CHÍNH PHỦ ________ Số: 122/2016/NĐ-CP CỘNG HOÀ XÃ HỘI CHỦ NGHĨA VIỆT NAM Độc lập - Tự do - Hạnh phúc ___________________________________ Hà Nội, ngày 01 tháng 9 năm 2016 NGHỊ ĐỊNH Biểu thuế xuất khẩu, Biểu thuế nhập khẩu ưu đãi, Danh mục hàng hóa và mức thuế tuyệt đối, thuế hỗn hợp, thuế nhập khẩu ngoài hạn ngạch thuế quan ______________ Căn cứ Luật tổ chức Chính phủ ngày 19 tháng 6 năm 2015; Căn cứ Luật thuế xuất khẩu, thuế nhập khẩu ngày 06 tháng 4 năm 2016; Căn cứ Nghị quyết số 71/2006/QH11 ngày 29 tháng 11 năm 2006 của Quốc hội phê chuẩn Nghị định thư gia nhập Hiệp định thành lập Tổ chức thương mại thế giới của nước Cộng hòa xã hội chủ nghĩa Việt Nam; Theo đề nghị của Bộ trưởng Bộ Tài chính; Chính phủ ban hành Nghị định Biểu thuế xuất khẩu, Biểu thuế nhập khẩu ưu đãi, Danh mục hàng hóa và mức thuế tuyệt đối, thuế hỗn hợp, thuế nhập khẩu ngoài hạn ngạch thuế quan. Điều 1. Phạm vi điều chỉnh Nghị định này ban hành Biểu thuế xuất khẩu, Biểu thuế nhập khẩu ưu đãi, Danh mục hàng hóa và mức thuế tuyệt đối, thuế hỗn hợp và thuế nhập khẩu ngoài hạn ngạch thuế quan. Điều 2. Đối tượng áp dụng 1. Người nộp thuế theo quy định của Luật thuế xuất khẩu, thuế nhập khẩu. 2. Cơ quan hải quan, công chức hải quan. 3. Tổ chức, cá nhân có quyền và nghĩa vụ liên quan đến hàng hoá xuất khẩu, nhập khẩu. Điều 3. Ban hành Biểu thuế xuất khẩu, Biểu thuế nhập khẩu theo danh mục chịu thuế, Danh mục hàng hóa và mức thuế tuyệt đối, thuế hỗn hợp, thuế nhập khẩu ngoài hạn ngạch thuế quan Ban hành kèm theo Nghị định này: 1. Phụ lục I - Biểu thuế xuất khẩu theo danh mục mặt hàng chịu thuế.

    Theo ngh ca B trng B Ti chnh;

    Chnh ph ban hnh Ngh nh Biu thu xut khu, Biu thu nhp khu u i, Danh mc hng ha v mc thu tuyt i, thu hn hp, thu nhp khu ngoi hn ngch thu quan.

    iu 1. Phm vi iu chnh

    Ngh nh ny ban hnh Biu thu xut khu, Biu thu nhp khu u i, Danh mc hng ha v mc thu tuyt i, thu hn hp v thu nhp khu ngoi hn ngch thu quan.

    iu 2. i tng p dng

    1. Ngi np thu theo quy nh ca Lut thu xut khu, thu nhp khu.

    2. C quan hi quan, cng chc hi quan.

    3. T chc, c nhn c quyn v ngha v lin quan n hng ho xut khu, nhp khu.

    iu 3. Ban hnh Biu thu xut khu, Biu thu nhp khu theo danh mc chu thu, Danh mc hng ha v mc thu tuyt i, thu hn hp, thu nhp khu ngoi hn ngch thu quan

    Ban hnh km theo Ngh nh ny:

    1. Ph lc I - Biu thu xut khu theo danh mc mt hng chu thu.

    2. Ph lc II - Biu thu nhp khu u i theo danh mc mt hng chu thu.

    3. Ph lc III - Danh mc hng ha v mc thu tuyt i, thu hn hp i vi mt hng xe t ch ngi t 15 ch ngi tr xung (k c li xe), qua s dng.

    4. Ph lc IV - Danh mc hng ha v mc thu sut thu nhp khu ngoi hn ngch thu quan i vi cc mt hng thuc din p dng hn ngch thu quan.

    iu 4. Biu thu xut khu theo danh mc mt hng chu thu

    1. Biu thu xut khu theo danh mc mt hng chu thu quy nh ti Ph lc I ban hnh km theo Ngh nh ny gm m hng, m t hng ho, mc thu sut thu xut khu quy nh cho tng nhm mt hng, mt hng chu thu xut khu.

    2. Mt hng than g rng trng thuc m hng 4402.90.90 p dng mc thu sut thu xut khu 5% quy nh ti Biu thu xut khu ban hnh km theo Ngh nh ny phi p ng cc tiu ch k thut nh sau:

    Tiu ch Yu cu Hm lng tro 3% Hm lng carbon c nh (C)-l carbon nguyn t, khng mi, khng khi khi tip la.

    3. Mt hng trang sc v cc b phn ri ca trang sc bng vng (thuc nhm hng 71.13), k ngh v cc b phn ri ca k ngh bng vng (thuc nhm hng 71.14) v cc sn phm khc bng vng (thuc nhm hng 71.15) c p dng mc thu sut thu xut khu 0% nu p ng cc iu kin sau y:

    a) Ngoi h s hi quan i vi hng ha xut khu theo quy nh chung, phi c Phiu kt qu th nghim xc nh hm lng vng di 95% do t chc th nghim c cp php xc nh hm lng vng trang sc, m ngh cp (xut trnh 01 bn chnh i chiu, np 01 bn chp cho c quan hi quan).

    b) Trng hp cc mt hng l trang sc v cc b phn ri ca trang sc bng vng (nhm hng 71.13), k ngh v cc b phn ri ca k ngh bng vng (nhm hng 71.14) v cc sn phm khc bng vng (nhm hng 71.15) xut khu theo hnh thc gia cng xut khu hoc c iu kin xc nh l c sn xut t ton b nguyn liu nhp khu, xut khu theo loi hnh sn xut xut khu th khi lm th tc hi quan thc hin theo quy nh hin hnh, khng phi xut trnh Phiu kt qu th nghim xc

    nh hm lng vng. i vi trng hp xut khu theo hnh thc sn xut xut khu th khi lm th tc hi quan, doanh nghip phi xut trnh giy php nhp khu vng nguyn liu ca ngn hng nh nc theo quy nh.

    4. Cc mt hng phn bn thuc cc nhm hng 31.01, 31.02, 31.03, 31.04, 31.05 p dng mc thu sut thu xut khu nh sau:

    a) Cc mt hng phn bn thuc cc nhm 31.01, 31.02, 31.03, 31.04, 31.05 m c gi tr ti nguyn, khong sn cng vi chi ph nng lng chim t 51% gi thnh sn phm tr ln p dng mc thu sut thu xut khu l 5%.

    b) Cc mt hng phn bn khng thuc trng hp nu ti im a khon ny p dng mc thu sut thu xut khu quy nh cho cc nhm 31.01, 31.02, 31.03, 31.04, 31.05 ti Biu thu xut khu quy nh ti Ph lc I ban hnh km theo Ngh nh ny.

    iu 5. Biu thu nhp khu u i theo danh mc mt hng chu thu

    Biu thu nhp khu u i theo danh mc mt hng chu thu quy nh ti Ph lc II bao gm:

    1. Mc I: Quy nh thu sut thu nhp khu u i p dng i vi 97 chng theo danh mc hng ha nhp khu Vit Nam. Ni dung gm tn cc Phn, Chng, Ch gii phn, ch gii chng; Danh mc biu thu nhp khu gm m t hng ho (tn nhm mt hng v tn mt hng), m hng (08 ch s), mc thu sut thu nhp khu u i quy nh cho mt hng chu thu.

    2. Mc II: Chng 98 - Quy nh m hng v mc thu sut thu nhp khu u i ring i vi mt s nhm mt hng, mt hng.

    a) Ch gii v iu kin, th tc p dng thu sut thu nhp khu u i ring ti Chng 98.

    - Ch gii chng: Cc mt hng c tn nu ti khon 1 phn I mc II Ph lc II ban hnh km theo Ngh nh ny c p dng mc thu sut thu nhp khu u i ring ti Chng 98.

    - Ch gii nhm:

    + Vic phn loi m hng ho v p dng mc thu sut thu nhp khu u i ring i vi mt hng CKD ca t, mt hng khung gm gn ng c, c bung li (t satxi, c bung li) c thc hin theo quy nh ti khon 2.1 phn I mc II ph lc II;

    + Cc mt hng: Giy kraft dng lm bao xi mng ty trng thuc nhm 98.07; Thp hp kim c cha nguyn t Bo v/hoc Crm v/hoc Titan thuc nhm 98.11; Cht lm y da, Kem h tr chc nng bo v da, gel lm gim so thuc nhm 98.25; Vi mnh nylong 1680/D/2 v 1890 D/2

    thuc nhm 98.26; Dy ng c kch thc mt ct ngang ti a trn 6 mm nhng khng qu 8 mm thuc nhm 98.30; Ht nha PolyPropylene dng nguyn sinh thuc nhm 98.37; Thp khng hp kim, dng thanh v dng cun cun khng u, c cn nng thuc nhm 98.39 c p dng mc thu sut thu nhp khu u i ring ti Chng 98 nu p ng cc tiu chun, thng s k thut quy nh c th ti khon 2.2, 2.3, 2.4, 2.5, 2.6, 2.7, 2.8 phn I mc II Ph lc II.

    - Cch thc phn loi, iu kin, th tc c p dng mc thu sut thu nhp khu u i ring ghi ti Chng 98, bo co kim tra vic s dng hng ha c p dng mc thu sut thu nhp khu u i ring ti Chng 98: Thc hin theo quy nh ti khon 3 phn I mc II Ph lc II.

    b) Danh mc nhm mt hng, mt hng v mc thu sut thu nhp khu u i ring gm: M hng ca nhm mt hng, mt hng thuc Chng 98; m t hng ho (tn nhm mt hng, mt hng); m hng tng ng ca nhm hng, mt hng ti mc I ph lc II (97 chng theo danh mc Biu thu nhp khu Vit Nam) v mc thu sut thu nhp khu u i p dng ring ti Chng 98 thc hin theo quy nh c th ti phn II mc II Ph lc II.

    c) Cc nhm mt hng, mt hng c tn v c thc hin mc thu sut thu nhp khu u i ring quy nh ti Chng 98 nu iu kin p dng thu sut thu nhp khu u i c bit theo quy nh hin hnh th c la chn p dng mc thu sut thu nhp khu u i c bit quy nh ti cc Biu thu nhp khu u i c bit hoc thu sut thu nhp khu u i ring quy nh ti Chng 98 ca Biu thu nhp khu u i.

    d) Khi lm th tc hi quan, ngi khai hi quan phi k khai m hng theo ct M hng tng ng ti Mc I Ph lc II nu ti Chng 98 v ghi ch m hng Chng 98 vo bn cnh.

    V d: Mt hng giy kraft dng lm bao xi mng, ty trng khi nhp khu, ngi khai hi quan k khai m hng l 4804.29.00 (9807.00.00), thu sut thu nhp khu u i ring l 3%.

    3. Mc III: Quy nh thu sut thu nhp khu u i i vi mt s mt hng thc hin cam kt WTO cho cc nm 2017, 2018 v t 2019 tr i.

    iu 6. Thu sut thu nhp khu u i i vi cc mt hng my gia cng c kh v ha du

    1. Cc mt hng my gia cng c kh thuc cc nhm hng t 84.54 n 84.63 p dng mc thu sut thu nhp khu u i nh sau:

    a) Cc mt hng my gia cng c kh trong nc cha sn xut c p dng mc thu sut thu nhp khu u i bng 0%. My gia cng c kh nu ti im ny l loi khng thuc Danh mc my mc, thit b trong nc sn xut c do B K hoch v u t quy nh.

    b) Cc mt hng my gia cng c kh khng thuc trng hp nu ti im a khon ny p dng mc thu sut thu nhp khu u i quy nh cho cc nhm t 84.54 n 84.63 ti Biu thu nhp khu quy nh ti Mc I Ph lc II ban hnh km theo Ngh nh ny.

    2. Cc mt hng ha du gm Benzen thuc m hng 2707.10.00 v m hng 2902.20.00; Xylen thuc m hng 2707.30.00, P-xylen thuc m hng 2902.43.00 v Polypropylen thuc m hng 3902.10.30 v m hng 3902.10.90 (khng bao gm mt hng Polypropylen dng nguyn sinh thuc nhm 98.37) p dng mc thu sut thu nhp khu u i theo l trnh nh sau:

    a) T ngy 01 thng 9 nm 2016 n ngy 31 thng 12 nm 2016: p dng mc thu sut thu nhp khu u i l 1%.

    b) T ngy 01 thng 01 nm 2017 tr i: p dng mc thu sut thu nhp khu u i l 3% theo quy nh ti Mc I Ph lc II ban hnh km theo Ngh nh ny.

    iu 7. Thu nhp khu i vi mt hng xe t qua s dng

    1. Xe t ch ngi t 09 ch ngi tr xung (k c li xe) c dung tch xi lanh di 1.500cc thuc nhm hng 87.03 v xe t ch ngi t 10 n 15 ch ngi (k c li xe) thuc nhm hng 87.02 p dng mc thu tuyt i quy nh ti Ph lc III ban hnh km theo Ngh nh ny.

    2. Xe t ch ngi t 09 ch ngi tr xung (k c li xe) c dung tch xi lanh t 1.500 cc tr ln thuc nhm hng 87.03 p dng mc thu hn hp quy nh ti Ph lc III ban hnh km theo Ngh nh ny.

    3. Xe t ch ngi t 16 ch ngi tr ln (k c li xe) thuc nhm hng 87.02 v xe vn ti hng ho c tng trng lng c ti khng qu 05 tn, thuc nhm hng 87.04 (tr xe ng lnh, xe thu gom ph thi c b phn nn ph thi, xe xi tc, xe bc thp ch hng ha c gi tr; xe ch xi mng kiu bn v xe ch bn c thng ri nng h c) p dng mc thu sut thu nhp khu u i l 150%.

    4. Cc loi xe t khc thuc cc nhm hng 87.02, 87.03, 87.04 p dng mc thu sut bng 1,5 ln so vi mc thu sut thu nhp khu u i ca xe t mi cng chng loi thuc cng nhm hng quy nh ti mc I Ph lc II ban hnh km theo Ngh nh ny.

    iu 8. Danh mc hng ha v mc thu sut thu nhp khu ngoi hn ngch thu quan i vi cc mt hng thuc din p dng hn ngch thu quan

    1. Danh mc hng ho thuc din p dng hn ngch thu quan gm mt s mt hng thuc cc nhm 04.07; 17.01; 24.01; 25.01 c quy nh ti Ph lc IV ban hnh km theo Ngh nh ny.

    2. Mc thu sut thu nhp khu ngoi hn ngch thu quan quy nh ti Ph lc IV ban hnh km theo Ngh nh ny.

    3. Lng hn ngch nhp khu hng nm ca cc hng ho nu ti khon 1 iu ny thc hin theo quy nh ca B Cng Thng.

    4. Hng ha nu ti khon 1 iu ny c s lng nhp khu nm ngoi s lng hn ngch nhp khu hng nm theo quy nh ca B Cng Thng p dng mc thu sut thu nhp khu ngoi hn ngch quy nh ti khon 2 iu ny.

    5. Trng hp theo cc Hip nh thng mi t do m Vit Nam k kt c cam kt thu sut thu nhp khu ngoi hn ngch (mc thu sut cam kt) i vi cc mt hng quy nh ti khon 1 iu ny v mc thu sut cam kt thp hn mc thu nhp khu ngoi hn ngch quy nh ti Ph lc IV ban hnh km theo Ngh inh ny th p dng theo mc thu sut cam kt (nu p ng cc iu kin c hng mc thu sut cam kt) theo Hip nh. Trng hp mc thu sut cam kt theo Hip nh cao hn mc thu sut thu nhp khu ngoi hn ngch quy nh ti Ph lc IV th p dng mc thu sut thu nhp khu ngoi hn ngch quy nh ti Ph lc IV.

    6. Hng ho nu ti khon 1 iu ny c s lng nhp khu nm trong s lng hn ngch nhp khu hng nm theo quy nh ca B Cng Thng p dng thu sut thu nhp khu u i quy nh ti mc I Ph lc II ban hnh km theo Ngh nh ny hoc p dng mc thu sut thu nhp khu u i c bit theo cc Biu thu nhp khu u i c bit (nu p ng cc iu kin c hng mc thu sut thu nhp khu u i c bit) ban hnh km theo cc Ngh nh ca Chnh ph thc hin cc Hip nh thng mi t do.

    iu 9. T chc thc hin

    1. Ngh nh ny c hiu lc thi hnh t ngy 01 thng 9 nm 2016.

    2. Ngh nh ny bi b:

    a) Quyt nh s 36/2011/Q-TTg ngy 29 thng 6 nm 2011 ca Th tng Chnh ph v vic ban hnh mc thu nhp khu i vi mt hng xe t ch ngi t 15 ch ngi tr xung (k c li xe) qua s dng;

    b) Quyt nh s 24/2013/Q-TTg ngy 03 thng 5 nm 2013 ca Th tng Chnh ph sa i, b sung khon 1 iu 1 Quyt nh s 36/2011/Q-TTg ngy 29 thng 6 nm 2011 v vic ban hnh mc thu nhp khu i vi mt hng xe t ch ngi t 15 ch ngi tr xung (k c li xe) qua s dng;

    c) Thng t s 111/2012/TT-BTC ngy 04 thng 7 nm 2012 ca B trng B Ti chnh ban hnh Danh mc hng ho v thu sut thu nhp khu p dng hn ngch thu quan;

    d) Thng t s 80/2014/TT-BTC ngy 23 thng 6 nm 2014 ca B trng B Ti chnh sa i, b sung Thng t s 111/2012/TT-BTC ngy 04 thng 7 nm 2012 ca B Ti chnh ban hnh Danh mc hng ho v thu sut thu nhp khu p dng hn ngch thu quan;

    ) Thng t s 182/2015/TT-BTC ngy 16 thng 11 nm 2015 ca B trng B Ti chnh ban hnh Biu thu xut khu, Biu thu nhp khu u i theo danh mc mt hng chu thu;

    e) Thng t s 05/2016/TT-BTC ngy 13 thng 01 nm 2016 ca B trng B Ti chnh sa i mc thu sut thu nhp khu u i i vi mt s hng ha mi trng trong APEC thuc nhm 84.19 v 84.21 ti Biu thu nhp khu u i;

    g) Thng t s 16/2016/TT-BTC ngy 21 thng 01 nm 2016 ca B trng B Ti chnh sa i mc thu sut thu nhp khu u i i vi mt s mt hng thuc nhm 27.07, 29.02, 39.02 ti Biu thu nhp khu u i;

    h) Thng t s 25/2016/TT-BTC ngy 16 thng 02 nm 2016 ca B trng B Ti chnh sa i mc thu sut thu nhp khu u i i vi mt hng Diamoni hydro orthophosphat (diamoni phosphat) thuc m hng 3105.30.00 ti Biu thu nhp khu u i;

    i) Thng t s 31/2016/TT-BTC ngy 23 thng 02 nm 2016 ca B trng B Ti chnh b sung mt hng Dung mi N-Hexan dng trong sn xut kh du u tng v du thc vt, cm go trch ly v du cm vo Chng 98 ca Biu thu nhp khu u i;

    k) Thng t s 48/2016/TT-BTC ngy 17 thng 3 nm 2016 ca B trng B Ti chnh sa i mc thu sut thu nhp khu u i i vi mt s mt hng xng, du thuc nhm 27.10 ti Biu thu nhp khu u i;

    l) Thng t s 51/2016/TT-BTC ngy 18 thng 3 nm 2016 ca B trng B Ti chnh sa i, b sung danh mc nhm mt hng v mc thu sut thu nhp khu u i ring i vi mt hng st hoc thp sn xut tanh lp xe thuc chng 98 ca Biu thu nhp khu u i ban hnh km theo Thng t s 182/2015/TT-BTC ngy 16 thng 11 nm 2015 ca B trng B Ti chnh;

    m) Thng t s 73/2016/TT-BTC ngy 20 thng 5 nm 2016 ca B trng B Ti chnh sa i, b sung mc thu sut thu xut khu i vi mt hng than lm t mn ca thuc nhm 44.02 ti Biu thu xut khu ban hnh km theo Thng t s 182/2015/TT-BTC ngy 16 thng 11 nm 2015 ca B trng B Ti chnh;

    n) Thng t s 98/2016/TT-BTC ngy 29 thng 6 nm 2016 ca B trng B Ti chnh b sung danh mc nhm mt hng v mc thu sut thu nhp khu u i ring i vi mt hng trng Artemia vo Chng 98 ca Biu thu nhp khu u i ban hnh km theo Thng t s 182/2015/TT-BTC ngy 16 thng 11 nm 2015 ca B trng B Ti chnh.

    3. B Cng Thng ch tr, phi hp vi cc b, ngnh lin quan cng b c th v quy nh phng thc iu hnh nhp khu i vi tng mt hng thuc din p dng hn ngch thu quan.
