2. Definitions

In this proclamation, unless the context otherwiserequires:1) "Constitution" means the constitution of the

FederalDemocraticRepublicof Ethiopia;2) "House" means the House of Peoples' Represen-

tativesestablishedin accordancewith Article53 ofthe.Constitution.

3) "Committee"meansStanding,Ad hoc...Committeeestablished by the House .to undertake a certainactivitywhenevernecessary; ';' .

4) "StandingCommittee"means a body set up by theHouse to enhance the duty of the House within theboundary ()f the powers and functions given to itunder thisproclamation;

5) "Ad hoc Committee" means a body established bythe House whenever it feels there is an urgentsituation and where deemed necessary to carry outactivities that may not be directly undertaken byother Committees;

6)' "Sub Committee"meansa Committeesetup by anyof the Committees of the House from among itsmembers with a view to act upon its work effec-tivley;

7) "Standing Sub Committee" means a Commmitteeset up by the House to act as a supporting bodywheneverthe StandingCommitteeis under a heavyworkload.

8) "Coordinating Committee" means a Commiittee,whichcomprisesthe chairpersonsand secretariesofthe StandingCommitteesor theirrepresentativesand . ,

the speakers;9) "Resou(ce. Person" means individuals or or-

ganizationsinvitedto expoundtheir viewsoncertainfunctionsof the Houseor Cominitteesof the House;

10) ''First Reading" means the reading and discussionprocess held on a draft bill to be endorsed by theHouse,before referringit to the pertinentStandingCommitteefor further inspection; .

11) "Second'Reading" means the discussion on therecommendationand suggesions of the StandingCommittee,to which the draft bill was referredforfurther inspectionsubsequentto the first reading;

12) "ThirdReading"meansthediscussionof theHouseon th~returneddraft bill which was referred to theStanqing Committee for further re-~xaminationsubsequentto the sCfondreading;

13) "Technical Correction" means rectification oferrors of language or otherwise which in no waymodifiesthe substanceof the given law.

PART TWOMajorFunctionsand Working

Proceduresof the House

3. GeneralFunctionsof the House

The House of Peoples' Representativesshall have thefollowing general functions as enshrined in the Cons-titution :1) enact laws;2) hear reportsof thePrime Ministerand otherofficials

.of the Federal Governmentand shall call for ques-tioning wheredeemed necessary;

3) investigate the operations of the Federal Govern-mentbodies;

4) establishStandingand other Committees as well ashear their reports.

4 LegislativeProcedures1) The, House of Peoples' Representatives shall

" legisl;1te laws, by passing new, la)Ns, amending,repealing old ones orpy a,dopting internationalagreements.'

2) Bodies who may initiate and 'submit draft bills to theHouse are:(a) The Sepeaker and the Deputy Speaker;(b) Members of the House;(c) Committees of the House;(d). Exec~tivebpdies;,(e) The judiciary, and(t) Other governmental institutions accountable to

the House., ,3) The Bodies sp~cified in Sub-Article (2), (d), (e), (t)

above, may initiate laws within their jurisdictiongiven to them by law.

4) Any draft bill to be presented in accordance with SubArticle (2)(b) of this Article shall be in writing andsupported, by the signature ,of at least'20 members ofthe House and should be s\lbmitted to the Speaker ofthe House a week prior to its presentation to theHouse.

5) Subject to Sub-Article (2) (a) a draffbill initiated bythe Deputy Speaker shall be submitted to the Speakerof the House a week before its submission to theHouse. ,

6) Any ,praft bill shall be submitted"tp the Housethrough the Speaker. '

7) The'Houseshalldirectlyreceiveandopendiscussionon a draft bill submitted in accordance with sub-Article(4) of this Article.

8) The Speakershall,upon submissionof a draftbill tohim, notify the House of its content and essence;cause it to be itemizedin the agendafor preliminaryreading.

9) First Reading.(a) A person delegatedby the speakeror represen-. tative of the bill initiator shall, at the time

therein. set for it, openly read out the billitemizedin the agenda',to the House.

(b) Where the draft bill, submitted is foundvoluminousand time consumingfor a reading,the speaker may rule that it be sent out todeputies,priorto the date set for the agendaanddeliberations be started u,ponit without open

. reading.(c) upon completion of the reading of the draft bill

under sub-Article (9) (a) and (tr), the speakershall open the floor for deliberations on thespirit of the draft bill in geQerfl. ,

(d) uopn winding-up of the detibr~,rati.ons!the draftbill 'shall he numbered and referred, to thecencerned standing oFjoint committee, by the

"~p~aker. '(e) where,subsequentto thereadingof theqraftbill

submitted, two thirds of the members of theHouse deCidethat the HOliseQughtto directlyconsider the matter at its regular meeting, thematter shall not be referred to a comittee.

10) when 'executing sub Article (9) (d) the PertinentCommitteeinspectingthe draftbill referredto it shallrequire at least 20 wor~jng qays to submit itsproposalon thebill to the House,unlessthe bill to bepassed is urgingfor an immediateenactment.

11. SecondReading;,(a) the speaker of the House shall cause the

standing committeeread the report on the billreferred to it after the first reading with its

. recommendationsand suggestions. '

(b) the speaker opens the floor for discussionsonthe recommendationsmade.;

(c) ,where the draft bill is not deliberated exhaus-tively, it shall be re-referred to the pertinentcommittee for further review; if the de-liberation,however, is completedsatisfactorilythen it shallbe enactedas a law.

12) ThirdReading(a) thecommitteethatreceivedthe'billfor the second

time, shall read out the amended version and itsfinal' decision to 'the House. '

(b) the House shall pass the bill after a thoroughdiscussionon the final proposal.

13) Adoption of Laws,(a) Subject to Article 57 of the Constitution, the

speakerof theHouseshatltransmitthedraftbill tothe President of the Federal Government forsignaturesuggestingthat the Househasdiscussedand approvedit. .

(b) ,ThePresidentshall sign withinfifteendays. If thepresidentdoesn't sign withinfifteendays,the lawshall take effect without ,his signature. Thespeakerof theHousemayundertaket,hetechnical~orrection,where deemed necessary,prior to itspublicationin the FederalNegaritGazeta.

(c) Subject to sub - Article (13) (b) of this Article,whenever there is a technical correction, thePresidentshouldbe informedthroughtheSpeakerof the House.

(d) Theratifiedlawshallbe numberedby the Speakerand thereby published, in the Federal NegaritGazeta.

5. Examining the Performanceof the FederalGovemmentBodies

1) The, Prime 'Minister of the Federal, DemocraticRepublicof Ethidpiashallpresenthisgeneralplan inOctober, as well as his performance'reports at themiddleandend of the year to theHouse.

2) Anymemberof theFederalGovernmentbodiesshallpresent their reports to the pertinent committees inthe allottedtime.

3) The' Standing Committee shall summon a publicdebate on the -report after its own hearing. Thecommitteeshallinvitepertinentbodiesof the societyand the mass media to attend the discussions.Thepertinent Federal Governmentbodies shall presenttheirreportsthroughthepertinentStandingCommit-tees to the house. '

4) Subject to sub-Article (2) of this Article, amongothers, the repprt to be presentedshall focus mainlyon annual plan of action and achievements, theadministrative process and ,budget execution,problemsjdentified,in the process of execution aswell as the resultsachieved.

5) Head of the cpncernedbody shall present the reportof the body unless obliged otherwise by a forcemajeure.

6) The report may be presented by his representative,only wherethe head concerned'informsthe Speakerthe reasonof his absenceand that his representativeshallpresent the report.

7) According to the order set up by the ~peaker,membersof theHousemayraisequestionsandmakesuggestions.

8) Subject to sub-Article(7) additional questions andideasmaybe forwardedin connectionto the answersgiven.

9) Members of the House shall give summary of thereport and may also issue orders to the pertinent

'standing committee to launch additional inves-tigation into the matter and present a report to theHouse,wheredeems it necessary.

9. Powers and Functions of the Speaker and DeputySpeakerof theHouse '.

I) TheSpeakershallhavethepowersandfunctionsto:a) presid~ over the House sessions and in coor-

dination with the pertinent bodies shall setagendas and notify mem~rs of the House, ofsame"in advance;

(b) direct and administerthe House;(c) representthe Ho.usein all its dealings;(d) reconunend a,secretary, for appointment,who

shallmanagethe secretariatof the House;(e) coordinate the activities of the Standing and

other committeesof the House;(t) the Speakermaydelegatepartof his powersand

duties to the Deputy Speal\erin writing;(g) undertake such other activities as may be

assignedto him by.the House;2) The Deputy Speaker of the House shall have the

Powers andFunctionsto:(a) represent,the Speakerin his absenceor whenthe

Speaker wants to participatein the discussionofthe Househavinghis position;

(b) undertakesuchotl;1eractivitiesas maybegiventohim by the House'and the Speakerin writing.

10. Setting of AgendasI) The agendas that the Hpuse may deliberate in its

regular sessionsmaycome from:(a) the Speakerof the House,(b) committeesset up by the Houseand(c) membersof the House.

2) Any agenda to be 'presentedto the House shall besubmitted to the Speaker ahead of five workingdays unlessit is a matterof greatest urgency.

3) In conforrrutywith Sub.:ArticleI/c/, an agenda tobe presented to the House has.to be supported bythe signatureof 20membersof theHouseincludingthe presenter.

4) The House shaHr.eceivethe agenda submitted inaccordancewith sub Article131of this Article anddirectly: resume discussio1)s.

11. Structure, Powers and Functions as wel1 as WorkingProcedures of the Coordinatng Committee

1) the Coodinating Committee(a) the committee shall, comprise the speaker,

deputy speaker, chairpersons of each commit-tee and the secretary or their representatives asits members.

(b) the speaker shall preside over sessions of thecommittee and pass decisions by a majorityvote. The presence of more than half of themembers shall constitute a quorum.

(c) shall elect a secretary from among its mem-. be~. '

2) The Coordinating Committee of the House shallhave the followingpowersand functions:(a) coordinate the work plan of the committees

and supervisethe general flow harmony andeffectivenessof works'in the House.

;(b) evaluatethe majorproblemsandstrongpointsidentified in the House, streamline general

. work plans and issue directives to the Per-tinentCommittees. '

(c) holduiscussionson issuesand agendaswhichthe speaker believes should be seen by thiscommittee or referred to it by the StandingCommittees.

3) The coordinating.committeeshall apply the generalworkingpro~edU1"esprovidedfor the standingcom-mitteesin Article 19of this proclamation.

12. Structure, Powers and Functions of the Ad hocCommittee1) TheH6use shallestablishadhoccommittees when

it is convincedthat thereareurgentand vital issues,which rltay not be directly undertaken by theStandingand CoordinatingCommittees.

2) The power of the ad hoc committee shaH'bede.terminedby-theurgencyandvitalityof situationsthat may take place,however,the Hous,eshall givegeneraldirective&thatmayenable it accomplishitsmISSIons.. '

3) TheHouse,dependingon t)1esitua!ion,shalldecidethe number of members of the ad hoc committeeand assign chairman and secretary to lead thecommittee. ' ~.

4) The ad hoc committeeshall dissolve after accom-plishing its mission within its powers andpresen-ting a report to the House.

6) may undertake their activities by breaking up intosub committees and may also request the House forthe establishment of Standing Sub Committeesciting workload ofthe committee.

7) make sure that, their legislative and investigativeactivities are done on gender equality basis andgender sensitized.

8) undertake other assignments given by the House orthe Speaker.

17. 'Powers and Functions of Leadership of the StandingCommittees1) powers and functions of Chairpersons shall be to:

(a) represent the committee in all its dealings withthird parties;

(b) submit a report to the House as stipulated inArticle 6;

(c) direct the committees, coordinate and presideover meetings. They shall administer the sup-port staff as enshrined in Article 15(6);

(d) facilitate ways for the presence of invitedguests;

(e) call for extra ordinary meetings;(f) carryout other activities given by the Speaker,

the House and the Committee.2) Powers and functions of the deputy chairpersons

shall be to:(a) represent the chair persons in their absence;(b) mak sure that the committees' documents and

minutes are properly kept;(c) undertake other activities assigned to them by

the committees' chairpersons and the commit-tees.

3) The leadership specified in Sub Articles (1) and (2)0fthis Article shall undertake their activities with theknowledge of their committee members.

18. Obligations of Members of the Standing Committees1) Members of the standing committees shall have the

following major obligations:(a) except where there is a good cause for absence,

any member is obliged to be present at allcommittee meetings;

(b) undertake and supervise the execution of assig-nments on time.

(c) a member represented to take part in, the studiesto be conducted both at home and abroad as wellas meetings and field works shall submit asound report to the Pertinent Committee and tothe House.

2) A committee member is responsible for the activitiescarried out both idividually and jointly. A memberwho failed to accomplish hislher duties, shall beevaluated by the majority vote of the committee andthe report shall be submited to the House.

19. General Working Procedures of the Standing Commit-teesThe Standing Committees of the House shall have thefollowing major working systems and procedures:1) A committee having received a draft bill, subsequent

to the first reading, shall itemize the matter in itsagenda; and(a) give notice;(b) invite resource presons and bodies dir~ctly- concerned with the matter;

(c) arrange public opinion collecting forums; andsubmit, to the House, a report consisting of itsinvestigation, recommendations and susggestions onthe matter.

2) Standing Committees shall undertake theirsupervisory and follow-up duties by:

teesor bodies.

4) preparingrep6rt, givingexplanation~5) the guidanceof theannualplanandreviewingtheir

comprehensiveoperations.

20. Proceduresof StandingCommitteeMeetings1) unless otherwisechanged for special reasons, the

Standing Committees shall regularly have fixedmeetingdays,place and time.

2) without being counted for quorum, motioningagendaandvote,membersof theHouseandinvitedguestsmaytakepart in the meetingof the StandingCommittee.

3) particulars relating to Sub Articles (1) and (2)above and conditions of meeting and decisionmakingproceduresshallbe inlinewiththeworkingproceduresof the Houseand the specificsof whichshallbe determinedby Regulations.

21. CapacityBuildingAffairs StandingCommittee1) The major objective.for the establishmentof the

CapacityBuildingAffairsStandingCommitteeis:(a) to produce trained manpowerin a short time

and in a big numberwhocould be committedto work effectively, with a great sense ofresponsibility and integrity to bring aboutrapid economic development and build asocietybasedon democraticprinciples,

(b) as well as to implement,superviseand inves-tigatethe measuresbeing undertakento buildexecutionand planningcapacitiesboth in thegovernmentand privateeconomicsectors.

2) TheCapacityBuildingAffairsStandingCommitteeshall supervisethe followinggovernmentoffices:(a) Minis~ of CapacityBuilding;(b) Ministryof Education;(c) ScienceandTechnologyCommission;(d) CivilServiceCommission;(e) ManagementInstitute;(t) CivilServiceCollege,and(g) Justiceand LegalOrderResearchInstitute.

3) Havingregardto thebodiesspecifiedin SubArticle(2) above and within the powers and dutiesspecifically given to them, the Committee shallpreparedraftbills and submitto the House,check,superviseand investigatewheneverdeemedneces-sary.

22. TradeandIndustryAffairs StandingCommittee1) The Tradeand IndustryAffairsStandingCommit-

tee shallhave the followingmajorobjectives:to check that the agriculture policy has beenformulatedin sucha wayto speedup the growthofthe nationaleconomyandeffectivelyimplemented,measures have been taken to encourage the de-velopment of trade, industry and handicraft, the

. investmentpolicy and law have createdfavorableconditionstoentrepreneursas wellassuperviseandinvestigate the implementationof policies, lawsand regulations issued to facilitate the regions'traderelations,foreigntradeandexistingandfuturechambersof commerceat a national level.

3) Havingregardto the bodiesspecifiedin SubArticle(2) above and within the powers and dutiesspecifically given to them, the committee shallpreparedraft bills and submit to the House,check,superviseand investigatewheneverdeemedneces-sary.

23. RuralDevelopmentAffairs StandingCommittee1) The main objective for establishmentof the Rural

Development Affairs Standing Committee is toraiseproductionandproductivityin theagricultural,sector of the economy, to ensure food self suf-ficiencyand food securityas well as to investigateand supervise the effective implementation ofpolicies,programsand plans formulated to enablethe agricultureleddevelopmentstrategyachieveitsobjectives.

2) TheRuralDevelopmentAffairsStandingCommit-tee shall supervise the following governmentalinstitutions:(a) the Ministryof Rural Development,(b) the Ministryof Agriculture,(c) the Disaster Preventation and Preparedness

Commission,(d) the Social Rehabilitation and Development

fund,(e) the Plant GeneticIndustry Agency,(t) the FertilizerIndustryAgency,(g) the AgriculturalResearch Organization,(h) the Bio Diversity Protection and Research

Institute,and(i) theRuralEnergyDevelopmentandPromotion

Center.3) Having regard to the bodies specifiedin sub Article

(2) above and within the powers and dutiesspecifically given to them, the Committee shallprepare draft bills and submit to the House, check,supervise and investigate wheneverdeemed neces-sary. .

24. NaturalResourcesandEnvironmentalProtectionAffairs StandingCommittee

1) The main objective for the establishment of theNatural Resources and Environmental ProtectionAffairs Standing Committee is to preserve andconserve the nation's natural resources, to ensuresustainabledevelopment, investigate and supervisethe effective implementationof policies, strategiesand progarmsadopted.

2) The Natural Resources and Enviommental Protec-tion AffairsStandingCommitteeshall supervisethefollowinggovernmentoffices:(a) EnvironmentalProtectionAuthority,(b) Ministryof WaterResources,(c) Ministryof Mines and(d) The Ethio-GeologicalSurvey.
