ACQUISITION OF LAND

The following declaration, made by the President of Malta in terms of article 3 of the Land Acquisition (Public Purposes) Ordinance (Chapter 88), is published in terms and for the purposes of article 9(1) of the said Ordinance.

DeCLArATION by The PresIDeNT Of MALTA

Whereas by declaration made by the President of Malta dated 10th May, 1996, the undermentioned land was declared to be required by the competent authority for a public purpose in terms of the provisions of the Land Acquisition (Public Purposes) Ordinance (Chapter 88) and that the acquisition thereof should have been by absolute purchase.

Description of the Land

The following land in Żejtun:

Plot of land measuring about 36 square metres, bounded on the North by property of salvatore Azzopardi, and on the south and south east by Triq Antonio Micallef or more precise boundaries.

The abovementioned land is shown in brown and marked as plot No. ‘4’ on plan L.D. No. 132/95, which may be viewed on demand at the Land Department, Auberge de baviere, Valletta.

Whereas the present Declaration made by the President of Malta is being published for the purposes of Act I of 2006.

The compensation offered as on 1st January 2005, is six thousand, seven hundred and eight euro and sixty cents (€6,708.60) according to the valuation published with this declaration as made by of Architect Joseph henry spiteri, A. & C.e.

A valuation is being made dated 30th september, 2010, in connection with the subject in the above caption:

The site in question is indicated ‘4’ edged in brown along Triq Antonio Micallef, Żejtun, on drawing LD Plan 132/95 dated 21/7/95.

In terms of the Land Acquisition Ordinance, Chapter 88, the site is considered as within a building scheme.

The site is bounded on the North by property of salvatore Azzopardi and on the south and south east by a public road (Triq Antonio Micallef). The site has a footprint area of about 36m2.

Taking into account the locality of the site, the footprint area and other contributory factors from assessments carried out based in year 01/07/1986, the value of the site on a freehold basis is one thousand and ninety euros and 15 cents (€1,090.15).

As directed by the Commissioner of Lands, in terms of article 25(3A) of the Land Acquisition (Public Purposes) Ordinance, Chapter 88 of the Laws of Malta, I am assessing the free and unencumbered of the property described hereunder in siġġiewi, is required by the Government for a public purpose, after having taken into consideration the locality as well as other matters which may be related to the value of the same property.

Land in Marsa

As directed by the Commissioner of Lands, in terms of the Land Acquisition (Public Purposes) Ordinance, I, the undersigned architect, assess the freehold and unencumbered value of the property described hereunder in Marsa, which is required by the Government for a public purpose, after having taken into consideration a number of criteria which may be related to the value of the same property, amongst which:

i. the use and potential of the land in terms of the guidelines stipulated by the Local Plan for the Grand harbour, as published by the Malta environment and Planning Authority (MePA),

ii. as the land qualifies in terms of the Land Acquisition (Public Purposes) Ordinance, Cap. 88,

iii. the locality

iv. the size and contours of the land,

v. the market value in terms of european Council Directive 91/64/eeC, Article 49(2)

vi. the value on the open market of the similar property in the vicinity, and

vii. the present situation of the property market.

The land measuring about 18 square metres, bounded on the North and North east by a public road and on the south West by property of Messrs Camenzuli Tractors Ltd, which land is considered as a building site in terms of the Land Acquisition Ordinance, is within the boundaries of the development zone in terms of the Local Plan for the Grand harbour as published by MePA and forms part of the public road which has been open for a number of years. The same land is shown in red on plan L.D.29/93 and valued for the price of four thousand, one hundred and fifty euro (€4,150) in terms of the property market as on 1st January 1994 and five thousand, two hundred and fifty euro (€5,250) in terms of the property market as on 1st January, 2005.

Description of the Land

The following land in Marsaskala:

A plot of land measuring about 5.6 square metres, bounded on the North West by Triq san Tumas, on the south West by property of Grazio buhagiar and on the south by property of francesco Psaila or more precise boundaries.

As directed by the Commissioner of Land, I have been requested to provide a valuation in connection with the subject in the above caption.

The property in question is indicated on drawing L.D.156/74/A.

In terms of the Land Acquisition Ordinance, Chapter 88, the property is considered building site. The land has a superficial area of about 5.6m2.

Whereas by declaration made by the President of Malta dated 23rd May 1996, the undermentioned land was declared to be required by the competent authority for a public purpose in terms of the provisions of the Land Acquisition (Public Purposes) Ordinance (Chapter 88) and that the acquisition thereof should have been by absolute purchase.

Description of the Land

The following land in Żurrieq:

Plot of land measuring about 155 square metres which included a well, bounded on the North east by property of emanuel Mangion, on the south east and east by property of Anthony Caruana or more precise boundaries.

The abovementioned land is shown in red and marked as plot number 3A on plan L.D. No. 120/95/1, and included a well, which may be viewed on demand at the Land Department, Auberge de baviere, Valletta.

Whereas the present Declaration made by the President of Malta is being published for the purposes of Act I of 2006.

The compensation offered for the abovementioned plot of land as on 1st January 2005 is seven thousand euro (€7,000), according to the valuation published with this declaration as made by of Architect Carmen V. sutton, A.&C.e.

in the vicinity, and vii. the present situation of the property market.

Plot 3A. The following declaration, made by the President of Malta

in terms of article 3 of the Land Acquisition (Public Purposes)

Ordinance (Chapter 88), is published in terms and for the

purposes of article 9(1) of the said Ordinance.

Whereas by declaration made by the President of Malta

dated 17th february, 1998, the undermentioned land was

declared to be required by the competent authority for a public

purpose in terms of the provisions of the Land Acquisition

(Public Purposes) Ordinance (Chapter 88) and that the

acquisition thereof should have been by absolute purchase.

Description of the Land

The following land in Ħal Kirkop:

Plot of land measuring about 132.90 square metres,

bounded on the North and south east by property of Maria

Carmela Cassar et al and on the North east by property of the

family Apap bologna or more precise boundaries.

The abovementioned land is shown in red and marked

as Plot 2A_3 on plan P.D. No. 196A_96_1_A, which may

be viewed on demand at the Land Department, Auberge de

baviere, Valletta.

Whereas the present Declaration made by the President of

Malta is being published for the purposes of Act I of 2006.

The compensation offered for the abovementioned plot of

land as on 1st January 2005 is one thousand, eight hundred

Land Acquisition (Public Purposes) Ordinance, I have been

requested to assess the freehold and unencumbered value

of the property described hereunder in Ħal Kirkop, which is

required by Government for a public purpose, after having

taken into consideration the locality, as well as other matters

which may be related to the value of the same property.

Plot 2A_3. Plot of land measuring about 132.90 square

metres, bounded on the North and south east by property of

Maria Carmela Cassar et al and on the North east by property

of the family Apap bologna or more precise boundaries,

which land is considered as agricultural land in terms of

the Land Acquisition Ordinance, and is edged in red and

As directed by the Commissioner of Land, in terms of article 25(3A) of the Land Acquisition Ordinance (Public Purposes), Chapter 88 of the Laws of Malta, after considering the locality, the size, contours, state and potential according to the plans and boundaries of the development zone as officially published by the Malta environment and Planning Authority (MePA) as well as the value of other similar properties in the vicinity and other matters which may affect the value of the same properties, I am hereby dividing the original amount of the compensation regarding the property described hereunder in Triq Ġużeppi ellul in Ħal Luqa which:

i. on the 12th November 1981, it was valued by architect

O. Caruana Montaldo for the price of ninety-two Maltese Liri and eighty cents (Lm92.80/€216.17)

ii. on the 26th November 2007, it was valued by the undersigned, on the 1st January 2005 for the price of two thousand five hundred Maltese Liri (Lm2,500/€5,823.43)

and as marked as plot 2 on part of plan L.D. 159A/74/A it is now divided in plots 2A, 2b, 2C and 2D on plan P.D. 159A_74_A_2, all required by the Government for a public purpose.

Whereas by declaration made by the President of Malta dated 8th January, 1982, the undermentioned land was declared to be required by the competent authority for a public purpose in terms of the provisions of the Land Acquisition (Public Purposes) Ordinance (Chapter 88) and that the acquisition thereof should have been by absolute purchase.

Description of the Land

The following land at Ħal Luqa:

1. Plot of land measuring about 44 square metres, bounded on the North east by property of Giomaria Attard et al, on the south east by property of Paul zahra et al and on the North West by property of Joseph Mercieca or more precise boundaries.

The abovementioned land is shown in red and marked as plot number 2b on plan P.D. No. 159A_74_A_2, which may be viewed on demand at the Land Department, Auberge de baviere, Valletta.

Whereas the present Declaration made by the President of Malta is being published for the purposes of Act I of 2006.

The compensation offered for the abovementioned plot of land as on 1st January 2005 is five hundred and fifty euro (€550), according to the valuation published with this declaration as made by of Architect Michael schembri, A.&C.e.

Description of the Land

The following land in Ħaż-Żabbar, in the limits of Xgħajra:-

Plot of land measuring about 294.2 square metres, bounded on the North West by property of Victor Lia et al, on the North east by Triq Orlando, Ħaż-Żabbar, and on the North West by property of Carmelo bonnici or more precise boundaries.

The abovementioned land is shown in yellow and marked as plot ‘14b’ on plan L.D. No. 35/76/1, which may be viewed on demand at the Land Department, Auberge de baviere, Valletta.

Whereas the present Declaration made by the President of Malta is being published for the purposes of Act I of 2006.
