judgment had been recommended by theChairman and accepted by the representative of Julian Foy Motors, Inc., if accepted and ratified by theCommission.
