ANNEXURE-1
OFFICE OF THE EXECUTIVE ENGINEER,
MEDICAL & HEALTH, UDAIPUR.
SPECIAL CONDITIONS OF CONTRACT
1. The work shall include all lead and fit complete work in all respect. 2. The contractor shall arrange all men, material and T & P to complete the work
well in time. 3. The contractor will arrange Electricity and water at his own cost at his level. 4. Any damage occurred to the structure shall have to be rectified by the
contractor at his own cost as per direction of Engineer-in-charge. 5. The quality control tests directed by Engineer-in-charge for materials required
for construction for which on site testing facilities and equipments etc. are not
provided by the contractor and/or such test are required to be carried form out
side laboratories all such tests as directed by the Engineer-in-charge, shall bearranged and got done by the contracting agency at his own cost and no
reimbursement and payment shall be made by the department to the contractor on this account.
6. The department engineers shall also test the material with their own equipment
as per norms and the contractor will provide all necessary assistance.
Department may also engage third party quality assurance / evaluation firm for
carrying out the test as deemed fit and check the material lying at the site and
the quality control test results conducted by the department. They may also get
the selected work done in their own presence. The contractor shall provide all necessary help and assistance to them.
7. Testing of material required by Engineer-in-charge shall be the contractor’s
responsibility at his cost. 8. For mixing of concrete and compacting concrete mixer and vibrator shall only
be used. The mortar as required for masonry, plaster etc. shall be prepared by
means of C.C. Mixer only. 9. The contractor shall not work after the Sunset and before sunrise without
specific permission of the Authorized Engineer.
10.No equipment or personnel will be removed from site without permission of
Engineer-in-charge. 11.The contractor shall furnish the programme of construction for execution of the
work within the stipulated time schedule together with methodology of
construction for each type of work and should obtain the approval of the Engineer-in-charge prior to actual commencement of work.

12.If there is any typographical or clerical error / discrepancy of otherwise in the
Schedule ‘G’ the rates as given in the PWD BSR 2013 Banswara circle for building works items and its latest corrigendum issued form time to time on which “Schedule-G” has been prepared shall prevail.
13.Any Material not Confirming to the specification collected at site shall have to
be removed by the contractor within a period of three days of the instruction
issued by the Engineer-in-charge in writing, failing which, such material shall
be removed by the department at risk and cost of the contractor after expiry ofthree days period.
14.The Material collected at site and paid provisionally shall remain under the watch and ward of the contractor till it is consumed fully on the work.
15.The contractor should arrange the necessary survey and Quality Control
Equipments at his own cost at work site for checking of material and to ensure
the work done by his as per specification, as per directions of the Engineer-in-
charge. 16.Cement from Mini Cement Plant shall not be allowed, and the brand of cement
is to be got approved from the Engineer-in-charge before execution of work. 17.Since the printed agreement from of the Govt. Press in not available and
agreement form printed from local market is used for agreement purpose for of
this work. However in case of printing mistake or any other error, from the
standard agreement form, the rules and conditions amended by Govt. vide N. F3 (109)/FD/Exp./III/69 part Jaipur dated 30.8.93 and F2 (I)(FD)/Exp./96 dated 12.6.97 and further amended up to 8.11.2007 by the Govt. from time to time
will be applicable in this case issued up to the date of issue of NIT. 18.The labour engaged by the contractor for carrying out the work shall be at his
own risk and he is bound to protect the interest of labour rights under labour
laws and rules prevailing and enforce. 19.The overall cleaning of site and disposal of building rubbish, surplus material
etc. is to done by contractor as directed by Engineer-in-charge.
20.Contractor will make his own arrangement for permission of vehicles from
traffic department, in entry zone area and will make his own arrangement of
movement of vehicles within time allowed by Traffic Police authorities. 21.Kota Stone/Marble Stone/Granite Stone and other building stones to be used in
flooring shall be of specific size as decided by the Engineer-in-charge only and of uniform color & shade. No extra payment is admissible for use of specific
size and of uniform color & shade. The sample is to get approved from Engineer-in-charge before procurement. Drawings enclosed with this document are conceptual drawings and modification may be done, by Engineer-in-charge,
to match with over all décor and no extra payment shall be paid to contractor on
this account.

22.Complete site of work will have to be barricaded by 10’ to 12’ ht. G.I. sheet as
per instruction of Executive Engineer required for work till completion of the
work at his own cost. 23.The Materials used in Doors frames and Sections Windows shall be ISI
Marked.
24.The useful dismantled material shall either be deposited with concerned MO in
charge or shall be used in construction for which recovery shall be affected as
per rules. 25.The contractor or his nominated sub contractor should possess the required
valid license for executing water supply/Sanitary works and electrical works also.
26.Mix Design for Concrete work (Ready Mix/ In-situ) would have to be got
approved from the Engineer-in-charge before execution of the work. The design
shall be arranged by the contractor from authorized institution at his own cost. 27.The Contractor would be allowed to use only new ply shuttering for all RCC
works.
28.The Contractor has to submit copies of all the bills of purchase of Cement, Steeletc. required by the Engineer-in-charge. 29.Work of Anti-termite Treatment shall be carried out by Lice need/ Approved
personals with spray machines.
30.Contractor shall be fully responsible for provident funds, insurance etc. for
workers engaged by him on the work. 31.The final bill shall be paid after receipt of NOC from mining department.
32.The drawing enclosed with the bid document are the conceptual drawings and
modification may be done to suit the client requirements. 33.Defect Liability period of work shall be 3-Year reckoned from date of actual
completion of the Building work (As per Annexure) 34.Regarding refund of Security Deposit, Modified Agreement Format shall be
applicable (As per Annexure)
35.The Contractor is responsible for design of RCC members in above work which
includes the submission of General Arrangement drawings for columns, beam
etc. with all required soil and other investigations. After approval of GAD he
will carry out the detailed design of RCC members from the structural
consultant and proof checking from the authorized institutions, in view of
design being earth quake resistant. After submitting the design and bar bending
schedule of RCC work the approval will be given by the competent authority/ Engineer in charge, only there after he will start the work. No Extra payment
will be payable for this job.

36.The defect liability period shall be Three years for the work executed under this
agreement. Security Deposit shall be refunded after Three years from the date of actual completion of the work provided the final bill has been paid in
accordance with the Clause 37 of Agreement. During this period, the contractor
shall carry out maintenance and rectifications of defects (if any) of the job at his
own, failing which it shall be carried out at risk & cost of the contractor and
expenditure so incurred shall be recoverable from the contractor.
37.Deployment of two site engineer one degree holder (civil) with minimum sevenyear experience and one diploma holder (civil) with 3 year experience has to be
made by contractor at his own cost.
38.Contractor has to erect field laboratory as well as site office as approved by
engineer in charge at his own cost. 39.From work shall be got approved from engineer in charge before laying of RCC
work.
40.Amount according to orders No. 9568 dated 17.05.2010 issued by Principal
Secretary, Labour, Employment & Technical Education (Training),
Government of Rajasthan (Copy Enclosed) shall be deducted from contractor’s bill as Labour cess.
41.The Contractor shall engage unskilled local labour from Rajasthan state
preferably of the district, for the execution of the work.
42.The breakup of the components of labour / cement/ steel/ other materials as
indicated in Clause 45 (Price Variation Clause) have been determined as below
and shall be a part of the agreement.
a) Labour 20%
b) Cement 18%
c) Steel 35%
d) Other materials 27%
