    of the 5th Meeting of the Delegations of Ukraine and the Russian Federation to Determine the Legal Status of the Sea of Azov and the

    Kerch Strait and to Delimit the Maritime Spaces in the Black Sea On March 26, 1999, Moscow hosted the 5th Meeting of the Delegations of Ukraine and the Russian Federation to Determine the Legal Status of the Sea of Azov and the Kerch Strait and to Delimit the Maritime Spaces in the Black Sea (the lists of delegation members are enclosed).

    Meeting agenda:

    1. Approval of the draft agreements between Ukraine and the RussianFederation on the legal status of the Sea of Azov and on navigation in itswaters and on the legal status of the Kerch Strait.

    2. Regarding navigation in the Kerch Strait.

    3. Regarding preparations for the signing of the draft agreement betweenUkraine and the Russian Federation on delimitation of the continental shelf andthe exclusive (maritime) economic zones in the Black Sea.

    4. Regarding the basic principles of cooperation between Ukraine and theRussian Federation in the Sea of Azov and Black Sea region.

    5. Miscellaneous.

    Regarding item one:

    a) The parties reaffirmed their readiness to continue the negotiation processwith a view to approving the draft agreement between Ukraine and the RussianFederation on the legal status of the Sea of Azov and on navigation in itswaters, proceeding from the premise that the Sea of Azov will retain status asinternal waters of Ukraine and the Russian Federation.

    The Russian side proposed (alongside continued consultations to approve the draft agreement between Ukraine and the Russian Federation on the legal status of the Sea of Azov and on navigation in its waters) looking into the matter of legal formalization of this status via an exchange of notes, which would constitute an agreement between the parties confirming the status of the Sea of Azov as internal waters of the two states, of which the UN Secretariat would be subsequently notified.

    The Ukrainian side will examine this proposal and present its response in the prescribed manner.

    The Russian side has reaffirmed its position on (what it believes to be) the key second provision dealing with the status of the Sea of Azov, specifically the need to avoid the kind of delimitation in its waters, which would cause the Sea of Azov to be granted status as international waters. The parties confirmed their interest in continued elaboration of the proposal previously put forward by the Russian side to define functional zones of responsibility and jurisdiction of the parties in the Sea of Azov.

    The Ukrainian side believes that delimitation of the state border in the Sea of Azov would not change the status of internal waters. The Ukrainian side believes that the undefined boundaries of sovereign rights of Ukraine and the Russian Federation in the Sea of Azov hurt the economy of both Ukraine and the Russian Federation and adversely affect the wellbeing of the people of both states.

    The Ukrainian side is in turn prepared to elaborate specific proposals regarding the definition of functional zones of responsibility.

    b) The Russian side reaffirmed its position to the effect that the status ofinternal waters of Ukraine and the Russian Federation should be extended tothe Kerch Strait, proceeding from the uninterrupted geographic, natural, andeconomic unity of the Azov-Kerch waters and the vital interests of the twostates in this region. The parties outlined an approach toward joint use of thestrait in terms of management of vessel traffic and other commercial activitythrough regulation of organizational, engineering, financial, and economicconditions by separate agreements, as well as creation of an administrative orother joint body for managing vessel traffic and the use of fairways.

    The Ukrainian side pointed out the fact that the line of the Ukrainian-Russian state border in the Kerch Strait was drawn back in the times of the Soviet Union and—according to provisions of international law, effective Ukrainian-Russian treaties and agreements, and national laws of Ukraine—is the line of the state border between two sovereign states: Ukraine and the Russian Federation.

    Proceeding from the principle of legal succession of the states with respect to the territory and considering the affirmation of the status of the state border by bilateral interstate agreements, the Ukrainian side reaffirmed its position regarding the need to enter into an agreement on the legal status of the Kerch Strait.

    Regarding item two:

    The Russian side spoke in favor of bringing order to various aspects of navigation in the Kerch Strait in conjunction with and in the context of the legal status of the strait, which shall be formulated according to the principles of equitable and mutually advantageous cooperation, and fair regulation of rights and liability.

    The Ukrainian side yet again directed attention of the Russian side to the fact that the ports of Kavkaz and Temryuk (Russian Federation) unlawfully declared Fairways Nos. 50 and 52 (which, in the opinion of the Ukrainian side, are located in the waters of Ukraine) to be part of the waters of these ports.

    Simultaneously with efforts to define the legal status of the Kerch Strait, the parties have also agreed to step up cooperation in the matter of approving the navigation practices in the strait at the level of the relevant maritime and other services of the two states and port authorities in the Kerch Strait region.

    Regarding item three:

    The parties expressed readiness to expedite efforts aimed at practical approval of the draft agreement on the delimitation of the territorial sea, continental shelf and the exclusive (marine) economic zones of Ukraine and the Russian Federation in the Black Sea, and to this end have agreed to form expert work groups of the parties.

    The Ukrainian side made a preliminary proposal to hold a meeting of expert work groups in mid-April 1999 in Kyiv.

    Regarding item four:

    Simultaneously with ongoing efforts to approve the above-mentioned draft agreements, the Russian side proposed returning to the review of the Draft Integrated Program of Cooperation between the Russian Federation and Ukraine in the Azov-Kerch Region proposed by the Russian side during the third round of delegation meetings in April 1998. The Russian side expressed readiness to supplement this draft with provisions on cooperation in the Black Sea region and consider the relevant proposals of the Ukrainian side.

    The position of the Ukrainian side on this issue is expressed in the Minutes of the 4th Meeting of the Delegations of Ukraine and the Russian Federation (September 23, 1998, Kyiv). In particular, the Ukrainian side has denounced the Russian draft of the Integrated Program of Cooperation between the Russian Federation and Ukraine in the Azov-Kerch Region as being unacceptable and in contravention of the national interests of Ukraine.

    The next meeting of the delegations of Ukraine and the Russian Federation to determine the legal status of the Sea of Azov and the Kerch Strait and to delimit the maritime spaces in the Black Sea will take place in the second half of May 1999 in Ukrainian territory.
