Welcome to the second edition of the Guide to Leading Practitioners: China, the international legal market’s leading guide to the top practitionersadvising on China-related matters, across ten practice areas:
Over the past decade, China’s emergence as a global leader has created an increased demand for practitioners with expertise in Chinese laws andcustoms. Based on independent research, this book is a one-stop reference guide for in-house counsel with interests in both in-bound and out-bound Chinese legal activity. Our team of researchers, based in London, Hong Kong and New York, interviewed attorneys at top firms aroundthe world and the in-house counsel who have utilized their services. The result is a reliable resource which identifies the top practitioners in China– both at domestic and international firms - as well as experts around the world who are familiar with Chinese law and customs.
Once seen as a target for direct investment, China’s economic boom has resulted in widespread Chinese investment in other economies. Theresulting conflicts over intellectual property issues, particularly between Chinese and US companies, have provided prosperous opportunities fortrademark and patent practitioners. The entry of many Chinese interests into the United States through well-publicized reverse mergers has alsocreated a market for US firms assisting Chinese companies with M&A, competition and antitrust cases. As Chinese businesses start to expandinto Canada and Latin America, similar opportunities are beginning to open up for corporate lawyers in those jurisdictions.
As the world’s most populous country, natural resources are a major concern for China, particularly in view of the country’s recent economicexpansion. Minerals and energy are particularly popular targets of Chinese investment, with Chinese interests investing heavily in resources inCanada. Firms reported increased activity in the oil sands, shale gas, and mining industries. China has increased its natural resource holdings inBrazil, Argentina, and Africa and, in an effort to preserve its future energy options, China has also started buying green technology patents fromUS companies.
In response to the increase in Chinese-related legal work, many international firms have taken the logical step of establishing offices in the countryto assist with both in-bound FDI, and out-bound work for Chinese interests. Those which have report smoother transactions and closerrelationships with clients as a result of their presence in the jurisdiction. Several Chinese firms have also opened offices in the US, with Jun HeLaw Firm and King & Wood Mallesons leading the way.
We have compiled a list of specialists in 22 jurisdictions for this guide. These specialists have been offered the opportunity to enhance their listingwith a professional biography. Manuel Maisog is a partner in the Beijing office of Hunton &Williams. He has had significant roles in prominent energytransactions, both in China and around the Asia-Pacific region.
As representative examples, in China, Manuel represented alarge Southeast Asia-based multinational in its acquisition ofinterests in two coal mining joint ventures in Shanxi, and in itsacquisition of a portfolio of foreign-invested enterprisesoperating power- and steam-generating assets around NortheastChina. He also represented project sponsors in the negotiationand drafting of turnkey construction contracts for electricitygeneration facilities in Taiwan.
Elsewhere in the Asia-Pacific region, Manuel represented theacquiror in the privatisation of the largest and most advancedelectricity generating facility in Thailand, and participated instructuring and drafting the concession agreements for theprivatisation of the national electricity transmission system inthe Philippines. He also participated in the negotiation of a long-term coal supply agreement for an electricity generating facilityin Mindanao, and in the negotiation of the proposed acquisitionof a hydroelectric facility in Laos.
In addition to his work in the energy sector, Manuel’s practiceinvolves data privacy, mergers and acquisitions, and foreigndirect investment. He earned an undergraduate degree atPrinceton University, and studied law at Harvard Law Schooland Chinese at the Stanford Center in Taiwan.

Zhengning Li graduated from China Foreign Affairs Universitywith LLB and LLM degrees, majoring in International BusinessLaw, and was called to the Bar in 2003. He is now a member ofthe Chinese Society of International Law.
He specialises in cross-border investment, M&A, project financeand pre-IPO finance. He has advised many international anddomestic clients in their investment, construction, restructuring,financing and general corporate matters in industries includingenergy, mining and resource, infrastructure, renewable,pharmaceutical, health and medical, publication, internet,media, entertainment, sports and travel. His clients include listedcompanies and mid-sized private companies, venture capital andprivate equity, entertainment companies with IP as core assetsand power plants with heavy fixed assets, as well as financinginstitutions and giant corporate groups.
Zhengning has deep understanding of PRC laws and policies,sharp thinking and quick response. He is good at designingappropriate deal structures for projects with different purposes.His proposals in deadlock during negotiations and transactionsalways gain him a good reputation from both clients andcounterparties.
He is a member of the Chinese Society of International Law, adelegate of the Culture, Sports and Travel Commission of theBeijing Lawyers’ Association, and a member of the Olympic andSports Committee of the Beijing Law Academy. He is also activein legislative activities of China.
Zhengning was named as a Beijing Leading Youth Lawyer byBeijing Lawyers’ Association for the years 2009-2011. He isfluent in Mandarin and English.

David Yu is a founding partner of Llinks. He earned his LLB fromFudan University School of Law. He is acting as co-head of theInternet & High-Tech Committee (All China Bar Association) andhead of the M&A and Restructuring Committee (Shanghai BarAssociation). He is a member of the International CooperationCommittee (Shanghai Bar Association), co-head of the PudongLawyer Delegation (2011-2013) and a member of Legal ConsultingBoard of Shanghai Pudong Government.
David specialises in corporate/mergers and acquisitions,capital markets, private equity/venture capital, andrestructuring/insolvency.
He possesses in-depth legal knowledge and practicalexperience in automobile, infrastructure and real estate,technology/media/telecoms (TMT), energy and naturalresources, healthcare and pharmaceutical, consumer productsand logistics, and has been involved in many groundbreakingtransactions in these areas.
David has represented a large number of multinational companies,financial investment institutions, large-scale Chinese conglomeratesand listed companies, with practices involving cross-borderinvestment, mergers and acquisitions, corporate finance,restructuring and insolvency, tax planning, IPO, bond issuing, andsecuritisation. He has also represented a number of private equityhouses and venture capitalists in their fund formation, fund raisingand investment projects.

Handong Rang holds a BSc degree in Electrical Engineeringfrom Zhejiang University, China and two MSc degrees inElectronics Engineering and Management of IntellectualProperty from Queen Mary, University of London.
Handong joined Jenkins in 2006 and qualified as a CharteredUK Patent Attorney and a European Patent Attorney. Beforejoining the firm, he worked as an IT analyst at a blue chip IT firmin China and as a research assistant in a medical research lab inthe UK for several years.
While at Jenkins, Handong has prosecuted a large number ofpatent applications at the UK Patent Office and the EuropeanPatent Office, most of which are in the fields oftelecommunications, computer hardware, software andelectronics. He has handled many opposition matters, bothdefensive and offensive, at the EPO and attended hearings infront of the Examining Division, the Opposition Division andthe Board of Appeal at the EPO.
Handong moved back to China in 2012 to set up a representativeoffice for Jenkins in Beijing, which he now mans. He has spokenat several IP conferences and seminars in China and givenChinese enterprises training on European patent practice.
Handong is fluent in Mandarin and English and has a goodunderstanding of Japanese.

Jay Hayden is associate counsel in the Hong Kong office ofMcMillan. His practice is focused on corporate and commercialtransactions including mergers and acquisitions and financingtransactions (including asset-based lending, corporate andcommercial lending, project finance and structured finance),mining projects and renewable energy projects. He representslenders, technology companies, renewable energy companies, cleantech companies, oil and gas companies and mining companies.
A member of the British Columbia, Alberta and Ontario lawsocieties, Jay has practised with national law firms for 25 years inVancouver, Toronto, and Calgary. Most recently, he wasresponsible for the Singapore office of another Canadiannational law firm.
He has acted for most of the large Canadian banks on financingtransactions. He has also acted for public and privatecorporations including private equity and venture capital firms,oil and gas companies, manufacturing companies, and cable andtechnology companies. His financing experience includes largesyndicated credit facilities, real estate, and secured lendingtransactions. While in Calgary, he gained offshore oil and gasexperience having been involved with the Terra Nova, Hiberniaand White Rose offshore oil and gas projects.
Some of Jay’s recent transactions have included acquisitions byChinese companies, US public companies, the acquisition andfinancing of renewable energy projects, financings for clean techcompanies, derivatives/swap agreements and asset basedfinancings. He was lead counsel for Electronic Arts on its $750million acquisition of a Canadian gaming software company,lead counsel on the acquisition and financing of wind farm assetsand lenders counsel on a number of secured and unsecuredfinancings for public companies in the power, oil and gas,engineering, technology, manufacturing industries andrenewable energy sectors.
Jay has also been active in the philanthropic community. Heserves as president of a private foundation which supports avariety of charitable organisations including those devoted toeducation and medical research.

Catherine Pawluch is a partner in the Toronto office of Davis and amember of the firm’s China practice. For more than 25 years, shehas provided government and regulatory advice to Chinese,Japanese, US and other foreign companies seeking to establish orconduct business in Canada. Catherine has extensive experience in pre-merger approvals,foreign investment review and competition law. She made a presentation on Canada’snew foreign investment law at the ‘Invest in Canada’ seminar.
In January 2008, she travelled to Beijing and presented a briefing onCanada’s state-owned enterprises guidelines to various ChineseSOEs targeting investments in Canada.
She is intimately familiar with the Canadian regulatory regimesgoverning every aspect of the international supply chain, includingborder crossing security programmes and the customs clearanceprocess, import and export controls, as well as the transport,warehousing and distribution of products. Her hands-onexperience in regulatory laws benefits foreign companies seeking toimport, market and sell products in the Canadian marketplace.
Following the implementation of NAFTA, Catherine was invitedas an expert to participate on a tri-national committee tasked withcreating a harmonised uniform bill of lading for surfacetransportation in the NAFTA region. She was named in theLexpert/American Lawyer Guide to the Leading 500 Lawyers inCanada.
As an active member of the Chinese communities in Canada,Catherine has been appointed to the board of directors of theCanada China Lawyers Foundation and serves on the board ofdirectors of The Canadian Foundation for Chinese HeritagePreservation.

Thomas A Doyle serves as chair of Baker & McKenzie’s NorthAmerican China initiative, and heads a team of US-based andChina-based litigators who jointly represent Chinese clients inUS litigation matters. He represents leading Chinese companiesin matters that have ranged from antitrust claims against mobiledevice makers to ownership claims regarding LNG interests inSoutheast Asia. He has represented Chinese companies in theauto, oil and gas, heavy manufacturing, high tech, and cleanenergy fields. His cases have been in state and federal courtsacross the United States, as well as before arbitration bodies suchas the ICC and the Stockholm Chamber of Commerce. Jean Jacques Ah Choon is a partner in Schellenberg Wittmer'sGeneva office, where he heads the mergers and acquisitionsgroup. Oliver Triebold is a partner and a member of SchellenbergWittmer's mergers and acquisitions group in Zurich. Oliver Triebold graduated from the University of Basel with aDoctor of Law degree (Dr iur summa cum laude), was admittedto the Swiss Bar in 1994 and earned a Master of ComparativeJurisprudence (MCJ) from New York University School of Lawin 1996. He was admitted to the New York Bar in 1997.
He joined Schellenberg Wittmer in late 1997, became a partnerin 2003 and acted as the firm's managing partner from 2007 to2009. He previously worked as a foreign associate with aninternational law firm in New York and as a research andteaching assistant at the University of Basel. He serves as seniorvice-chairman of the International Bar Association's Corporateand M&A Law Committee and as one of the firm's two partnersresponsible for China.

Thomas T Moga is a patent attorney with the Washington, DCoffice of Shook Hardy & Bacon LLP, where he focuses on patentpreparation and prosecution. His primary experience is indevelopment and enforcement of domestic and foreign patentportfolios and in the extension of those portfolios in China. Heis an established patent prosecutor with experience in a widerange of technologies, including the mechanical, chemical, andpharmaceutical arts. Mr Moga has prepared and prosecutedhundreds of patent applications before the US Patent &Trademark Office with many of those cases being extended toChina for secondary filing.
Mr Moga has lived, worked and taught in China for over threeyears. He spent part of 1997 as a Fulbright scholar in thatcountry, where he taught patent law at Jilin University and actedas a foreign advisor to China's State Intellectual Property Office.During his time with SIPO he assisted in the training of Chinesepatent examiners. In 1990, Mr Moga was a visiting foreignexpert in law at Xiamen University, China.
Mr Moga's close relationship with the State IntellectualProperty Office continues to this day. Last year, he was theEnglish-language reviewer of SIPO's annual report, a role hefilled a number of years before. Mr Moga works closely in Chinawith a former deputy commissioner of the Chinese StateIntellectual Property Office, now in private practice, in thepreparation, prosecution and enforcement of Chinese patentapplications. He frequently interviews examiners at SIPOduring the prosecution of patent applications.
An author of several articles on Chinese patent law and practice,Mr. Moga has most recently had articles of his published in theChina Business Review. One of these articles discusses the 2009amendment to Chinese patent law and the other deals withlicensing in China. Currently, he is under contract with the USChamber of Commerce to prepare a report on utility model lawand practice in China. Mr Moga is the author of a multi-volumetreatise on patent law in Asia.
