    T HE GOV ER NMEN T o nWednesday cleared amend-

    mentstothe NationalTariff PolicyforElectricity,whichtightensthediscretioncurrentlyallowedtoregulators while setting powertariffsand makes a strongpitchforthepromotionofcleanenergy.

    The tariff policy has morethan30 amendmentsin theex-istingtariffpolicy theNationalElectricityPolicy,2005.

    Theregulationstightenthenorms followedby electricityregulatorsfor settingpowertar-iffsby requiringthem toneces-sarilybeguidedbythenewpol-icywhile framingregulationsunder section 61 of theElectricityAct 2003.

    After the amendments, itwouldbe bindingonthe regula-tors totake decisions as perthechangedpolicy.

    A significantaddition totheobjective of thepolicyare the

    promotion of renewable gener-ation sourcesand aimto createmore competition, efficiency inoperationsand improvementinqualityof power supply.One ofthe recommendations in thepolicy toincentivise thedistri-

    bution companies to procurepower fromrenewablesourcesof energy,for whichthe centralgovernmentcould notifyan ap-propriatebid-basedtariff frame-workfor renewable energy.

    Onthe regulatory side,thetariff policyhas incorporatedtheword necessarily inSection61oftheElectricityAct2003,whichempowers regulators to set

    termsandconditionsfor thede-termination of tariffs at autilitylevel.

    The Act also requires theCentralElectricity RegulatoryCommissionand StateElectricityRegulatory Commissions

    (SERCs) shall necessarily beguidedbythetariffpolicyindis-charging theirfunctionsinclud-ingframingthe regulationsun-dersection61of theAct.

    Thepolicyhasalsoallowsin-

    creasein fuelcostonaccountofimporttobeincludedinthetar-iff structure.

    Incase of reducedquantityof coalsupplied byCoal India,vis-a-vistheassured quantityof85percent, the highercost ofimported or market based e-auction coal formakingup theshortfall,shall beconsidered forbeing madea passthroughbyCERCor SERCs,on acase-tocasebasis, tothe extentof shortfall,according to anamendmenttothepolicy.Generators,however,have beengiven thefreedom tosellsurpluspowerin spotmar-ketif the beneficiary doesnotgivepriornoticetwo daysahead.Itwasearlier10hours.

    Inafirst,thepolicyalsospec-ifiesnormsforancillaryservices.The central commission hasbeengiventherighttointroduce

    thenormsand framework forancillaryservicenecessarytosupport the power system orgridoperationfor maintainingpowerquality,reliabilityandse-curityof thegrid, including themethodof sharingthe charges.

    THENR NarayanaMurthycom-mitteeappointedbytheSEBI hasproposedtweaking safehar-bournorms andimplementing

    the SecuritiesTransactionTax(STT)approachtotaxationof in-vestmentsand distributions byalternate investment funds(AIFs), includingventure fundsandprivate equityfunds.

    Currently most fund man-agers of offshorefundsmanagetheirinvestmentsfrom offshorelocationsratherthanfrom India.Thisis adisadvantage tothemandIndia.The fundmanagerslosethebenefitof beingclosetothe Indian private equity andventurecapitaldealflowi.e.thepipelineof investibleventures,thecommitteehas said.

    India loses theemploymentand tax revenue benefits of alargeIndia-based fundmanage-ment industryandlargerrelatedvolumesof long-termandstableprivateequity andventure cap-ital inflows.In order toattract

    significantamounts of foreigncapitalby havingfund managersbasedin India, itis importantthattheiroperationsinIndia arenottreatedas permanentestab-lishments.

    Amongtaxsuggestions,it has

    proposedpass througheffectivewithouta 10per cent leakage,non-taxationof capitalinvestedasdeemedincomeandclarityonindirecttransfersat fundlevel.Ithas recommendedtaxabilityofincomeof AIFascapitalgainsasagainst business income will

    avoidunnecessarylitigationandbuild in more certainty. Thepanelsuggested exemptionfromservice taxon services forrais-ing funds from overseas in-vestors.

    A keyproposalis forintro-ductionof SecuritiesTransactionTax(STT)for private equityandventurecapitalinvestments.

    Accordingto thecommittee,anappropriaterateof STTcouldbe introducedon alldistribu-tionsof AIFs,investment,short-term gains and other incomeandeliminate anywithholdingoftax.

    After Securities TransactionTax incomefromAIFs shouldbetaxfreeto investors. Toensurethattherearenottoomanyhas-slesinattractingoverseasfunds,it has said the governmentshould clarifythe rules forin-

    vestment by non-residentIndians(NRIs)in AIFson a non-repatriation basis. Clearing theambiguity inthis regard wouldhelpNRIs invest inAIFs usingfunds intheirrupee accounts,amongothers.
