PENDERFYNIAD / DECISION Mae’r Cabinet yn gytûn fod y drafft o’r Cynllun Adnau a gyflwynwyd yn symud i’r Pwyllgor Polisi Cynllunio ar y Cyd i’w ystyried cyn ei ryddhau ar gyfer ymgynghoriad cyhoeddus heb iddynt gynnig sylwadau penodol ar y cynnwys. The Cabinet is in agreement that the Draft Deposit Plan submitted is suitable to be discussed by the Joint Planning Policy Committee, before being released for public consultation, without their adding any further comment on its content .

Rhesymau dros y penderfyniad / Reason for the decision:- Mae’r Cynllun Adnau’n darparu fframwaith cynllunio defnydd tir cynaliadwy i hyrwyddo ac arwain gofynion economaidd, cymdeithasol ac amgylcheddol y ddau Awdurdod yn ystod y cyfnod o bymtheg mlynedd rhwng 2011 a 2026. Yn dilyn ei fabwysiadu (a ragwelir bydd yn digwydd yn Rhagfyr 2016), bydd y Cynllun yn cael ei ddefnyddio i arwain a rheoli datblygiad a buddsoddiad yn ardal y Cynllun, gan ddarparu sail ar gyfer gwneud penderfyniadau cyson a phriodol ar geisiadau cynllunio. Fe fydd yn disodli’r Cynllun Datblygu Unedol pan gaiff ei fabwysiadu. Pan fydd y Cynghorau yn ymgynghori ar y Cynllun Adnau, rhaid iddynt hysbysebu'r ymgynghoriad yn unol â Rheoliadau'r CDLl a hysbysu'r partïon hynny a nodwyd yn y Strategaeth Cyfranogiad Cyhoeddus (gan gynnwys ymgynghorai statudol), a chaniatáu chwech wythnos i wneud sylwadau. Anelir i gynnal yr ymgynghoriad cyhoeddus yn ystod mis Chwefror a Mawrth 2015. Bydd yr ymgynghoriad yn cynnwys cyfathrebu’n ysgrifenedig gyda'r holl unigolion a'r sefydliadau sydd wedi eu cynnwys yng nghronfa ddata’r CDLl ar y Cyd, gan osod copïau o'r Cynllun Adnau ar wefan y Cyngor ac yn y lleoliadau Adnau, a chyhoeddi datganiadau i'r wasg sy'n ymwneud a’r mater hwn. Yn ogystal, bwriedir darparu crynodeb o brif negeseuon y Cynllun a chynnal nifer o arddangosfeydd wedi’u staffio mewn lleoliadau strategol ar draws ardal y Cynllun. Bydd y broses yma yn rhoi cyfle eang i ymateb yn ffurfiol i gynnwys y Drafft Adnau. Bydd y rhai sy'n gwneud sylwadau ar y Cynllun Adnau yn cael eu hannog i wneud hynny ar ffurflen safonol, gan nodi'n glir unrhyw sylwadau cefnogol, wrthwynebus neu gyffredinol. Bydd hefyd yn ofynnol i wrthwynebwyr ddangos pa brawf (brofion) o gadernid y Cynllun yr ystyrir sy’n methu, a nodi pa newidiadau i'r Cynllun a ddymunir. Bydd y wybodaeth hon yn llywio ystyriaeth yr Arolygydd ynglŷn â chadernid y CDLl ar y Cyd, gan gynnwys y goblygiadau i'r arfarniad o gynaliadwyedd. Bydd fersiwn ryngweithiol ar-lein o'r ffurflen safonol ar gael i annog

cyflwyno unrhyw sylwadau ategol neu wrthwynebiadau’n uniongyrchol i'r gofrestr o sylwadau neu wrthwynebiadau. Ar ôl mabwysiadu’r CDLl ar y cyd, bydd yn cael ei fonitro’n flynyddol ac ar sail tystiolaeth gall ei flaenoriaethau gael eu haddasu. Mae cyfundrefn adolygu statudol yn bodoli ond cytunwyd y byddai budd mewn datblygu trefn arfer da o ymgynghori â Chynghorau Cymuned/Dinesig. The Deposit Plan provides a sustainable land use planning framework to promote and guide the economic, social and environmental requirements of both Authorities during the fifteen year period between 2011 and 2026. Following its adoption (which is anticipated to happen in December 2016), the Plan will be used to guide and manage development and investment in the Plan area, providing the basis for making consistent and appropriate decisions on planning applications. When adopted, it will replace the Unitary Development Plan. When the Councils will be consulting on the Deposit Plan, they must advertise the consultation in accordance with the LDP Regulations and notify those parties that are noted in the Public Participation Strategy (including statutory consultees), and allow six weeks to make observations. It is aimed to undertake the public consultation during February and March 2015. The consultation will involve written communication with all individuals and organisations that are included in the JLDP's database and displaying copies of the Deposit Plan on the Council's website and in the Deposit locations, as well as issuing press releases relating to this matter. It is also intended to provide a summary of the Plan's main messages and hold a number of staffed exhibitions in strategic locations across the Plan area. This process will offer a full range of opportunities to formally respond to the Draft Deposit Plan. Those making observations on the Deposit Plan will be encouraged to do so on a standard form, noting clearly any supporting, objecting or general observations. Objectors will also be required to demonstrate which test(s) of the Plan’s soundness they consider have failed, and to note the desired changes to the Plan. This information will guide the Inspector’s consideration with regard to the soundness of the JLDP including the implications for the sustainability appraisal. An online interactive version of the standard form will be available in order to encourage participants to submit any supporting observations or objections directly to the register of observations or objections. After adopting the JLDP, it will be monitored annually, and based on evidence its priorities may be amended. A statutory monitoring procedure is in place, but it was agreed to develop a good practice procedure of consulting with Community/Civic Councils.

The responsibility for agreeing the deposit draft LDP for publication rests with the Local Development Plan Joint Committee. This report provides has provided the Cabinet with an opportunity to comment on the draft for consideration by the Joint Committee. 3. PENDERFYNIAD / DECISION Cymeradwyo y rhaglen waith i gyfarch yr argymhellion yn adroddiadau Estyn, Arolygiaeth Gofal a Gwasanaethau Cymdeithasol Cymru a Swyddfa Archwilio Cymru. Approve the work programme to realise the recommendation in the reports by Estyn, Care and Social Services Inspectorate Wales, and the Wales Audit Office.

Rhesymau dros y penderfyniad / Reason for the decision:- Yn ystod y deunaw mis diwethaf cyhoeddwyd tri adroddiad yn dilyn archwiliadau oedd yn cynnwys sylw i faterion diogelu plant yng Nghyngor Gwynedd sef “Adroddiad ar ansawdd gwasanaethau addysg awdurdodau lleol i blant a phobl ifanc.” Estyn ( Arolygiaeth ei Mawrhydi dros Addysg a Hyfforddiant yng Nghymru ) a Swyddfa Archwilio Cymru ym Mawrth 2013 “Arolygiad Cenedlaethol Diogelu a Chynllunio Gofal ar gyfer plant sy’n derbyn gofal ac unigolion sy’n gadael gofal ,sy’n ymddwyn mewn ffordd sy’n eu gwneud yn agored i niwed neu a allai beri risg .” AGGCC ( Arolygiaeth Gofal a Gwasanaethau Cymdeithasol Cymru )yn Awst 2014 “Trefniadau Diogelu Plant Awdurdodau Lleol .” Swyddfa Archwilio Cymru yn Hydref 2014. Mae’r adroddiadau yn eu cyfanrwydd ar gael ar wefan y cyrff archwilio unigol neu drwy gysylltu a’r Gwasanaeth perthnasol. O ganlyniad i bob adroddiad, mae cyfres o gynigion neu argymhellion - rhai yn berthnasol i’r gwasanaethau arbennig ac eraill yn berthnasol ar lefel gorfforaethol. Mae argymhellion yn y tri adroddiad sy’n berthnasol i aelodau a staff y Cyngor yn gyffredinol. Mae argymhellion hefyd sy’n berthnasol i aelodau penodol megis cynrychiolwyr ar y Panel Rhiant Corfforaethol a chynrychiolwyr ar Bwyllgorau Craffu. Y bwriad yw pwysleisio’r angen i bawb ddeall a gwerthfawrogi eu cyfrifoldeb o ran diogelu plant a phobl ifanc ac yn arbennig mewn perthynas â phlant a phobl ifanc mewn gofal. Cymdeithasol neu’r Gwasanaeth Cefnogi Plant a Theuluoedd yn unig yw hyn. Mae holl argymhellion y tri adroddiad uchod wedi eu cyfuno i greu rhaglen waith ar gyfer Panel Strategol Diogelu’r Cyngor ar gyfer 2014/15. Cefnogir argymhelliad yr adroddiad gan y Cabinet oherwydd:

Yr angen i ddeall a gwerthfawrogi polisi a gweithdrefnau diogelu plant a phobl ifanc y Cyngor.

Yr angen am graffu a herio er mwyn sicrhau’r canlyniadau gorau i blant a phobl ifanc mewn gofal neu’n gadael gofal.

Yr angen i sicrhau fod perchnogaeth gorfforaethol o faterion diogelu a materion yn ymwneud a phlant mewn gofal neu’n gadael gofal.

Cytunwyd hefyd ar y canlynol:

Bod angen codi ymwybyddiaeth ymysg holl Aelodau’r Cyngor o gyfrifoldebau Rhiantu Corfforaethol.

Bod angen arweiniad pellach ar natur cyfrifoldebau y Cabinet am y maes

Bod angen ymchwilio ymhellach i arfer da ble mae cyfrifoldebau rhiantu a diogelwch plant yn gyfrifoldeb ar Aelodau etholedig.

During the past 18 months three reports have been published following inspections which included addressing the issues relating to safeguarding children in Gwynedd Council: “Report on the quality of local authority education services for children and young people.” Estyn (Her Majesty’s Inspectorate of Education and Training in Wales) and the Wales Audit Office in March 2013. “National Inspection of Safeguarding and Care Planning for looked after children and care leavers who exhibit vulnerable or risky behaviours.” CSSIW (Care and Social Services Inspectorate Wales) in August 2014 “Local Authorities’ Safeguarding Children Arrangements” Wales Audit Office in October 2014. The complete reports are available on the websites of the individual inspection bodies or by contacting the relevant Service. As a result of every report there is a series of proposals or recommendations – some relevant to the particular services and others relevant on a corporate level. There are recommendations in the three reports which are relevant for Council members and staff in general. There are also recommendations which are relevant to specific members such as members of the Corporate Parent Panel and members

of the Scrutiny Committees. The intention is to emphasise the need for everyone to understand and acknowledge their responsibility in terms of safeguarding children and young people and in particular in relation to looked after children and young people. A clear message from the inspections is that this is not a matter for Social Services or the Children and Family Support Service only. All the recommendations of the three reports above have been combined to create a work programme for the Council’s Strategic Safeguarding Panel for 2014/15. The report’s recommendation is approved by the Cabinet because of:

The need to understand and appreciate the Council’s policy and procedures on safeguarding children and young people

The need for scrutiny and challenge in order to secure the best results for looked after children and young people or care leavers

The need to ensure corporate ownership of safeguarding matters and matters involving looked after children or care leavers

The following was also agreed:

There is a need to raise awareness amongst all Council Members of Corporate Parenting responsibilities

There is a need for further guidance on the Cabinet’s responsibilities for the field

There is a need to further investigate good practice where responsibility for parenting and child safety is a responsibility of Elected Members.

Sylwadau neu bwyntiau croes / Observations or opposing views:- Derbyniwyd yr adroddiad a gyflwynwyd gan yr Aelod Cabinet Gofal, ond nodwyd bod angen amlygu nad diwedd y daith yw derbyn yr argymhellion a gyflwynir. Mae angen derbyn yr argymhellion adeiladol a gweithredu arnynt. Bydd angen rhoi mwy o ffocws i gyfrifoldebau Rhiantu Corfforaethol i’r dyfodol. The report submitted by the Care Cabinet Member was accepted, but it was noted that it must be highlighted that accepting the recommendations proposed did not mark the end of the journey. The constructive recommendations need to be accepted and acted upon. There will be a need to give more focus to Corporate Parenting responsibilities for the future

The findings of these audits are of paramount importance to ensure protection for the Council. It is good to have some recognition in the reports for the progress that has been made in the field but further progress must now get underway for further improvements. I support the recommendation. 2. Dim sylwadau pellach o safbwynt priodoldeb. Given the statutory requirements, regulators' expectations and Council’s priorities, the recommendations in this report are timely and appropriate. No further comments regarding propriety. 3. Prif Swyddog Cyllid / Chief Finance Officer:- Cadarnhaf fod yr adroddiad yma'n cydgasglu sawl argymhelliad a wnaed gan wahanol arolygwyr i mewn i un rhaglen waith ar gyfer diogelu plant, a deallaf fod adnoddau digonol mewn lle ar draws sawl adran er mwyn gweithredu'r rhain yn briodol. I confirm that this report aggregates several recommendations made by different inspectors into one work program for the protection of children, and I understand that adequate resources are in place across several departments to action these appropriately.

Rhesymau dros y penderfyniad / Reason for the decision:- Fel rhan o Strategaeth Ariannol y Cyngor rydym yn taflunio bwlch ariannol tybiedig o tua £50m dros y pedair blynedd 2014/15 - 2017/18. Gyda chynnydd tybiedig o 3.5% yn y Dreth Gyngor ac arbedion sydd eisoes ar y gweill, byddai hyn yn gadael tua £34m o arbedion pellach i’w ddarganfod. Gan gofio mai arbedion effeithlonrwydd yr ydym yn sôn amdanynt yma fe ddylai’r effaith ar ganlyniadau i drigolion fod yn llai na’r hyn y byddwn yn ei weld mewn unrhyw gyfundrefn toriadau. ‘Roedd rhai o’r cynlluniau a gyflwynwyd yn yr adroddiad angen dod i gasgliad ynglŷn a beth yn union oedd y cynnig manwl ac ‘roeddent wedi eu lliwio yn Atodiad 2. Fel rhan o’r broses adnabod arbedion effeithlonrwydd, sefydlwyd Gweithgor Craffu o blith Aelodau Pwyllgorau Craffu, Pwyllgor Gwasanaethau Democrataidd a’r Pwyllgor Archwilio. Fe gynhaliwyd Gweithdy i holl Aelodau’r Cyngor ar yr 8fed a’r 13eg o Hydref 2014 ble roedd cyfle i aelodau gyflwyno sylwadau a / neu bryderon am y cynigion i’r Gweithgor Craffu eu hystyried. Fe fynychodd 35 o aelodau. Roedd hyn yn caniatáu i’r gweithgor fod yn gynhwysol yn eu rôl gyda’u cyd-aelodau i graffu effaith y cynigion. Yn ogystal, ar gyfer yr aelodau na fu’n bosib mynychu, fe yrrwyd pecyn atynt hwythau gyda chyfle i godi sylwadau a / neu bryderon. Yn ei dro, bu i’r Gweithgor Craffu roi sylw i’r holl sylwadau a gasglwyd o’r gweithdai a gynhaliwyd i’r aelodau gan ystyried goblygiadau gweithredu’r cynigion ac amlygu unrhyw ystyriaethau o ran effaith a oedd angen dwyn i sylw’r Cabinet. Nodwyd fod y Pwyllgor Craffu Gwasanaethau eisoes wedi craffu cynlluniau OED 13 ; P6 a P7 ac ystyriwyd canlyniadau’r craffu manwl wrth ddod i benderfyniad. Nododd yr aelod cabinet ei fod yn cytuno gydag argymhellion y Pwyllgor Craffu Corfforaethol ac yn awyddus i’w hargymhellion gael eu dilyn. As part of the Council’s Financial Strategy a funding deficit of around £50m is projected over the four year period 2014/15 – 2017/18. With an assumed Council Tax increase of 3.5% and savings that are already being implemented, this would leave around £34m of further savings to be found. Bearing in mind that efficiency savings is what is under consideration here, the effect on results for citizens should be less than that we would see in any cuts regime. Some of the proposals submitted in the report needed to come to a conclusion as to what exactly was the detailed proposal, and they had been highlighted in Appendix 2. As part of the process of identifying efficiency savings, a Scrutiny Working Group was established from amongst members of the Scrutiny Committees, the Democratic Services Committee and the Audit Committee. A Workshop was held for all Members of the Council on 8 and 13 October 2014 where members had an opportunity to submit ideas and/or concerns regarding the proposals for the Scrutiny Working Group to consider. 35 members had attended. This enabled the working group to be inclusive in their role with their fellow members to scrutinise the effect of the proposals. In addition, for members who had been unable to attend, a pack was sent to them so that they also had the opportunity to make observations and/or raise concerns. The Working Group addressed all the observations that had been gathered during the workshops held for the members and considered the implications of implementing the proposals and highlighted any considerations in terms of effect that needed to be brought to the Cabinet’s attention. The Working Group’s conclusions were reported to the Corporate Scrutiny Committee on 13 November and a summary of the Committee’s recommendations for consideration by the Cabinet is given in Appendix 1 of the report submitted. It was noted that the Services Scrutiny Committee had already scrutinised schemes OED 13; P6 and P7 and the results of the detailed scrutiny were considered in reaching a decision. The Cabinet Member noted that he agreed with the recommendations of the Corporate Scrutiny Committee and was eager for the recommendations to be followed.

proposals have been the subject of Equality Impact Assessment (Schedule 3) and members are specifically referred to the context when considering the proposals. 3. Although there have been several recent developments, I confirm that the financial gap to be closed over the period of this year and 2017/18 will continue to be around £34m, in line with the strategy discussed in September. We must continue with the efficiency savings strategy without delay, and maximize the amount available from the plans for 2015/16 in order to minimize the significant balance required by cutting services.
