Dear Records Custodian ,
Pursuant to the state open records law, W. Va. Code Secs.
29B-1-1 to 29B-1-7 , I write to requestaccess to and a copy of;
All police/ incident reports, dispatch call log reports (or
C.A.D. Report) and all otherpublicly available documents,
associated with the arrest Daniel Dobos on or around 06-02-
2008, all audio and video recordings, including but not limited
to any recordings of dash cams and
radio transmissions, 911 calls etc. pertaining to the above
mentioned name,
Princeton Police Department written policies regarding; probable
causes for searchingvehicles & confiscating property/asset
forfeiture.
If your agency does not maintain these public records, please
let me know who does and include theproper custodian's name and
address.
I agree to pay any reasonable copying and postage fees of not
more than $20.00. If the cost would begreater than this amount,
please notify me. Please provide a receipt indicating the charges
for eachdocument.
As provided by the open records law, I will expect your response
within five (5) working days. SeeW. Va. Code Sec. 29B-1-3(4).
If you choose to deny this request, please provide a written
explanation for the denial including areference to the specific
statutory exemption(s) upon which you rely. Also, please provide
all segregable
portions of otherwise exempt material.Please be advised that I
am prepared to pursue whatever legal remedy necessary to obtain
access to
the requested records. I would note that willful violation of
the open records law is a misdemeanor,punishable by a fine of not
less than $200 nor more than $1,000, imprisonment in the county
jail fortwenty (20) days, or both. See W. Va. Code Sec. 29B-1-6.
Court costs and attorney fees may also beawarded. See Sec.
29B-1-7.
