    present during the incident. Suspect presumably resides in

    Seattle, his last known address is 27 3rd Avenue, Seattle.

    On Saturday, November 9th, 2013, just prior to 1107 hours,

    was awoken by the sound of the steel security gate shaking outside

    the sliding door in her living room. looked outside into the

    fenced/gated patio and saw an unknown man later identified as

    pacing about ~ the patio is surrounded by a 7', solid wooden fence/gate.

    woke her husband .

    The two noticed that the locked steel security gate outside their sliding

    door was ripped off the wall and leaning against the house. The glass

    slider was exposed.

    A man later identified as suspect was in the

    private, secure patio pacing about and acting oddly. picked up a

    block of wood (the thougth it was a brick) and sat down on a table

    in the patio area for a few moments. At some point picked up a gardentrowel and peered into the . and were afraid the

    unknown man would break into their apartment ~ called 911.

    grabbed a large canister of pepper spray and showed it to

    through the window. did not acknowledge .

    walked over to a brick retaining wall and sat down, facing and just

    inside the wooden patio gate. Officers arrived shortly thereafter.

    I arrived on-scene and with Officers Knox and Fowler walked over to the

    wooden patio door of the patio. I pushed the door open and it

    stopped halfway open on the leg of who was still seated on the

    retaining wall ~ staring at me.

    his hands from his pockets ~ several times ~ he did not respond. I told

    to step out of the patio ~ he did not respond. At this point I could

    hear telling us to get in the patio immediately ~ there was an

    edge to his voice.

    was not responding to verbal commands in anyway, so officers

    stepped forward to restrain him. As soon as officers placed their hands on

    arms he tensed up and began yelling.

    I tried to communicate with but he was not listening, and he was

    tensing his arms, pulling them away, and preparing for a struggle.

    appeared to be under the influence of narcotics. At this point I was concerned for my safety, the safety of the other

    officers present, and if we were unable to control , for the safety of

    the .

    I told officers to handcuff . We tried to pull arms behind

    his back, but he he gained his feet and with the leverage of his leg

    muscles, and his arm strength we were unsuccessful. lunged forward

    and we moved with him in hopes of using the nearby wooden wall as a brace

    to prevent from moving.

    was incredibly strong and pulled officers toward the open gate and

    street. I had both hands on left arm as I had when I first entered

    the patio, and I was losing my grip. was exhibiting amazing strength,

    and was headed for the street.

    I directed officers to take to the ground. Officers were able to

    spin around, but he would still not go to the ground. We were at the

    entrance of the patio and there was precious little room ~ I was slammed

    into the brick retaining wall, and the wooden fence as struggled to

    maintain his feet, and tried to free his arms.

    was bent over at the waist, and I had ahold of his left arm,

    Officer Knox was on his right, and Officer Fowler was ahold of

    upperbody. I leaned over back and put my weight over his legs. The

    combined action of the three officers finally caused legs to buckle

    and he went to the ground.

    At this point I was able to place handcuffs on ~ locked and gauged.I briefly searched pockets and found only an old disposable lighter.

    I directed officers to place in a patrol car, and Officers Fowler

    and Knox escorted to a nearby patrol car and placed him inside.

    was not cooperative and had to be pulled into the backseat. Due to

    extremely violent nature, he was not seat-belted ~ it was too dangerous for

    officers to lean into the vehicle to even attempt placing a seatbelt on

    him.

    I called for a supervisor with the intent of screening the incident

    on-scene and transporting directly to KCJ.

    Officer Fowler mirandized using his MIR codes card on DICVS.

    responded by screaming. A few minutes later, while seated in the back seatof patrol car #487, decided to repeatedly ram his head into the

    divider between the front and back seats. This opened a rather large cut on

    forehead. self-destructive actions were captured on the

    in-car video system.

    SFD was called to address self-inflicted head wound. SFD #A25 was

    dispatched and responded. As officers and SFD personnel prepared to remove

    from the car, began kicking the patrol car door. The door was

    opened and kicked his way out.

    Officers and SFD personnel brought forward to the ground.

    he was flinging it everywhere. I was holding right leg down and washaving difficulty doing so.

    A spit-sock was provided by SFD and pulled over head.

    legs were restrained first with an SPD leg restraint strap ~ applied by an

    unknown fire-fighter, and later with velcro straps provided by personnel

    from AMR (at which time the SPD leg restraint was removed).

    was restrained on an AMR gurney, face-up. Even restrained

    struggled so much that he almost overturned the gurney with attendants

    holding either end. AMR personnel were not comfortable with removing the

    Officer Laina, #7606 rode in the ambulance with at the request of

    the AMR personnel. At the hospital divulged that he had recently

    injected an unknown drug into his body, provided by an unknown subject.

    was sedated by hospital staff before he could be interviewed further

    about the incident.

    Sergeant Dietrich screened the event on-scene and later in the East

    Precinct. Officer Consalvi took audio statements from and

    holding his can of pepper spray.

    After reviewing the accounts provided by the I decided to book

    for 'Investigation of Burglary' ~ Sergeant Dietrich concurred

    with my decision. At the time of this report was still being treated at HMC. I

    provided a business card with incident number to victim .

    If is not charged with burglary, I am requesting that he be

    charged with three misdemeanor crimes; Criminal Trespass ~ SMC 12A.08.040,

    Property Damage ~ SMC 12A.08.020, and Resisting Arrest ~ SMC 12A.16.050.
