    What to Know Before Working with a Real Estate Broker

    Before working with a real estate broker, you should know thatthe duties of a broker depend on whom the broker represents.If you are a prospective seller or landlord (owner) or aprospective buyer or tenant (buyer), you should know that thebroker who lists the property for sale or lease is the ownersagent. A broker who acts as a subagent represents the ownerin cooperation with the listing broker. A broker who acts as abuyers agent represents the buyer. A broker may act as anintermediary between the parties if the parties consent inwriting. A broker can assist you in locating a property,preparing a contract or lease, or obtaining financing withoutrepresenting you. A broker is obligated by law to treat youhonestly.

    IF THE BROKER REPRESENTS THE OWNER: The broker

    becomes the owners agent by entering into an agreement withthe owner, usually through a written listing agreement or byagreeing to act as a subagent by accepting an offer ofsubagency from the listing broker. A subagent may work in adifferent real estate office. A listing broker or subagent canassist the buyer but does not represent the buyer and mustplace the interests of the owner first. The buyer should not tellthe owners agent anything the buyer would not want theowner to know because an owners agent must disclose to theowner any material information known to the agent.

    IF THE BROKER REPRESENTS THE BUYER: The brokerbecomes the buyers agent by entering into an agreement torepresent the buyer, usually through a written buyerrepresentation agreement. A buyers agent can assist the

    owner but does not represent the owner and must place theinterests of the buyer first. The owner should not tell a buyersagent anything the owner would not want the buyer to knowbecause a buyers agent must disclose to the buyer anymaterial information known to the agent.

    IF THE BROKER ACTS AS AN INTERMEDIARY: A brokermay act as an intermediary between the parties if the brokercomplies with The Texas Real Estate License Act. The brokermust obtain the written consent of each party to the transactionto act as an intermediary. The written consent

    must state who will pay the broker and, in conspicuous bold orunderlined print, set forth the brokers obligations as anintermediary. The broker is required to treat each partyhonestly and fairly and to comply with The Texas Real EstateLicense Act. A broker who acts as an intermediary in atransaction:

    (1) shall treat all parties honestly;(2) may not disclose that the owner will accept aprice less than the asking price unless authorized inwriting to do so by the owner;(3) may not disclose that the buyer will pay a pricegreater than the price submitted in a written offerunless authorized in writing to do so by the buyer; and(4) may not disclose any confidential information oany information that a party specifically instructs the

    broker in writing not to disclose unless authorized inwriting to disclose the information or required to do soby The Texas Real Estate License Act or a courtorder or if the information materially relates to thecondition of the property.

    With the parties consent, a broker acting as an intermediarybetween the parties may appoint a person who is licensedunder The Texas Real Estate License Act and associated withthe broker to communicate with and carry out instruction of oneparty and another person who is licensed under the Act andassociated with the broker to communicate with and carry ouinstruction of the other party.

    If you choose to have a broker represent you, you shouldenter into a written agreement with the broker that clearlyestablishes the brokers obligations and your obligations. Theagreement should state how and by whom the broker will bepaid. You have the right to choose the type of representationif any, you wish to receive. Your payment of a fee to a brokedoes not necessarily establish that the broker represents youIf you have any questions regarding the duties andresponsibilities of the broker, you should resolve thosequestions before proceeding.
