JUDICIAL AFFIDAVIT RULE

Whereas,case congestion and delaysplague most courts in cities, given the huge

volume of cases filed each year and theslow and cumbersome adversarial syste1nthat the judiciary has in place;

Whereas, about 40 of criminal cases aredismissed annually owing to the fact that

complainants simply give up con1ing tocourt after repeated postponements;

Whereas, few foreign businessmen ma!elong"term investments in the Philippinesbecause its courts are unable to provide

ample and speedy protection to theirinvestments, !eeping its people poor;

Whereas, in order to reduce the timeneeded for completing the testimonies of

witnesses in cases under litigation, on#ebruary $1, $01$ the %upreme &ourtapproved for piloting by trial courts in'ue(on &ity the compulsory use of judicialaffidavits in place of the direct testimoniesof witnesses;

Whereas, it is reported that such pilotinghas )uic!ly resulted in reducing by abouttwo"thirds the time used for presenting thetestimonies of witnesses, thus speeding upthe hearing and adjudication of cases;

Whereas, the %upreme &ourt &ommitteeon the Revision of the Rules of &ourt,headed by %enior *ssociate +ustice*ntonio - &arpio, and the %ub"&ommitteeon the Revision of the Rules on &ivil

Procedure, headed by *ssociate +usticeRoberto *- *bad, have recommended foradoption a +udicial *ffidavit Rule that willreplicate nationwide the success of the

Whereas, the %upreme &ourt /n anc findsmerit in the recommendation;

NOW, THEREFORE,the %upreme &ourt/n anc hereby issues and promulgatesthe following

Sectio 1.Scope." 2a3 his Rule shallapply to all actions, proceedings, andincidents re)uiring the reception ofevidence before
