    LEGAL Healthand Safety

    Every employer is responsible formaking sure that all staff are trainedand competent enough to carry outtheir work. All production companiesmust have a a current health andsafety policy, that staff employeesand employers must follow. TheHealth and Safety at Work Act l974places a duty on the employer, andemployees, to work in a safemanner.     document outlines any possible risksand displays how hazardous theyare in order of the risk rating.

    I damaged a tripod during the production of mydocumentary. I could have possibly avoidedthis by removing the base plate from thecamera when I was packing my equipmentaway.

    Although I had been trained in how use theequipment provided, on this occasion I did notfollow the correct procedure as I was in a rush.

    If I was involved in the media industry, thiscould have cost me a large sum of money inreplacing equipment.

    Following the health and safety policy made me muchmore aware of the possible dangers within production.When filming my vox-pops this made me cautious ofoutdoor dangers such as theft or loss of equipmentand weather conditions. Keeping my equipment withme at all times meant that I avoided it being stolen orlost.

    The action that I took in filling in risk assessmentshighlighted the level of risk involved. This determinedwhether or not I went to film in these locations.Fortunately my locations had low risk ratings meaningthat I felt confident while filming the production

    My documentary was full of content that hadcopyright protection. This included music,

    achieve footage, graphics and images. Eventhough these were all relevant to mydocumentary, I did not get copyright for most ofthem.

    Using elements of the Who Wants to be aMillionaire format including graphics andmusic, means that I could be prosecuted by theproducer Endomel.

    I will be protected by copyright rules and ask

    Permission from companies such as Radio 1 radio

    station to use their images, videos and other material.I may have also been given a license to ensure that Iam allowed to use material. from the author.

    However as I knew my Radio 1 Dj really well, I hadconfidence to ask him if I was allowed to use picturesof him with other celebrities involved with the BBC. Ashe responded positively to my request, he also let mefilm all of his credentials and awards.

    Legal-Libel In the process of making a production, all cast

    must not make statements about somethingthat may not be true. An example of this wouldbe saying negative things about someonesuch as, All black people smoke weed thatmay hurt them especially if it isn't true.

    The test that is to be applied will be whether areasonable person would react to thestatement in such a manner so as to have alower opinion of the one who made thestatement.

    If my documentary said something like, Only White

    males download music then my documentary wouldbe libellous. This would make the audience of otherethnicities less likely to relate to my documentary.

    As libel wasnt an issue in my documentary, I was fully

    aware that I had to be careful about the content that Idelivered and made sure that it was accurate and true.During my vox-pops I made sure that I spoke to teenagersthat were both male female. This was because illegal musicdownloading appealed to both of these genders.

    Legal-DataProtection

    The producer responsible for making theproduction must make sure that theirinformation is accurate and true. They mustnot share other information about companiesor people without their consent.

    I also made a contact list of my contributors,however I could not include the contributorspersonal details such as, their phone number oremail address. If I had done this then thesedetails would have been posted onto the blogmeaning that anyone would be able to accessthem, which could have resulted in undesirablepeople contacting him meaning that he couldhave prosecuted me under the Data ProtectionAct.

    As I managed to hook up interviews with mycontributors, I got their permission for them to producetheir experience of illegal music downloading. I gavehim anonymity in post production by blurring his faceout. This meant that he could not be pursued forcarrying out illegal music downloading.

    LEGAL ANDETHICAL Race andEthnicity

    The producer must consider race andethnicity. However this must relate to thesubject content such as, a subject projectinvolving group that may be cultural or medicalissues. Another example would be how acertain audience would behave from astatement made about them.

    As I had used a mixed race illegal downloader whichcould have connoted to my audience that it is mainlymixed raced people are criminals and that it is onlythem that download illegally. I also had a white manin my Performing Rights Society interview whichcould have suggested that people of colour are thereason why illegal music downloading is such a bigissue.

    I made sure that I chose vox-pops including a variety ofrace giving their opinion based on their ethnicity. Theethnicity of my vox-pops connoted a representative sampleof their explanation to illegal music downloading.

    I also used a group of extras in my documentary of differentbackgrounds and lifestyle. An example of this would bewhen I filmed the introduction to my documentary and thepresenter says 50% of you like to socialise. This showedthat my documentary was open to a lot of a differentbackground.

    Using a wide range of races and ethnicities meant that my

    documentary was diverse and this expanded the appeal outto a wider target audience.

    LEGAL ANDETHICAL Privacy

    In a production as serious as a documentary,staff must know if the information they want todeliver is held private to the company. If theproduction team use certain information thatwas meant to be kept private from anothercompany, then the company have the right to

    sue you.

    I was unable to give a location of where the illegaldownloader was being interviewed as I was notallowed to tell everyone who may be watchingpersonal information about him. Seeing as hedownloads music illegally, I had to keep his identityprivate to avoid the possibility of him being

    prosecuted.

    I made sure that I covered the face of my illegal musicdownloader during post production. This made mydocumentary more mysterious by hiding his identity. At thestart of the interview with the illegal downloader, I cut out ashot of the presenter mentioning where he was. Thisworked really well as I did not reveal to other people such

    as the police where he lives, and it was also less timeconsuming meaning that I could of got straight to theinterview with my illegal downloader.

    PROJECTSPECIFIC

    -Budget

    A certain amount of money in which a mediaproduction team are permitted to spend during

    production. This would have to cover the wholeproduction including, equipment,royalties/licenses, contributors, travelexpenses, accomodation, stationary orsoftware.

    This may have affected my product negatively as Iwas limited in choosing certain equipment such as

    tripods and cameras. This would have also beendifficult as I rented out some of the equipment for acertain amount of days. If I needed the equipment formore than the days I had required then I would haveran into a financial problem.

    Having a budget of 5000 meant that I was well organisedand creative with the production that I made. I could have

    cut back on expenses for some of my travel arrangementsas I am 18 years old using an oyster card. As I had handledmy budget well, I had more than 400 left over which meantthat I could have saved that money to put towards anotherproduction.

    Another positive point is that the Apple Mac computer Iwould have brought would have come with free editingsoftware meaning that I would not have to spend any extramoney buying software.

    PROJECTSPECIFIC -echnology

    Certain equipment that I would have used toeither film or edit my production. Using elements of the Who Wants to be aMillionaire format meant that I would have hadto seek permission from the company Endomel.This may have been a negative thing as theymay not allow me to use the graphics that I haveused making the idea of informing, educatingand entertaining my audience through a quizwould not be accomplished.

    Using technology such as graphics in my, who wants to bea millionaire scene meant that I could be much morecreative with how I wanted my documentary to look like. Toadd to the list, using effects during post production

    such as speed ups and changing the colour of the scenemade my documentary more exciting to watch.

    Zooming in and panning across to pictures and cutawaysduring my interview with my Radio 1 Dj proved to bepositive. This was because it helped to keep mydocumentary much more engaging towards my audience.

    TV INDUSTRYSPECIFIC Regulatory andself-regulatory(OFCOM/ BBC)

    Ofcoms role is to respond to complaints aboutthe content of all radio and TV programs in theUK. Ofcom work from the code this containsall the rules and ethics that the producers haveto follow while creating a programme. Ofcommay punish any broadcast company or finingthem or making them apologise if they do notfollow these rules.

    The BBC have to follow certain rules that theyhave set themselves before they decide tobroadcast any of their productions.

    I was going to include a scene in my documentaryabout the pros and cons of certain musicdownloading sites. However I decided against it as Ithought that publishing the problems may suggestthat these specific sites are causing issues with thesecurity of your computer. This could have resultedwith these site complaining to Ofcom.

    Knowing that I had to stick to the rules kept me from fallinginto these issues as I did some research on the Ofcom code.This meant that I was fully aware of what I could and couldnot use An example of this would be not to use badlanguage or racial comments in my documentary.
