I. Cc iu kin chuyn tin quc t i ca BIDV (BIDVs terms and conditions on overseas remittance)

1. nh ngha (Definitions)Trong Lnh chuyn tin ny, nu khng c quy nh g khc, cc thut ng c hiu nh sau: (On this form, unless otherwise stipulated,words and phrases are understood as follows):

BIDV: l S Giao dch v Chi nhnh ca Ngn hng Thng mi C phn u t v Pht trin Vit Nam (BIDV: any TransactionCenter and Branche of Joint Stock Commercial Bank for Investment and Development of Vietnam).

Bn th ba: l Ngn hng nhn in/Ngn hng trung gian m BIDV gi in trc tip/gin tip chuyn tin n Ngn hng ngihng (Third Party: any Receiving bank/ Intermediary bank chosen by BIDV to convey the funds directly or indirectly to the

Beneficiary bank).

2. BIDV c quyn la chn s dng dch v ca Bn th ba thc hin Lnh chuyn tin theo yu cu ca Ngi chuyn tin (BIDVhas its full authority to choose any Third Partys service to effect the remittance transaction as per request by the Applicant).

3. BIDV khng chu trch nhim v nhng tn tht, thit hi nu giao dch b tr hon, khng c thc hin do cc nguyn nhn bt khkhng hoc do nhng s c nm ngoi s kim sot ca BIDV. BIDV s tch cc trong vic lin h vi Bn th ba gim thiu tn tht,thit hi c th pht sinh cho Ngi chuyn tin (In no circumstances will BIDV bear any losses or damages if the transaction is delayedor failed to be performed due to Force Majeure or any incidents that are out of BIDVs control. If any such circumstances occur,

however, BIDV will try its best in contacting the Third Party involved to minimize the Applicants potential losses and damages).

4. Ngi chuyn tinng rng BIDV v/hoc Bn th ba c th tr hon, gi li hoc t chi thc hin giao dch m khng chu bt ctrch nhim g nu BIDV v/hoc Bn th ba c cs nghi ng rng: (i) Giao dch c th vi phm php lut Vit Nam, php lut v thngl quc t; v/hoc (ii) Giao dch c lin quan n ra tin hoc ti tr khng b (I/We agree that BIDV and/or the Third Party can delay,block or refuse to make the transaction without bearing any responsibility if BIDV and/or the Third Party has any grounds to establish

suspicion that: (i) the transaction may breach any Vietnamese laws or international laws and common practices, and/or (ii) the

transaction may involve money laundering or terrorist financing).

Ngi chuyn tin ng rng BIDV c php cung cp thng tin lin quan n Ngi chuyn tin v giao dch chuyn tin bao gmnhng khng gii hn: tn; thng tin CMND, H chiu, ng k kinh doanh; a ch; M s thu; ... theo yu cu ca (i) Bn th ba; (ii)cc c quan c thm quyn ca Vit Namv/hoc ca nc m Bn th ba/Ngn hng ngi hng mang quc tch (I/We agree that

BIDV can provide all information relating to the Applicant and the transaction, including but not limited to: name; information of ID,

Passport, Business Registration; address; Tax code; at the request of: (i) the Third Party, (ii) Vietnamese authority and/or the

competent authority of the Third Partys/Beneficiary Banks country).

II. Cam kt ca Ngi chuyn tin (Applicants commitments)Ngi chuyn tin cam kt (I/We undertake that):(1) H s i km Lnh chuyn tin ny tun th mi quy nh hin hnh v qun l ngoi hi v cc vn bn quy phm php lut linquan ca nc Cng Ha X Hi Ch Ngha Vit Nam (The supporting documents attached to this payment order are in strictcompliance with current laws and regulations on foreign exchange control and other related regulations of S.R.Vietnam);

(2) Chu trch nhim v tnh php l, xc thc ca Lnh chuyn tin v h s cung cp cho BIDV (I/We shall bear the responsibility forthe legitimate and authenticity of this payment order and the attached documents);

(3) Chu mi ri ro lin quan n ch dn thanh ton trn Lnh chuyn tin (I/We shall bear all risks arising from my/our instructions onthis payment order);

(4) Cho php BIDV la chn Ngy hiu lc thanh ton sang ngy lm vic tip theo trong trng hp Ngy hiu lc trn Lnh chuyntin trng vi ngy ngh ca Bn th ba/Ngn hng ngi hng (BIDV is allowed to set the Value date to the next working day in casethe Value date mentioned on this payment order is the working day-off of Third Party/Beneficiary bank);

(5) Cung cp y cc chng t theo quy nh ca BIDV cho tng mc ch chuyn tin v b sung cc chng t cn thiu (nu c)(I/We shall submit all supporting documents as required by BIDV for each remittance purpose and furnish BIDV with other un-presented

documents (if any)):

- Ha n v T khai hi quan thng quan (km T khai hi quan gc i chiu) i vi trng hp chuyn tin thanh tonnhp khu hng ha trc khi nhn hng (Invoice and copy of cleared Customs Declaration Form (original one submitted for checking) -in case payment is made before goods delivery); hoc (or)

- Chng t chng minh dch v c cung cp theo ng yu cu ca hp ng i vi trng hp chuyn tin thanh ton dch v trc khi dch v c thc hin (Supporting documents certifying that services are strictly performed as per contract terms andconditions - in case payment is made before service performance); hoc (or)

- Visa nhp cnh c hiu lc ca ngi Vit Nam nc ngoi i vi giao dch chuyn tin mt chiu cho ngi Vit Nam ccnc quy nh c Visa nhp cnh (Valid Visa of Vietnamese overseasin case of outward remittance for Vietnamese overseas in Visa-required countries);

(6) nhn c dch v theo ng yu cu ca hp ng i vi trng hp chuyn tin thanh ton dch v sau khi dch v c thchin (Service has been strictly performed as per contract terms and conditionsin case payment is made after service performance);(7) Chuyn tin tr cp khng qu s tin ti a/ngi thn/nm theo quy nh hin hnh (tr trng hp c chng t chng minh s tinchuyn vt mc l hp l) i vi giao dch chuyn tin tr cp cho thn nhn nc ngoi (Allowance to overseas relatives shall notexceed the limit stated in current regulations on foreign exchange control, unless the excess amount is evidenced reasonably by

supporting documents);

(8) Cung cp mi thng tin c lin quan n giao dch chuyn tin cho BIDV khi BIDV c yu cu kim sot vic tun th: php lutVit Nam, php lut v thng l quc t, quy nh phng chng ra tin v/hoc ti tr khng b (I/We shall furnish BIDV with allinformation related to the transaction upon BIDVs request to be in compliance with Vietnamese laws, international laws and p ractices,

regulations on money laundering and/or terrorist financing);

(9) Chu trch nhim trc php lut nu Ngi chuyn tin vi phm cc cam kt nu trn (I/We shall bear full legal responsibility forbreach of my/our above-mentioned commitments).
