Of the $185 million, $30 million came from Proposition 1B, the $19.9 billion transportation bond approved by voters in 2006. The remaining funds are a mixture of state and federal dollars. The new CTC allocation went to projects large and small. Contractors in California, one of the stateshardest hit by construction job losses, receivedgood news in February when the CaliforniaTransportation Commission (CTC) allocated$185 million to 43 transportation projects acrossthe state.

Of the $185 million, $30 million came fromProposition 1B, the $19.9 billion transportation

bond approved by voters in 2006. The remainingfunds are a mixture of state and federal dollars.

The new CTC allocation went to projects largeand small. Some of the largest include $69 mil-lion to repave and repair 100-lane mi. of Interstate680, which lies east of Oakland, and $26 millionto widen State Route 99 in San Joaquin andSacramento counties.

Subsidy Loophole Closure Creates 28 Percent ‘Tax Increase’The construction and agriculture

equipment manufacturer was notthe only company to notify theU.S. Securities and ExchangeCommission of its bookkeepingloss — as required by law. Fellowequipment-maker Caterpillarannounced a $100 million loss,characterizing the law’s pertinentprovision as a “tax increase.”

“Although this tax increase doesnot take effect until 2011,” thecompany’s SEC filing stated,“Caterpillar is required to recog-nize the full accounting impact inits financial statements in the peri-od in which the act is signed.”

Firms besides Deere andCaterpillar that have announcedthe impact of the law on their bot-tom lines include, among others,AT&T ($1 billion), Verizon ($970million), 3M ($80 million), AKSteel ($31 million) and ethanolrefinery owner Valero Energy ($20million).

The estimated total impact on

businesses is $4.5 billion, as calcu-lated by Congress. Private sectorestimates range as high as $14 bil-lion.

However, some companiesreport no immediate conse-quences. Terex Corp. spokesmanMichael Bazinet said the companyis still looking at the healthcare law“to gauge overall impact.However, with regard to theMedicare issue for retirees that isaffecting Cat and Deere, we willnot face this impact.”

A spokesman of VolvoConstruction Equipment NorthAmerica said that the company isnot apt to know for some time how

its “bottom line” will be affected. “We are currently still analyzing

the legislation and our experts areworking on evaluating the effects,”said Beatrice Cardon, vice presi-dent of corporate communication.

The ProvisionThe nature of the provision in

question is disputed. What

Caterpillar terms a “tax increase,”a White House spokesman saidjust “closes a loophole.”Essentially, both views are correct.

The provision changes the tax codeto eliminate a deduction, whichcauses some companies to havelower after-tax profits.

The “loophole” was createdknowingly by 2003 legislation thatadded a prescription drug benefitto Medicare. Because some com-panies already provided the drugbenefit to their employees,

Congress worried that those com-panies would simply drop theirplans and let the retirees move ontothe Medicare plan, thus upping thecost to taxpayers.

So a deal was struck: A 28 per-cent subsidy, which Washingtongave companies for continuing tooffer a drug benefit, would not becounted against the companies attax time. In other words, a compa-ny was allowed to ignore the sub-sidy in its tax calculations anddeduct 100 percent of funds spenton drug coverage. The new laweliminates that privilege, meaningthat a company can only deduct 72percent of its drug benefit expendi-tures at tax time.

Though the provision doesn’ttake effect till 2013, the SECrequires that such projectedchanges in liabilities and assets bereported as soon as changes areknown so investors have a clearpicture of a company’s worthgoing forward. On March 23,

In many applications, the screening process is the keyingredient in transforming a waste material product into ahighly sought after marketable material. Several styles ofportable screening plants are available, including shakerscreens, trommel screens, severe shake shaker screens,starscreens and box screens.

“Screening is simply the segregation of material by size,”said Rick Cohen, president of Screen USA Inc. located inSmyrna, Ga. “Although all screening plants are designed forthe purpose of segregating material, different screeningapplications demand different screening technologies.

Shaker Screens“Traditional shaker screens have been around for many

years and are commonly used in screening aggregates andtopsoil,” said Cohen. “The key to any screening plant is tohave a nice consistent feed rate, and the shaker screens areno exception to this rule. Consistent feed rates allow thematerial to be evenly spread across the shaker screen toachieve the highest efficiency in screening. Many sand andgravel screening customers add spray bars to rinse thegravel during the screening operation. However, it’s impor-tant to understand that the addition of spray bars will rinsethe rock, but not clean the sand. For optimal results, a finematerial washer [sand screw] should be used in conjunc-

tion with the portable shaker screen to yield a qualitywashed sand product.

“To manufacture a sand product to meet a certain specifi-cation, many may require the assistance of a classifier, whichwill segregate different sizes of sand and blend them backtogether. Before purchasing any equipment, my recommen-dation is to take a few samples and send them out for a fullsieve analysis. The results of the sieve analysis will dictatewhat additional screening accessories will be needed,”Cohen added.

Shaker screens also are widely used for screening topsoil.In clumpy soils, many manufacturers equip their screeningplants with high-speed shredders, which break up the clumpsbefore screening. This shredder is desirable when screeningclay-based soils, but is not needed in sandy, loam topsoil,according to Cohen.

Trommel ScreensTrommel screens vary greatly from the shaker screens and

utilize a spinning drum to screen material. “Although both trommel screens and shaker screens do an

excellent job of processing topsoil, trommel screens have adistinct advantage when screening topsoil contaminatedwith a great deal of organic debris. Trommel screens nor-mally have a considerably larger screening area and incor-porate a cleaning brush that assists in the screening of high-er moisture material. Trommel screens are also very popularin screening organic materials, such as ground wood, mulchand compost. As one might expect, these applicationsrequire a fine screen size such as 3/8 inch and this compli-cates the screening process. The small screen openingequates to needing more screen area for efficient screening,”Cohen said.

StarscreenersIn high moisture materials with moisture levels of 35 to 45

Cohen does not recommend starscreen-ers for material that is contaminated withtwine, banding wire or any other string likematerial.

Box ScreensOne of the more simplistic screening

products is the box screen, which is simply ashaker screen mounted on a portable chassis.Instead of having a feeder, a loader or exca-vator must “bucket sprinkle” material ontoto shaker screen. The screened materialeither falls through the screen onto theground or onto a built-on conveyor, with theoversized material falling directly off the endof the screening plant.

“These machines are excellent for coarsersizing, but are rated as fair to poor on preci-sion screening. Since the loader or excavatorbucket is being used as the feeder, it is diffi-cult to provide a consistent feed. As a result,the machine is either overfed or is processingnothing at all. Over the past 10 years, manybox screens have been introduced into thescreening market. Most are extremely lightduty, are marketed based on selling price,and work well for light duty screening work.However, for heavier applications, theselight duty screening products will not holdup,” Cohen said.

In these cases he recommended choosinga heavy-duty box screen. For still otherapplications, the industry has developed analternative called heavy-duty severe shakeshaker screens.

Severe Shake Shaker ScreensAs the name implies, heavy-duty severe

shake shaker screens are used in heavy-dutyapplications such as construction and demo-lition. Instead of just having a shaker screen,the machines are equipped with a stout feed-er, which utilizes a feeder belt with impactbeds or a steel apron feeder. This allows thematerial to be fed at a consistent feed rate toachieve the highest level of production pos-sible. Slabs of concrete, asphalt, quarrystone, etc. can be fed into these robustscreening plants and they will typicallyscreen into three fractions.

Many of these machines are track mount-ed allowing for complete mobility.

“Severe shake shaker screens areextremely efficient for log yard clean-up,screening root material and other toughapplications. Many customers who owncrushers purchase these screening plants asthey can either screen crushed material intothree sizes or use the same machine to scalpoff the heavier materials to minimize unnec-essary crushing,” Cohen said.

“In the most simplistic terms, once thespecific screening technology is determined,we must look at the size of the loader buck-et to select the proper sized screening plantto suit the customer’s product need,” addedCohen.

The military M400W skid steer and M400T com-pact track loader are equivalent in size and generalspecs to the construction/farm models 420 series 3skid steer loader and 420CT series 3 compact trackloader, respectively. The machines are modified tothe military’s special requirements.

Some of the modifications include: lifting and tie-down points for transport loading and securing,weapons rack and fire extinguisher, 24 volt startingand charging system to match all military vehicles,removable steel crawler tracks (M400W), a fuelinjection pump that enables the equipment to useNATO (North American Treaty Organization) jetfuel, NATO slave cable receptacle that allows themachine to provide an electric jump-start to othermilitary vehicles, ISO pattern joystick pilot controls,a minus 25 degree F cold start capability and a chem-ical agent resistant coating finish on all exteriorpainted surfaces.

Vehicle attachments are shipped with eachmachine in custom designed containers for securityand rapid deployment. These machines have beentested to withstand parachute drop-offs and verifiedradiated electronic emissions to confirm non-inter-ference with communications.

This Army contract ordered 3,400 units, all to bebuilt at the Wichita, Kan. location. The long-termcontract calls for as many as 1,900 skid steers andnearly 1,500 compact track loaders. The project is aboon to the Wichita plant, the local economy and hasallowed furloughed workers to be called back to theplant.

Firms Adjust Earnings Due to Reforms; Congress Bristlesaffected companies knew theirfinancial statements had changed.The SEC filings followed.

The reason the “loophole” wassigned into law in 2003 was toinduce companies to keep theirretirees in their own programsrather than dump them intoMedicare Part D. According tobenefits consultant companyTowers Watson, some 3,500 U.S.employers are eligible for the drugbenefit subsidy, with more than 6million retirees in company plans.

Towers Watson researchers con-cluded that the federal subsidycosts taxpayers less than $700 perretiree — about half what it wouldcost taxpayers were the retiree onthe Medicare drug plan. So taxingthe incentive provision will reducethe value of the subsidy — theincentive — about a third.

How many companies will droptheir drug plan now depends on avariety of considerations, includ-

ing the new law’s overall cost tothem. One study by a formerOffice of Management and Budgetofficial predicts as many as 2 mil-lion retirees will be shifted toMedicare.

“The 2003 legislation encour-aged companies to stay in thegame and continue to fund theirretirees’ prescriptions,” Deerespokesman Ken Golden said whenthe company announced its $150million charge against earnings.Neither Deere nor any other com-pany has announced how long itwill remain “in the game” now thatthe rules have been changed.

The ReactionThe company announcements

were not well received inWashington by advocates of thehealthcare law. In fact, Rep. HenryWaxman ordered chief executiveofficers of Deere and several othercompanies to testify before a hear-ing of his House Committee onEnergy and Commerce. They were

ordered to bring with them to theApril 21 hearing various companydocuments justifying their actions.

The summons was generally —though not universally — seen asan act of political intimidation. Itprobably surprised executives atCaterpillar and nine other compa-nies, including Verizon andBoeing, who had forewarnedHouse Speaker Nancy Pelosi andSenate Majority Leader Harry

Reid of the immediate conse-quence. In a December letter, thecompanies declared that passage ofthe bill would mean they wouldneed to “immediately account forthe present value of this taxincrease” by adjusting their earn-ings statement.

For his part, CongressmanWaxman said he only wants to getat the truth. In the letter to JamesW. Owens, CEO of Caterpillar,

Waxman said he wants to ensurethat the healthcare law “is imple-mented effectively and has nounintended consequences.”

Responding to Caterpillar’s“assertions” that the law wouldcost the company immediately andjeopardize the ability of the com-pany to continue its drug benefitplan for its retirees, Waxmanwrote, “The new law is designedto expand coverage and bringdown costs, so your assertions area matter of concern. They alsoappear to conflict with independentanalyses.” He cited someCongressional Budget Office(CBO) analysis to prove his point.

The CBO citation does notimpress David L. Kendall, profes-sor of economics and finance at theUniversity of Virginia at Wise.Kendall said he tells students in hisclasses to find one — one! —CBO forecast of the cost of a pro-gram that didn’t prove to be half of

Kenworth T440 Targets Vocational, Municipal MarketsKenworth Truck Company’s T440 model is available in

tractor and truck configurations for regional haul, city pick-up and delivery, municipal and vocational applications.

“Kenworth is aggressively expanding its product line tobring Kenworth’s World’s Best quality, performance anddurability to additional markets and customers in theUnited States and Canada,” said Gary Moore, Kenworthassistant general manager for marketing and sales.

“The new Kenworth T440 offers excellent value, pro-ductivity and aerodynamics to truck operators and fleets inheavy front-axle regionalhaul and pickup and deliv-ery applications. The Kenworth T440 isnow available for order withinitial production scheduledto begin first quarter 2010.

Built on the same plat-form as the T470 introducedin June, the Kenworth T440has a gross vehicle weight(GVW) ranging from aheavy Class 7 vehicle at33,000 lbs. (14,968 kg) upto a light Class 8 truck at68,000 lbs. (30,844 kg).

The 2010 PACCAR PX-8 engine, rated from 260 to350 hp (194 to 261 kW) and660 to 1,000 lb.-ft. oftorque, is standard equip-ment. The optional 9-L,

2010 Cummins ISL engine is rated from 345 to 380 hp(257 to 283 kW) and 1,150 to 1,300 lb.-ft. of torque.

Other key T440 features include 10-, 11-, and 13-speedmanual and 5- and 6-speed automatic transmissions; and12,000 to 22,000 lb. (5,443 to 9,979 kg) rated front axles,21,000 to 26,000 lb. (9,525 to 11,793 kg) rated single rearaxles, and 40,000 to 46,000 lb. (18,143 to 20,865 kg) ratedtandem rear axles.

The T440’s modern styling features an aerodynamicsloped hood, which gives the driver enhanced forward vis-

ibility. A three-piece aerodynamic bumper, Kenworth sig-nature grille, and forward lighting with Halogen projectorheadlamps are standard equipment. An aluminum or steelchannel bumper and high intensity discharge (HID) light-ing are available as options.

The Kenworth T440 offers the same, multiplexed dashinstalled in Kenworth’s Class 8 product line with a largepanel for convenient installation of body controls andgauges. The Kenworth driver information center is stan-dard in the T440. The optional Kenworth extended day cab

enhances driver comfortwith an additional 6 in. oflength and 5 in. of cabheight compared toKenworth’s traditional daycab.

The T440 can be orderedwith the air ride cab and a38-in. Kenworth AeroCabsleeper. Also available arefactory installation of apower take-off (PTO) andone lift axle.

PT-30 Trailer Offers Package for Hauling, Storing Attachments

TerexASV’s PT-30 trailer with attachments includes fivedifferent attachments set on a custom built trailer with aTerexASV PT-30 compact track loader. The standard pack-age includes a dirt bucket, pallet forks, land plane, trencher,and auger drive with 9, 18, and 24 in. (23, 46 and 61 cm) bits.Awide range of other performance-matched attachments areavailable to customize the package for specific applications.

Custom built for Terex, the 74-in. (188 cm) wide trailercan haul up to 9,980 lbs. (4,527 kg). With a deck length of

14 ft. (4.3 m) there is plenty of room for the PT-30 plusattachments. All the attachments are conveniently located onstandard mounts, and can be removed and replaced by oneperson. Other optional attachment holders can be added forextra storage space and transport. Loading and unloading thetrailer is facilitated by the low-angle ramps.

Kendall calls himself a citizen— rather than a Republican,Democrat or independent — andsaid, therefore, he isn’t being par-tisan in characterizing the health-care bill as “quite possibly themost hideous piece of legislationthis country has ever seen.”

The professor offers no opinionon the particular subsidy provisionthat suddenly has Caterpillar andDeere in hot water with somemembers of Congress, butexpresses total assurance that busi-ness and personal taxes inevitablywill increase.

“It absolutely is the case, with-out question, unequivocally, thatour taxes will have to go up forthis bill to be implemented. That isnot difficult at all to understand.Anyone who says otherwise is liv-ing in La La land.”

Veteran business and econom-ics editor Megan McArdle of TheAtlantic magazine finds a bit mys-tifying Waxman’s demand for cor-porate executives to testify.

“What AT&T, Caterpillar, et aldid was appropriate,” she wrote inher regular published column. “It’searnings season, and they offeredguidance about, um, their earn-ings. Obviously, Waxman isincensed because this seems to putthe lie to the promise that if youlike your current plan, nothing will

change. “But this was never true.

“At the very least,” she wrote,

“I think we can ask that they[members of Congress] refrainfrom trying to force companies tojoin them in denying reality bythreatening congressional investi-gation of any company who daresto notify investors that this thing isgoing to cost them money.”

Kendall suggested that the true

impact of the 2,700-page law can-not yet be known because most ofit will never survive the start-upprocess. The immediate write-downs aside, many of the bill’sparts simply are unworkable, hesaid.

“The bill that has been passedwon’t see the light of day. It will beamended before any provision ofit is put in place. The provisionshave absolutely no chance ofbeing implemented before beingput into effect.”

In the meantime, companies inand out of the construction indus-try are waiting to see what comesfrom the April 21 hearing beforethe House committee. How com-mittee members and businessexecutives communicate to oneanother at the microphones mightgive everyone an idea of what toexpect as the rest of the health carelaw rolls out for public examina-tion. Another session by compactioncompany Hamm focused on thetypes of compaction and the impor-

tance the proper compaction plays inthe quality of a completed project.Hamm recently completed a newtraining facility in Antioch, Tenn., tosupply customers with new knowl-edge and proper techniques for eco-nomical compaction and paving.

The Wirtgen Group covered prod-ucts used in the recycling of existingasphalt and included a session onrecycling binding agents, foamedbitumen, emulsion sprays, cementtreated base (CTB), roller compactedconcrete (RCC) and fly ash/lime.

VT LeeBoy’s seminar concentrat-ed on distribution of materials usingthe proper calibration of the distribu-tor trucks, economies of mixingproducts, testing, and the scheduledmaintenance of the equipment wasdiscussed in-depth.

Broce Broom’s closing sessionconcentrated on the attributes andefficiencies of the products used forrequired clean-up of paving projects.

Funds Allocated to SeismicallyUpgrade Elevated Structurescaused by winter storms. Others are maintenance projectsthat have been on the back burner for some time.

For instance, the CTC funds will allow the CaliforniaDepartment of Transportation (Caltrans) to rehabilitate ele-vated structures on Routes 80, 101 and 280, in the heart ofSan Francisco, to prevent failure of structural elements andclogging of the drainage system. This $9 million project con-sists of replacing the current drainage system, as well as jointseals and rocker bearing pads, and treating the bridge deckswith methacrylate.

“Nothing is wrong but we want to make sure that nothinghappens, to prevent any kind of structural failure,” saidStephen Williams, a public information officer for Caltrans

Many of the structures in the area were built more than 60years ago. Williams said: “It’s just necessary to seismicallyupgrade those, not only because seismic standards havechanged and we live in a seismically active area, [but alsobecause] after that amount of time, your infrastructure juststarts to get old.”

Williams estimates that construction on this project willbegin in 2011; it will be coming out to bid in May or June.Construction is expected to take approximately 2.5 years,which means a completion date in 2013 or later — more thanseven years after Caltrans first started looking at the project.

The project may have languished longer without CTC

funding.When asked about the importance of the new CTC allo-

cation, Williams replied: “Obviously we’re thrilled. And aslong as that keeps happening, the roadways will remain safe

and [our] people will be working and our contractors will beout there working.”
