A GENERAL ACT FOR THE ORGANIZATION OF MUNICIPAL GOVERNMENTS IN THE PHILIPPINE ISLANDS

CHAPTER I

GENERAL PROVISIONS

SECTION 1. (a) The pueblos of the Philippine Islands shall be recognized as municipal corporations with the same boundaries as now existing de jure or de facto, upon organization under the provisions of this Act.

(b) All property and property rights vested in any pueblo under its former organization shall continue to be vested in the same municipality after its incorporation under this Act.


SECTION 3. The government of each municipality established under this Act is hereby vested in a president, a vice-president, and a municipal council. The president and the councilors, together with the vice-president, shall be chosen at large by the qualified electors of the municipality, and their term of office shall be for two years from and after the first Monday in January next after their election and until their successors are duly chosen and qualified: Provided, That the president and vice-president elected in nineteen hundred and one shall hold office until the first Monday in January, nineteen hundred and three, or until their successors are duly chosen and qualified and that the councilors elected in nineteen hundred and one shall divide themselves by lot into two classes. The seats of those of the first class shall be vacated on the first Monday of January, nineteen hundred and two, and those of the second class one year thereafter, or when their successors are duly chosen and qualified, so that one-half of the municipal council shall be chosen annually.


SECTION 4. (a) Incorporated municipalities shall be of four classes, according to the number of inhabitants. Municipalities of the first class shall be those which contain not less than twenty-five thousand inhabitants, and shall have eighteen councilors; of the second class, those containing eighteen thousand and less than twenty-five thousand inhabitants, and shall have fourteen councilors; of the third class, those containing ten thousand and less than eighteen thousand inhabitants, and shall have ten councilors; of the fourth class, those containing less than ten thousand inhabitants, and shall have eight.


SECTION 4. (a) Incorporated municipalities shall be of four classes, according to the number of inhabitants. Municipalities of the first class shall be those which contain not less than twenty-five thousand inhabitants, and shall have eighteen councilors; of the second class, those containing eighteen thousand and less than twenty-five thousand inhabitants, and shall have fourteen councilors; of the third class, those containing ten thousand and less than eighteen thousand inhabitants, and shall have ten councilors; of the fourth class, those containing less than ten thousand inhabitants, and shall have eight.

(b) Municipalities of less than two thousand inhabitants may be incorporated under the provisions of this Act, or may, upon petition signed by a majority of the qualified electors thereof, be attached as a barrio to an adjacent and incorporated municipality, if the council of the latter shall grant said petition.


(c) A barrio or barrios with an aggregate population of more than two thousand may be incorporated under the provisions of this Act as a separate municipality, upon the granting by the Commission of a petition signed by two-thirds of the qualified electors thereof.



(d) In case of controversy, the Commission shall determine to which class a town shall belong, and thereafter, if its population shall sufficiently increase or diminish, it shall pass to a higher or lower class by order of the provincial board.

SECTION 5. The municipality shall be divided into barrios, or wards, and the limits of such barrios shall be clearly defined, as hereinafter provided in section thirty-six. For administrative purposes, the barrios may be grouped into districts. The number of such districts in the municipality shall be equal to the number of councilors, including the vice-president.

SECTION 6. The electors charged with the duty of choosing elective municipal officers shall be male persons, twenty-three years of age or over, who have had a legal residence in the municipality in which they exercise the suffrage for a period of six months immediately preceding the election, and who are not citizens or subjects of any foreign power, and who are comprised within one of the following three classes:




(a) Those who, prior to the thirteenth of August, eighteen hundred and ninety-eight, held the office of municipal captain, gobernadorcillo, alcalde, lieutenant, cabeza de Barangay or member of any ayuntamiento.





(b) Those who own real property to the value of five hundred pesos, or who annually pay thirty pesos or more of the established taxes.

TRANSISYON SA SUSUNOD NA GAWAINKasabay ng mga batas ukol sa pagsasa – Pilipino ng gobyerno ay ilang

mga patakaran din ang inilabas ng mga Amerikano na sumupil sa damdaming nasyonalismo ng mga Pilipino. Sa mga susunod na Gawain ay muling magkakaroon ng pagsusuri ang mga mag – aaral sa ilang mga patakarang nakabalam sa pagkakamit ng ganap na kalayaan ng bansa at ang mga naging epekto nit sa aspetong pulitikal, ekonomiya at lipunan ng Pilipinas.

ANG PAGSUPIL NG NASYONALISMONG PILIPINO

Matapos matalakay ang mga batas at patakaran ng Pilipinisasyon, hingin ang mga hinuha ng mga mag – aaral sa kung ano ang naging kalagayan ng mga Pilipino sa panahon ng pamamalakad ng mga Amerikano sa aspetong pampulitika, pang – ekonomiya at panlipunan.


Matapos matalakay ang mga batas at patakaran ng Pilipinisasyon, hingin ang mga hinuha ng mga mag – aaral sa kung ano ang naging kalagayan ng mga Pilipino sa panahon ng pamamalakad ng mga Amerikano sa aspetong pampulitika, pang – ekonomiya at panlipunan.

Hatiin ang klase sa dalawang (2) pangkat. Bawat isa ay bigyan ng Task Card na naglalaman ng mga kinakailangang gampanin sa pagsasagawa ng gawain. Ibigay ang mga sipi sa bawat pangkat.


Pangkat 1 – Section 8 at 9 ng Batas Sedisyon na ipinasa noong Nobyembre 4, 1901

Sec. 8. Every person who shall utter seditious words or speeches,write, publish, or circulate, scurrilous libels against the Governmentof the United States or the Insular Government of the PhilippineIslands or which tend to disturb or obstruct any lawful officer in executing his office, or which tend to instigate others to cabal or meettogether for unlawful purposes, or which suggest or incite rebelliousconspiracies or riots or which tend to stir up the people against thelawful authorities or to disturb the peace of the community, the safetyand order of the Government, or who shall knowingly conceal suchevil practices, shall be punished by a fine not exceeding two thousanddollars or by imprisonment not exceeding two years, or both in thediscretion of the Court.

All persons who shall meet together for the purpose offorming, or who shall form any secret society or who shall after thepassage of this Act continue membership in a society already formedhaving for its object in whole or in part, the promotion of treason,insurrection or sedition, or the promulgation of any political opinion orpolicy, shall be punished by a fine not exceeding one thousand dollarsor by imprisonment not exceeding one year, or both.

REBELLION OR INSURRECTION AGAINST THE AUTHORITIES OF THE UNITED STATES AND THE

DISPLAY OF KATIPUNAN FLAGS, BANNERS, EMBLEMS, OR DEVICES AND FOR OTHER

PURPOSES


By authority of the United States be it enacted by the Philippine Commission that:

Section 1. Any person who shall expose or cause or permit to be exposed to public view on his own premises, or who shall expose or cause to be exposed to public view either on his own premises or elsewhere, any flag, banner, emblem, or device used during the late insurrection in the Philippine Islands to designate or identify those in armed rebellion against the United States, or any flag, banner, emblem, or device used or adopted at any time by the public enemies of the United States in the Philippine Islands for the purposes of public disorder or of rebellion or insurrection against the authority of the United States in the Philippine Islands, or any flag, banner, emblem, or device of the Katipunan Society or which is commonly known as such, shall be punished by a fine of not less than five hundred pesos nor more than five thousand pesos, or by imprisonment for not less than three months nor more than five years, or by both such fine and imprisonment, in the discretion of the court.


Sec. 2. Any person or persons having charge of any banquet, public entertainment, public meeting, or reunion, or any parade, procession, or review, who shall display or cause or permit to be displayed at such banquet, public entertainment, public meeting, or reunion, or in such parade, procession, or review, or who shall expose or cause to be exposed to public view any flag, banner, emblem, or device used during the late insurrection m the Philippine Islands to designate or identify those in armed rebellion against the United States, or any flag, banner, emblem, or device used or adopted at any, time by the public enemies of the United States in the Philippine Islands for the purposes of public disorder or of rebellion or insurrection against the authority of the United States in the Philippine Islands, or any flag, banner, emblem, or device of the Katipunan Society or which iscommonly known as such, shall be punished by a fine of not less than five hundred pesos nor more than five thousand pesos, or by imprisonment for not less than three months nor more than five years, or by both such fine and imprisonment, in the discretion of the court.


Sec. 3. It shall be unlawful tor any person to expose or cause or permit to be exposed to public view on his own premises, or to expose or cause to be exposed to public view either on his own premises or elsewhere, or to display or cause to be displayed at any banquet, public entertainment, meeting, or reunion, or in any parade, procession, or review, or for any person having charge of such banquet, public entertainment, meeting, or reunion, or of such parade, procession, or review, to permit to be displayed or exposed to public view, any flag, or banner the use or display of which is prohibited by executive order of the Governor-General. Any person who shall violate the provisions of this section shall be punished by a fine of not less thanfive hundred pesos nor more than five thousand pesos, or by imprisonment for not less than three months nor more than five years, or by both such fine and imprisonment, in the discretion of the court: Provided, however, That nothing in this section contained shall be construed to authorize the Governor-General to permit the use or display of any flag, banner, emblem, or device whose use, display, or exposition to public view is prohibited by the preceding sections of this Act.


Sec. 4. Any person who shall wear, use, or expose to public view in any parade, procession, or review, any uniform or dress or part thereof, adopted or used during the late insurrection in the Philippine Islands to designate or identify those in armed rebellion against the United States, or any uniform or dress or part thereof adopted or used at any time by the public enemies of the United States in the Philippine Islands for the purposes of public disorder or of rebellion or insurrection against the authority of the United States in the Philippine Islands, shall be punished by a fine of not less than five hundred pesos nor more than five thousand pesos, or by imprisonment for not less than three months nor more than five years, or by both such fine and imprisonment, in the discretion of the court.


Sec. 5. The public good requiring the speedy enactment of this bill, the passage of the same is hereby expedited m accordance with section two of “An Act prescribing the order of procedure by the Commission in the enactment of laws,” passed September twenty-sixth, nineteen hundred.
