วสยทศน

เปนศนยกลางแหงความเปนเลศดานวชาชพ ในอตสาหกรรมการบนของภมภาคโดยเปนองคกร แหงการเรยนรทมบคลากรคณภาพระดบมาตรฐาน สากล

พนธกจ

1. ผลตและพฒนาบคลากรดานอตสาหกรรม การบนใหมคณภาพตามมาตรฐานสากลอยางเพยง พอตอความตองการภายในประเทศ และสอดคลอง กบความตองการของภมภาค

2. ศกษาและพฒนาเทคโนโลย และบรการ ดานการขนสงทางอากาศ เผยแพรความร ใหคำ ปรกษา แนะนำเพอเพมประสทธภาพการใหบรการ และเพมศกยภาพในการแขงขนของระบบขนสง ทางอากาศของไทยในภมภาคเอเชย

3. เพมขดความสามารถในการใหบรการซอม บำรงอากาศยาน

4. ขยายการใหบรการอากาศยาน และสราง บรการใหมๆ ทเกยวของกบอตสาหกรรมการบน เพอฝกทกษะการปฏบตงานจรงใหกบนกศกษา และใหบรการกบหนวยงานภายนอก

Vision

As a Regional Human Resourced Development Center with world-class personnel , the CATC is committed to being a center of excellence in the regional avation industry.

Mission

1. To produce and train sufficient highly – skilled personnel to meet the needs of the sufficient national and regional aviation industries.

2. To research and develop new aviation technologies and services,and to educate and advise in order to raise service standards and enhance the competitiveness of Thailand’s aviation sector in the Asian region.

3. To provide increased capacity in aircraft maintenance and repair services.

4. To provide aircraft services and to create new business related to aviation industry, in order to serve the public and support CATC students on cooperative education activity.

โดยบคลากรทผานการอบรมจากสถาบนการบนพลเรอน ลวนเปนผทมศกยภาพในการทำงานสง มความพรอมทกๆ ดาน มมาตรฐานเทยบเทาระดบสากลตามมาตรฐานทองคการการบน พลเรอนระหวางประเทศกำหนด อนสงผลดตอการพฒนาประเทศ ชาตโดยรวม

I am very glad and proud of our CATC, the institute whose responsibility is producing and developing aviation industry personnel, as well as,running all International Civil Aviation Trainings.

Since CATC pesonnel, having gone through various trainings gien by the institute, are those who have high potentiality in their working-performances, They are fully-prepared in all dimensions, with high standards equivalent to international criteria, required by the International Civil Aviation Organizations. Their working performances result in wellness, found in the totality of the country development.

On this auspicious occasion, I wish CATC Administrative Board, all employees and alumni, as well as, present CATC students, together with families of all persons mentioned; blessed with hapiness, prosperity and progress; showered with the Four humanly needed blessings of: long lives, physical beauty, happiness and good health. ในโอกาสครบรอบวนคลายวนสถาปนาสถาบนการบน- พลเรอน ปท 47 ในวนท 4 มถนายน 2551 น ผมในฐานะผวาการ สถาบนการบนพลเรอน ขอขอบคณทกหนวยงานทใหการสนบ- สนนการดำเนนงานของสถาบนการบนพลเรอนดวยดเสมอมา และขอขอบคณผใชบรการทกทานทใหความไววางใจในการผลต และพฒนาบคลากรดานอตสาหรรมการบน และบรการตางๆ ตลอดมา

สถาบนการบนพลเรอนไดรบโอนกจการ ของกรมการบนพาณชยในสวนของศนยฝก การบนพลเรอนในประเทศไทยมาดำเนนการ เมอ วนท 1 เมษายน 2536 และไดรบทนประเดม ตามพระราชกฤษฎกาการจดตงสถาบนการบน พลเรอน รวมทงสนเปนเงนจำนวน 150,000,000 บาท โดยไดรบจากบรษท การบนไทย จำกด (มหาชน) จำนวน 100,000,000 บาท บรษท วทยการบน แหงประเทศไทย จำกด จำนวน 25,000,000 บาท และการทาอากาศยานแหงประเทศไทย (ปจจบนคอ บรษท ทาอากาศยานไทย จำกด มหาชน) จำนวน 25,000,000 บาท

สถาบนการบนพลเรอน จดตงขนโดย โครงการความรวมมอระหวางกองทนพ เศษ สหประชาชาต (United Nations Special Fund : UNSF) องคการการบนพลเรอนระหวางประเทศ (International Civil Aviation Organization : ICAO) และรฐบาลไทย เมอวนท 4 มถนายน พ.ศ. 2504 ภายใตชอ ศนยฝกการบนพลเรอนในประเทศไทย เปนโครงการระยะ 5 ป (พ.ศ.2504 - 2508) ซงม วตถประสงคเพอพฒนากจการบนพลเรอนระหวาง ประเทศในภมภาคเอเชยแปซฟกใหเจรญรดหนา ทนกบเทคโนโลยตามทองคการการบนพลเรอน ระหวางประเทศไดกำหนดไวในภาคผนวกแหง อนสญญาวาดวยการบนพลเรอนระหวางประเทศ

ตอมา ในป พ.ศ. 2509 รฐบาลไทยไดรบ มอบศนยฝกการบนพลเรอนในประเทศไทยมา ดำเนนการ โดยใหมฐานะเปนสถานฝกอบรม อยในความรบผดชอบของกรมการบนพาณชย (ปจจบนคอ กรมการบนพลเรอน) กระทรวงคมนาคม ตงแตวนท 1 มกราคม พ.ศ. 2509 และในป พ.ศ. 2530 รฐบาลไดมพระราชกฤษฎกาแบงสวนราชการ กรมการบนพาณชยใหม โดยไดจดตงศนยฝก การบนพลเรอนในประเทศไทย (มฐานะเปนหนวยงาน ระดบกอง) ในกรมการบนพาณชย กระทรวงคมนาคม

The status of the Center changed once again five years later, in 1992, when the Government decreed that the Civil Aviation Training Center would become a state enterprise under the Ministry of Transport. This has allowed the center to produce qualified personnel in aviation related fields more efficiently and in turn driven the growth and development of the country’s aviation industry and Thailand’s economic growth as a whole.

Civil Aviation Training Center was transferred from the Department of Civil Aviation on April 1, 1993 with a registered capital of 150,000,000 Bath of which 100,000,000 Bath came from Thai Airways Inter-national Public Company Limited, 25,000,000 Bath from Aeronautical Radio of Thailand , and 25,000,000 Bath from the Airports Authority of Thailand (today the Airport of Thailand (Public) Company, Ltd.).

The Civil Aviation Training Center was created as a joint project between the United Nations Special Fund (UNSF), the international Civil Aviation Organiza-tion (ICAO), and the Royal Thai Government on June 4, 1961 originally called the Civil Aviation Training Center in Thailand. The project operated for a period of five years, (1961-1965), and was designed to promote the civil aviation industry throughout the Asia Pacific region and to bring standards of technology in line with the standards set by the International Civil Aviation Organization.

On January 1, 1966, the Thai Government assumed complete control of the Civil Aviation Train- ing Center, placing it under the responsibility of the Department of Civil Aviation (DOA), part of the Ministry of Transport and Communications (today the Ministry of Transport). In 1987, the government issued a decree which raised the status to the CATC to that of a division within the Department of Civil Aviation within the Ministry of Transport. The move was intended to improve efficiency and give the center greater operating flexibility.

Founding Objectives, Commitments and Responsibilities

ตามพระราชกฤษฎกาจดตงสถาบนการบนพลเรอน พ.ศ. 2535 มาตรา 6 ใหสถาบนการบนพลเรอน มวตถประสงคในการจด ดำเนนการผลต และพฒนาบคลากรท เกยวของกบการบนและ ดำเนนกจการเกยวกบบรการชางอากาศ บรการอากาศยานและ กจการอนเกยวกบกจการบนเพอประโยชนในการผลตบคลากร ดงกลาว

สถาบนการบนพลเรอนมอำนาจหนาทและความรบผดชอบดงน

1. ฝกอบรมดานกจการบนพลเรอนระหวางประเทศใหได มาตรฐานตามทองคการการบนพลเรอนระหวางประเทศ (ICAO) ไดระบไวในอนสญญาการบนระหวางประเทศ และรบผดชอบการฝก อบรมภายในประเทศ ใหสอดคลองตามกฎหมายเกยวกบการเดน อากาศภายในประเทศ

2.ผลตบคลากรดานการบนพลเรอนใหเพยงพอตอความ ตองการภายในประเทศ เพอสนบสนนหนวยงานการขนสงทางอากาศ ของภาครฐและเอกชน ใหเปนไปตามแผนพฒนาบคลากรการบน ของประเทศ

3. บรการชางอากาศ บรการอากาศยาน และกจการอนใดทเกยวของกบกจการการบน โดยสถาบน การบนพลเรอนมวตถประสงค ภารกจและความรบผดชอบเพอผลต และพฒนาบคลากรดานการบน พลเรอนของประเทศในภมภาคเอเชยแปซฟกใหเจรญกาวหนาทนกบเทคโนโลยสมยใหมตามท องคการการบนพลเรอนระหวางประเทศไดบญญตไว

Under Article 6 of the Royal Decree which established the Civil Aviation Training Center, (CATC) is responsible for producing and developing personnel for the aviation industry and for aircraft maintenance, aircraft services and other aviation-related services that promote the production of such personnel.

The duties and responsibilities of the CATC are as follows:

1. To provide aviation training that conforms to the standards of the International Civil Aviation Orga-nization’s International Civil Aviation Convention, and to offer domestic training in compliance with Thailand’s own air transport laws and regulations.

2. To produce sufficient qualified personnel to meet the needs of the country’s private and state-sector air transport industry, in line with Thailand’s national aviation personnel development plans.

3. To provide technical and other aviation related services. The responsibility of the CATC is to produce highly skilled personnel for the civil aviation industry in Thailand and the Asia Pacific region. It has a vital role to play in helping the industry to keep pace with technological advances, envisioned by the international Civil Aviation Organization (ICAO).

1. ผสำเรจการศกษา/ฝกอบรมมทกษะความชำนาญและคณภาพตามมาตรฐานสากล ชวย ยกระดบมาตรฐานบคลากรดานการขนสงทางอากาศของประเทศและของภมภาค

2. สามารถผลตและพฒนาบคลากรทางดานการบนไดเพยงพอตอการขยายตวของอตสาหกรรม การบนของประเทศ

3. เปนแหลงอางองทางวชาการดานการบนพลเรอนเปนทยอมรบ และเชอถอในระดบนานาชาต

4. มรปแบบการใหบรการดานการบนเพมมากขน ซงกอใหเกดรายไดทเพมขนเพอลดการพงพา งบประมาณภาครฐ ในสวนทมใชงบลงทน

Objectives

1. CATC graduates and those who complete CATC training courses should attain a level of quality and expertise that complies with international standards, enabling them to contribute to the improvement of professional standards in the air transport industry.

2. To produce and develop sufficient qualified personnel to meet the expansion needs of the national aviation industry.

3. To win international recognition as a reputable training institution in the field of civil aviation.

4. To offer a continually expanding range of services that generate additional income and help to reduce the Center’s reliance on government support for investment funding.

5. To be a model government organization with an effective management structure and strategic management policies that give priority to quality standards and comply with the principles of good corporate governance.

6. To maintain staff who meet international standards are part of a culture of learning, and who take full advantage of opportunities for professional development as a means of improving personal and organizational performance.

1. หลกเกณฑและการคดเลอกกรรมการ

ตามพระราชกฤษฎกาจดตง สบพ. พ.ศ. 2535 ระบ ดงน

- มาตรา 10 ใหมคณะกรรมการคณะหนง เรยกวา “คณะกรรมการสถาบนการบนพลเรอน” ประกอบดวย ประธานกรรมการ ผแทนกระทรวง คมนาคม ผแทนกระทรวงการคลง ผแทนกรมการบน พาณชย ผแทน บรษท ทาอากาศยานไทย จำกด (มหาชน) ผแทนกองทพอากาศ ผแทน บรษท การบนไทย จำกด (มหาชน) ผแทน บรษท วทยการบนแหง ประเทศไทย จำกด และผทรงคณวฒอกไมเกน 2 คน และผวาการ เปนกรรมการและเลขานการ

- มาตรา 12 ประธานกรรมการหรอกรรมการ ซ งคณะรฐมนตรแตงต งตองไมมสวนได เสยใน กจการทกระทำกบ สบพ. หรอในกจการทมลกษณะ เปนการแขงขนกบกจการของ สบพ. ทงน ไมวาโดย ทางตรงหรอโดยทางออม

เมอครบกำหนดตามวาระดงกลาวในวรรค หนง หากยงมไดมการแตงตงประธานกรรมการหรอ

กรรมการขนใหมใหประธานกรรมการหรอกรรมการ ซงพนตำแหนงตามวาระนน อยในตำแหนงเพอ ดำเนนการตอไป จนกวาประธานกรรมการหรอ กรรมการซงไดรบการแตงตงใหมเขารบหนาท

ประธานกรรมการหรอกรรมการซงพนจาก ตำแหนงตามวาระอาจไดรบการแตงตงอกได แต ไมเกนสองวาระตดตอกน

การเขารวมประชมในรอบป

เนองจากในชวงปงบประมาณ 2551 มการ เปลยนแปลงคณะรฐมนตรชดใหม เขามารบผดชอบ การบรหารราชการ เพอใหรฐบาลสามารถพจารณา ความเหมาะสมของผทจะปฏบตหนาทเปนกรรมการ สบพ. อกทงการแจงรายชอกรรมการผแทนหนวยงาน ตางๆ ใชระยะเวลานานพอสมควร จงทำให สบพ. ไมสามารถจดใหมการประชมคณะกรรมการ สบพ. ไดตามกำหนด เนองจากกรรมการไมครบองค- ประกอบ ตามพระราชกฤษฎกาจดตง สบพ. พ.ศ.2535 ตามปกตแลว สบพ. จะจดใหมการประชมทกเดอน รวมทงสน 12 ครง หรอมากกวา (กรณมเรอง เรงดวน) ดวยเหตผลดงกลาวขางตนทำใหป งบประมาณ 2551 สบพ. สามารถจดประชมคณะ กรรมการ รวมทงสน 8 ครง (เดอนตลาคม 2550 และระหวางเดอนมนาคม - กรกฎาคม 2551 ไมได จดการประชม) สำหรบเดอนมกราคม และเดอน กมภาพนธ 2551 จดใหมการประชมเดอนละ 2 ครง

Criteria for Selection of Chairman of the CATC’s Board/Accredited Directors and Directors Representing the Organization:

1. Criteria for Selection of Directors;

According to the Royal Decree on CATC

Establishment B.E.2535 (1992), it is specified, as

follows:

- Section 10: To establish a board called

“CATC’s Board” consisting of the Chairman of the

Board, representative of the Ministry of Transport, rep-

resentative of the Ministry of Finance, representative of

the Department of Civil Aviation, representative of the

Airports of Thailand (Public) Co., Ltd., representative of

the Royal Thai Air Force, representative of Thai Airways

International (Public) Co., Ltd., representative of the

Aeronautical Radio of Thailand Limited, and accredited

people (not exceeding 2 people); and the Governor

(acting as the director and secretary);

- Section 12: The Chairman of the Board/

directors appointed by the Cabinet shall be prohibited to

have any direct or indirect interest in the business done

with CATC or in competitive businesses of CATC;

- Section 13: The Chairman of the Board

appointed by the Cabinet shall be in office for a term

of 3 years;

In case, the Chairman of the Board/directors

appointed by the Cabinet has/have been released from

office before the term thereof shall expire, the replacing

directors shall be in office equal to the remaining term

of the Chairman of the Board/directors appointed;

In case, the term in office under Paragraph 1 expires, if new Chairman of the Board/directors has/ have not yet been appointed, the retiring Chairman or directors who have been retired by rotation shall still be in office to carry out the operations until the new Chairman or directors has/have been appointed to assume the office;

The retiring Chairman or directors who have been retired by rotation may be reelected for not exceeding 2 consecutive terms in office.

Attendances of the Annual Meetings:

In the fiscal year of 2008, the new Cabinet was formed to assume the responsibilities for public administration, and the list of qualified directors of CATC, representing different organizations shall be reconsid- ered by the Government; however, the notification of the list thereof has taken some time; as a result, CATC was unable to convene the CATC’s Board meeting as scheduled because the quorum was not constituted. According to the Royal Decree on CATC Establishment B.E.2535 (1992), CATC shall normally convene 12 meetings or more per month (in cases of emergen cies). Due to the above-said reason, in the fiscal year of 2008, CATC convened 8 meetings (in October 2007 and during March-July 2008, no meetings were convened); and in January and February 2008, the meetings were convened twice a month.

คณะกรรมการ สบพ. มอำนาจในการแตงตง คณะอนกรรมการ หรอคณะทำงาน เพอทำหนาท บางประการตามทไดรบมอบหมาย โดยกรรมการ รฐวสาหกจทไดรบแตงตงเปนคณะอนกรรมการ หรอคณะทำงานใหไดรบเบยประชมในอตราเหมา จายเปนรายเดอนเทากบเบยกรรมการ ทงน หาก กรรมการรฐวสาหกจคนใดไดรบการแตงตงเปน กรรมการในคณะกรรมการอน มากกวา 1 คณะ กให ไดรบเบยประชมเพยงคณะใดคณะหนงเทานน

คาเบยประชมคณะกรรมการ สบพ. ประธาน กรรมการไดรบ 7,500 บาทตอครงททเขาประชม กรรมการ 6,000 บาทตอครงทเขาประชม หาก เดอนใดมการประชมเกน 1 ครง คงใหไดรบเบย ประชมเพยงครงเดยว ในสวนกรรมการ สบพ. ทได รบการแตงตงโดยคณะกรรมการ สบพ. ใหเปน อนกรรมการชดยอยอนๆ ใหไดรบเบยประชม ดงน ประธานคณะอนกรรมการฯ 7,500 บาท อน- กรรมการฯ 6,000 บาท หากกรรมการไดรบการ แตงตงเปนกรรมการในอนกรรมการอน มากกวา 1 คณะ คงไดรบเบยประชมเพยงคณะใดคณะหนง และกำหนดคาตอบแทนและคาเบยประชมของ กรรมการ สบพ. ประจำปงบประมาณ 2551 ไมเกน 1,200,500 บาท

Remunerations for Directors and the Management

The Ministry of Finance has approved the remunerations for state enterprise directors; whereas, directors of the Civil Aviation Training Center (CATC) shall receive the remunerations of not exceeding 6,000 Baht per month; and the Chairman of the CATC’s Board shall receive remunerations equivalent to those paid to directors plus 25%; and directors shall bear the personal income tax.

The CATC’s Board shall be empowered to appoint subcommittees or working parties to perform certain duties as assigned; whereby, state enterprise directors who are appointed as subcommittees or working parties shall receive the monthly lump sum meeting allowances equal to the remunerations for directors; provided that, in case, any state enterprise director has been appointed to another committee or other committees, such director shall receive the meeting allowances of only one specific committee.

Regarding the meeting allowances of the CATC’s Board, the Chairman of the Board shall receive 7,500 Baht per each meeting attendance; whereas, directors shall receive 6,000 Baht per each meeting attendance. In case, there are at least 2 meetings held in any month, the meeting allowances shall be paid only 1 time. Members of the CATC’s Board who are appointed as subcommittees shall receive the meeting allowances, as follows: the Chairman of the Subcom- mittee shall receive 7,500 Baht per month; and members of the subcommittee shall receive 8,000 Baht per month. In case, any director has been appointed to another subcommittee or other subcommittees, such director shall receive the meeting allowances of only one specific subcommittee; and the remunerations and meeting allowances of members of the CATC’s Board for the fiscal year of 2008 shall not exceed 1,200,500 Baht.

CATC’s 4th Corporate Plan for the fiscal year 2007-2010 was approved by the CATC Board of Directors and the Ministry of Transport. The Plan provides future directions for CATC and guidelines for the corporate administration and management during a 4-year period. This rolling plan in designed to facilitate CATC’S operations, enabling CATC to achieve its vision “CATC is the Specialized Civil Aviation Center of the Region and Learning Organiza- tion of World-class Human Resources”. At the same time, CATC is also committed to supporting many national strategies, for example, the 10th national Economic and Social Development Plan (2007- 2011), the government policy on air transport, Government Strategic Plan, the Ministry of Transport’s strategies and operational plan, the 2006-2016 National Education Plan, and the Ministry of Transport’s transport development approach toward the coun-try’s sustainable development.

Objectives

The Corporate Plan is designed to ensure balanced operations encompassing four aspects: customers and stakeholders, administration and management, learning and organizational development, and finance in tune with the government policy and the aviation industry development. The objectives of each aspect are as follows:

Customers and stakeholders

1. To produce and develop sufficient qualified aviation personnel to accommodate the expansion of the national and regional aviation industries.

2. To ensure CATC graduates or those com-pleting CATC training courses attain a level of quality and expertise that meet international standards and are wanted by the aviation agencies

Administration and Management

3. To enhance the administrat ion and management of education and training in compliance with the international standards, making it globally accepted.

Learning and organizational development

4. To ensure employees possess international standard quality level and are ready to constantly develop themselves to achieve a better quality of life.


Finance

5. To generate revenues and control costs so as to reduce reliance on the government for non-investment budget.

Administration and Management Policies

1. To maintain a high quality of education and training in accordance with the international stan-dards.

2. To operate in line with the principles of good governance to ensure maximum operational efficiency and effectiveness.

3. To stress the importance of human resource development and change the corporate culture to cater for competition and achieve sustainable development

โดยมวตถประสงคในการจดทำโครง- การเพอเพมพนสมรรถนะของประเทศกำลง พฒนาใหเปนไปตามมาตรฐานและขอพง ปฏบตของ ICAO รวมทงเปนการสงเสรม ความปลอดภยและพฒนาการของการบน- พลเรอนระหวางประเทศ ทงน ICAO และ รฐบาลไทย โดยกระทรวงคมนาคม ไดรวม ลงนามบนทกความเขาใจ วาดวยโครงการฝก อบรมสำหรบบคลากรดานการบนจากประเทศ กำลงพฒนา เปนระยะเวลาดำเนนโครงการ 3 ปตดตอกน เรมตงแตปงบประมาณ 2552- 2554 โดยสถาบนการบนพลเรอนเปนหนวย ดำเนนการจดการฝกอบรมหลกสตรดาน การบนใหกบตวแทนบคลากรดานการบน จากประเทศกำลงพฒนา ทงน ในปงบประมาณ 2551 ICAO ไดจดสงบคลากรดานการบน จากประเทศกำลงพฒนา มาฝกอบรมกบ สถาบนการบนพลเรอน เปนโครงการนำรอง โดยมผลการดำเนนงานตามโครงการดงกลาว ดงน

2. Cooperative with domestic and international

2.1 Signing of Memorandum of Understanding between the Thai Government and the International Civil Aviation Organization (ICAO) on the Training Programs for Aviation Personnel from Developing Countries;

This MOU is aimed at organizing training programs to improve the capabilities of developing countries in accordance with the ICAO’s standard and practices and at promoting the safety and development of international civil aviation; provided that ICAO and the Thai Government, represented by the Ministry of Transport, have mutually signed the Memorandum of Understanding on the Training Programs for Aviation Personnel from Developing Countries for 3 consecutive years (during the fiscal years of 2009-2011); whereby, the CATC shall organize the training programs for aviation personnel from developing countries; and in the fiscal year of 2008, ICAO has sent the aviation personnel from developing countries to participate in the training program organized by the CATC (pilot project), with the result of operation of the said training program, as follows:

2.2 Lao Airlines personnel participated in the Basic Course for Commercial Pilots and Related Ground Services Curriculum on April 8th, 2008 at the Lao People’s Democratic Republic; provided that in the fiscal year of 2008, Lao Airlines has -sent its personnel to participate in both the ground services and air operations sections, as follows:

2.2.1 Flight Attendant Curriculum, generation 6 (BCA-6), totally 22 people; the training program was organized at the Aviation Training Center, CATC, Hua Hin District, Prachuabkirikhan Province during April 21st, 2008-July 11th, 2008;

2.2.2 Basic Course for Commercial Pilots, generation 76 (AP-76), totally 3 people; the training program was organized at the Aviation Training Center, CATC, Hua Hin District, Prachuabkirikhan Province during February 2008- February 2009;

2.3 Signing of Memorandum of Understanding on Cooperation between the Civil Aviation Training Center (CATC) and Thai Air Asia Co., Ltd., in Training Programs and Conferment of Thai Air Asia Scholarships; and Special Training Programs on Airplane Maintenance Curriculum, on May 23rd, 2008 at the Civil Aviation Training Center (CATC) in Bangkok;

The Civil Aviation Training Center (CATC) shall organize and develop airplane technician training programs for Thai Air Asia Co., Ltd., aiming at developing airplane maintenance curriculum, with additional content covering Air Bus A320 airplanes; and Thai Air Asia Co., Ltd., shall confer 30 scholarships per year for the airplane maintenance curriculum for 3 consecutive years; whereas, the first group under the curriculum shall start in June 2008.

To show that aviation not far away, then Civil Aviation Training Center is operate aviation dream project to give chance to juvenile in secondary is interested as pilot and sharing with teacher and students, moreover training with imitate airplane at Flight Training Center, Borfai Airport, Prachuabkirikhan Province. From operate in year is satisfaction, juvenile are many sharing and give support from public and private sector for education and give chance for all juvenile across country to learning, and skill in aviation correctly that not any expense.

คณะกรรมการตรวจสอบ สถาบนการบนพลเรอน มขอบเขตอำนาจ หนาท และความรบผดชอบตามทไดรบ มอบหมายจากคณะกรรมการสถาบนการบนพลเรอน และตามทกำหนดไวในกฎบตรของคณะกรรมการตรวจสอบ สถาบนการบนพลเรอน สำหรบการสอบทานรายการทางการเงนผบรหารของสถาบนการบนพลเรอน เปนผรบผดชอบ ตอความถกตองและครบถวนของขอมลในงบการเงน คณะกรรมการตรวจสอบสถาบนการบนพลเรอน รบผดชอบเพยง พจารณาความครบถวน นาเชอถอ และประเมนวารายงานทางการเงนไดใชหลกการบญชทถกตองตามควรในสาระ สำคญตามหลกการบญชทรบรองทวไป ซงวธการสอบทานจำกดเพยงการสอบถามและวเคราะหเปรยบเทยบเทานน

คณะกรรมการตรวจสอบ สถาบนการบนพลเรอน ไดสอบทานการดำเนนงานดานตางๆ ของสถาบนการบน- พลเรอนในปงบประมาณ 2551 มสาระสำคญสรปไดดงน

1.ดานการบรหารความเสยง การประเมนการบรหารความเสยงตามเกณฑของ COSO ดำเนนการโดยคณะ อนกรรมการบรหารความเสยงและคณะทำงานบรหารความเสยงของสถาบนการบนพลเรอน ปจจบนอยระหวาง รวบรวมผลจากการอบรมเชงปฏบตการเพอทำแผนบรหารความเสยง ซงคาดวาจะแลวเสรจและสามารถนำมาใชได ในป 2552

4.ดานการปฏบตตามกฎหมาย ระเบยบ ขอบงคบ การปฏบตงานเปนไปตามพระราชกฤษฎกา และระเบยบ คำสง ขอบงคบ รวมทงการดำเนนการตามขอกฎหมายทแผนกนตการชแจงในประเดนตางๆ

5.ดานการขดแยงทางผลประโยชน สอบทานและใหความเหนตอการเขาทำรายการทเกยวโยงกน หรอ รายการทอาจมความขดแยงทางผลประโยชน รวมทงพจารณาการเปดเผยขอมลในเรองดงกลาวใหมความถกตอง ครบถวน

The Audit Committee of the Civil Aviation Training Center (CATC) has been appointed by the CATC’s Board, consisting of director representing the Royal Thai Air Force, executire director, director representing the Ministry of Finance, and the Head of the Internal Audit Office, as the secretary to the Audit Committee.

The Audit Committee of the Civil Aviation Training Center (CATC) has duties and responsibilities as assigned by the CATC’s Board and as prescribed in the Charter of the Audit Committee of the Civil Aviation Training Center (CATC) for review of financial reports; the CATC’s management shall be responsible for the correctness and completeness of data contained in these financial statements; meanwhile, the Audit Committee of the Civil Aviation Training Center (CATC) shall only be responsible for reviewing the completeness and reliability there of and evaluating if the financial reports are prepared duly in accordance with the generally accepted accounting principles; whereas, the reviewing method shall only be limited to inquiries and comparative analyses.

The Audit Committee of the Civil Aviation Training Center (CATC) has Joined 7 meetings with the internal auditor to review and report the audit result on the quarterly basis for the fiscal year of 2008; and has also joined meeting with independent auditor from the Office of the Auditor General of Thailand (OAG) to discuss on the audit guidelines and adequacy of the internal audit system of the Civil Aviation Training Center (CATC).

The Audit Committee of the Civil Aviation Training Center (CATC) has reviewed the CATC’s operations for the fiscal year of 2008, which can be summarized, as follows:

1. Risk Management The risk management evaluation under the COSO Framework shall be carried out by the Risk Management Subcommittee and the Risk Management Working Party of the Civil Aviation Training Center (CATC); whereas, the results of related workshops are being gathered to determine the risk management plan, which is expected to be complete and can be used in 2009.

2. Internal Audit System Regarding the internal audit system and evaluation in accordance with guidelines de-termined by the State Audit Commission, the data of evaluation result is now being collected from different organizations to summarize the overview of organizations to be submitted to the State Audit Commission, Ministry of Transport and the Audit Committee of the Civil Aviation Training Center (CATC), which is expected to be complete in May 2009.

3. Financial Reports The Office of Fiscal and Financial Services has provided the financial reports for the fiscal year of 2008, which have already been submitted to the Secretary to the Audit Committee of the Civil Aviation Training Center (CATC) and to the Office of the Auditor General of Thailand (OAG). At present, the Office of the Auditor General of Thailand (OAG) is auditing such financial reports for adoption.

4. Compliance with the Laws, Rules and Regulations The operations shall be in accordance with the Royal Decree, rules, regulations, orders, requirements and legal provisions as clarified, in different issues, by the Legal Affairs Division.

5. Conflicts of Interest The Audit Committee of the Civil Aviation Training Center (CATC) shall review and give opinions on the related transactions or any transactions which may have conflicts of interest and shall also consider the disclosure of data relating to such matters for correctness and completeness.

The Office of the Auditor-General of Thailand has examined the balance sheets as of September 30, 2008 and 2007 ,including statements of income and expenses, accumulated income and expenses,and cash flow for the years ending on the same day each year at the Civil Aviation Training Center,whose executives are responsible for the accuracy and completeness of the information in these financial statements.the office of the Auditor- General of Thailand is responsible for the opinions given to the financial statements,which are derived from the examination of the Office of the Auditor-General of Thailand. The Office of the Auditor-General of Thailand has made the examination in accordance with generally accepted auditing standards,which stipulate that the Office of the Auditor-General of Thailand must operate in such a way as to reach reasonable confidence as to whether or not the financial statements show information which (is not entirely factual,) Examination includes verification of evidence to the items in figures and disclosure of information in the financial statements assessment of appropriateness in the accounting principles used by the center and estimates regarding essential financial items compiled by the executives of the Center, including assessment of the appropriateness in the display of items show in financial statements as a whole.The Office of the Auditor- General of Thailand believes that this examination hives an appropriate conclusion to its expression of opinion. The Office of the Auditor-General of Thailand is of the opinion that the financial statements of September 30, 2008 and 2007 show statements of income and expenses,accumulated income and expenses and cash flow ending on the same day each year at the Civil Aviation Training Center are essentially accurate in accordance with accepted accounting principles. Without restriction to the expression of opinion about financial statement, the Office of the Auditor-General makes the following notices remark of balance sheet 3.12 deal with long-term loan and remark of balance sheet 3.18 deal with project jet Familiarization.

1. ขอมลทวไป

สถาบนการบนพลเรอน (สบพ.) เปนรฐวสาหกจทจดตงตามพระราชกฤษฎกาจดตงสถาบนการบน พลเรอน พ.ศ. 2535 มวตถประสงคเพอจดดำเนนการผลตบคลากรทางดานการบน และดำเนนกจการ เกยวกบบรการชางอากาศ บรการอากาศยาน และกจการอนเกยวกบกจการบน เพอประโยชนในการผลต บคลากรดงกลาวโดยมสถานประกอบการตงอยเลขท 1032/355 ถนนพหลโยธน แขวงจอมพล เขตจตจกร กรงเทพมหานคร และศนยฝกการบน ณ สนามบนบอฝาย อำเภอหวหน จงหวดประจวบครขนธ

2.3 คาเผอหนสงสยจะสญ

คาเผอหนสงสยจะสญจากลกหนทมใชสวนราชการหรอรฐวสาหกจ ซงคางชำระเกนกวา 6 เดอน ขนไป โดยถอปฏบตตามระเบยบกระทรวงการคลงวาดวย การบญชและการเงนของรฐวสาหกจ พ.ศ. 2548 ดงน

1. General Information

The Civil Aviation Training Center (CATC) is a state enterprise founded by Royal Decree in B.E. 2535. The center aims at creating and developing qualified aviation personnel and is responsible for operations regarding aviation services, aircraft services and other aviation-related activities. CATC is located at 1032/355 Phahon Yothin Road, Lat Yao, Chatuchak, Bangkok and Fiight Training Center is situated at Bo Fai Airport, Hua Hin, Prachuab Khiri Khan.

2. Summary of Significant Accounting Policies

2.1 Income Recognition

2.1.1 Income from tuition fees and dormitory rental fees during academic terms

2.1.2 Income from an aviation training service recognized when the actual training occurs

2.1.3 Income from any aircraft maintenance recognized when the task is complete.

2.1.4 Interest gained recognized in the proportional of time by taking the actual rate of

return of the assets into consideration

2.2 Government Grants

CATC abides by the Accounting Standards No. 55 regarding Government Grants Government grants for operational expenditure will be recognized as revenue and those for hardware procurement will be recorded as government grants waiting to be recognized in the balance sheet, and to be recognized as revenue in the statement of earnings and expenses throughout the period of time the asset is used.

2.3 Allowance Provisioning

Allowance for doubtful accounts created by non-government and non-state enterprises accounts receivable with over six months overdue is calculated in accordance with the regulation of the Ministry of Finance in the matter of the accounting and finance of state enterprises B.E. 2548 as follows:

อาคารและสงปลกสราง 20 ป เครองเรดารและเครองชวยการเดนอากาศ 15 ป เครองบนและอปกรณการบน 10 – 20 ป อปกรณและเครองใชอนๆ 7 ป ยานพาหนะ 5 ป

สนทรพยทกรมการขนสงทางอากาศไดรบมากอนป 2520 ระหวางป 2521 – 2530 และระหวาง ป 2531 – 2535 ประมาณอายการใชงานไวในอตรารอยละ 20 , 50 และ 80 ของอายการใชงานของ สนทรพยนน ตามลำดบ

คาเสอมราคาของสนทรพยทไดรบบรจาคทกอใหเกดรายไดโดยตรงรบรเปนคาใชจาย สำหรบ สนทรพยทไมกอใหเกดรายไดโดยตรงจะนำไปหกสวนเกนทนจากการบรจาค

2.4 Inventories and supplies

Shown in cost price on a first in, first out basis

2.5 Premises and Equipment

Premises and equipment transferred from the Department of Civil Aviation are shown with their estimated prices according to the current values on the date of transfer.

As regards newly purchased premises and equipment, the cost on the date of acquisition is exhibited. Premises and equipment bought before 16 August 1995, not over 10,000 Baht per unit and those bought after 16 August 1995, not over 30,000 Baht per unit would be recognized as expenses for the year when the purchase was made.

Donated assets are recorded along with the surplus from donations.

2.6 Depreciation of Premises and Equipment

Depreciation of premises and equipment is calculated by the Straight Line Method whereby the cost price of the assets is minus scrap value according to the estimated time of use of each type of asset starting from the month the asset had been received. Regarding an asset received after the 15th of a month, deprecia-tion will be calculated in the following month according to the amount of time the asset has been used. Details are as follows:

Aircraft and aviation equipment 10 –20 years

Other equipment and machinery 7 years

Automobiles 5 years

Premises and equipment from the Department of Civil Aviation is estimated according to the remaining period of use the assets received by the Department Civil of Aviation before 1977, between 1978 and 1987 and between, 1980. and 1992 are estimated at 20%, 50% and 80% of the usage period of the assets respectively.

The depreciation of assets obtained through donation that yield direct income is recognized as expense. Non-performing assets will be deducted from the surplus from donation.

2.7 Intangible fixed assets

Intangible assets are the deferred debit for building renovations paid according to the estimated time of use. CATC is the profiteer of the building; however, the proprietary rights and the software licensing belong to the Department of Civil Aviation. The debit is calculated by the Straight Line Method according to five years of use.

2.8 Foreign Currencies

Items in foreign currencies are converted to Baht at the exchange rate on the date of transaction. Assets and liability in foreign currencies remaining at the end of the accounting period are to be converted to Baht at the reference exchange rate announced by the Bank of Thailand on that day. Profit or loss from the exchange rate will be recognized as revenue or expense in that particular accounting period.

On 30 September, 2008 debtor of Department of Revenue for 16.95 million baht , mostly as value added tax list for refund from bought 1 Beechjet 400A plane. List as mentioned derived from 15 October, 2003 Civil Aviation Training Center is application list of value added tax (VAT. 30) for September, 2009 that not signature in box of refund that over payment and not application to refund value added tax as mentioned as cash (Form Kor.10) to Department of Revenue within period of 3 years. Caused not refund and unable to bring money as mentioned to deduct with tax that Civil Aviation Training Center is outstanding payment for 103.60 million baht as damaged to Civil Aviation Training Center. Therefore, Civil Aviation Training Center is setting Inspection Facts Committee according to order of Civil Aviation Training Center at 144/2008 dated 11 June, 2008, now during concluding facts.

เงนชดเชยรอเรยกคน จำนวน 3.19 ลานบาท เปนเงนจายชดเชยใหกบพนกงานผเกษยณอาย ในปงบประมาณ 2536 ถง 2539 จำนวน 32 ราย เปนเงนทงสน จำนวน 4.14 ลานบาท ตามคำสงสถาบน การบนพลเรอนท 171/2539 ลงวนท 5 พฤศจกายน 2539 และท 7/2540 ลงวนท 20 มกราคม 2540 ตอมากระทรวงการคลงพจารณาแลวเหนวาขอบงคบสถาบนการบนพลเรอนวาดวย สทธประโยชน เกยวกบคาชดเชยของพนกงาน พ.ศ.2539 มขอกำหนดใหพนกงานไดรบสทธประโยชนเกนกวาทกำหนด ไวในระเบยบคณะกรรมการรฐวสาหกจสมพนธ เรอง มาตรฐานของสทธประโยชนของพนกงาน รฐวสาหกจ พ.ศ.2534 ซงสถาบนการบนพลเรอนไดประกาศใชโดยไมไดขอความเหนชอบจากกระทรวง การคลง จงถอไดวาขอบงคบดงกลาวไมมผลใชบงคบ และเมอวนท 14 มนาคม 2543 คณะกรรมการ สถาบนการบนพลเรอนไดมมตใหสถาบนการบนพลเรอนเรยกเงนคาชดเชยคนจากอดตพนกงานท ไดรบเงนคาชดเชย จำนวน 32 รายดงกลาว โดยสถาบนการบนพลเรอนไดรบเงนชดเชยคนจำนวน 1 ราย สถาบนการบนพลเรอนจงไดมหนงสอถงสำนกงานอยการสงสดขอความอนเคราะหใหดำเนนคดกบ อดตพนกงาน จำนวน 31 ราย ซงในจำนวนนสถาบนการบนพลเรอนไดรบเงนชดเชยคนจำนวน 2 ราย และประนประนอมยอมความ จำนวน 3 ราย รวมมพนกงานจายเงนชดเชยคนแลว จำนวน 6 ราย คดเปนเงน จำนวน 0.95 ลานบาท คงเหลอเงนชดเชยรอเรยกคน จำนวน 26 ราย จำนวน 3.19 ลานบาท ปจจบนศาลแรงงานกลางไดพพากษาใหจำเลยชดใชเงน จำนวน 2 ราย สวนทเหลอ จำนวน 24 ราย ศาล ยกฟองเนองจากคดขาดอายความ รฐมนตรวาการกระทรวงคมนาคมจงไดมคำสง กระทรวงคมนาคมท 17/2546 ลงวนท 14 มกราคม 2546 แตงตงคณะกรรมการสอบขอเทจจรงความรบผดทางละเมดของ เจาหนาท โดยคณะกรรมการสอบขอเทจจรงความรบผดทางละเมดของเจาหนาท ไดรายงานผลการ สอบขอเทจจรงความรบผดทางละเมดตอรฐมนตรวาการกระทรวงคมนาคมผสงแตงตง ตามหนงสอ สถาบนการบนพลเรอนท สบพ 130(7)/22 ลงวนท 27 กมภาพนธ 2549 และท สบพ 130(7)/25 ลงวนท 27 กมภาพนธ 2549 ซงรฐมนตรวาการกระทรวงคมนาคมเหนชอบผลการสอบขอเทจจรงตามท คณะกรรมการสอบขอเทจจรงความรบผดทางละเมดเสนอ ซงสถาบนการบนพลเรอนไดสงสำนวนการ สอบขอเทจจรงความรบผดทางละเมด ใหกระทรวงการคลงพจารณาแลว ตามหนงสอสถาบนการบน พลเรอนท สบพ 130(7)/87 ลงวนท 9 ตลาคม 2549

ตอมากระทรวงการคลงมหนงสอท กค 0406.6/21418 ลงวนท 29 สงหาคม 2550 ใหสถาบน การบนพลเรอนสอบสวนเจาหนาททเกยวของกบขนตอนการดำเนนคดทงหมด โดยปฏบตตามระเบยบ สำนกนายกรฐมนตรวาดวยหลกเกณฑการปฏบตเกยวกบความรบผดทางละเมดของเจาหนาท พ.ศ. 2539 กลาวคอ ตองใหโอกาสแกเจาหนาททเกยวของหรอผตองรบผดไดชแจงขอเทจจรงและโตแยงแสดง พยานหลกฐานของตนเองอยางเพยงพอ และเปนธรรมและสงหลกฐานเพมเตมใหกระทรวงการคลง พจารณาอกครงหนง

Compensation waiting for refund 3.19 million baht is compensation to retire official in fiscal year 1993 to 1996 for 32 people total 4.14 million baht according to order of Civil Aviation Training Center at 171/1996 dated 5 November, 1996 and at 7/1997 dated 20 January, 1997 . Afterwards, Ministry of Finance considering to see that regulations of Civil Aviation Training Center deal with privilege deal with compensation of official, 1996 has regulations to official gained privilege over determined in discipline of Relatively State Enterprise Committee about standard of State Enterprise official, 1991. Which Civil Aviation Training Center is announced that not ask for approved from Ministry of Finance, regarding as regulations as mentioned is invalid and on 14 March, 2000 Civil Aviation Training Center Committee were resolution to Civil Aviation Training Center refund compensation from former official for 32 people as mentioned. Civil Aviation Training Center were gained for 1 people, then Civil Aviation Training Center has letter to Office of the Attorney-General to sued with former official for 31 people, which in these number Civil Aviation Training Center is gained compensation for 2 people and compromise for 3 people, total 6 people as 0.95 million baht , remainder 26 people for 3.19 million baht. In present Central Labour Court is judged defendant to payment for 2 people remainder for 24 people court is dismiss, due to expiry. Therefore Ministry of Transport has order of Ministry of Transport 17/2003 dated 14 January, 2003 appointed Inspection Facts Committee for infringe of official, committee are report facts to Ministry of Transport according to document of Civil Aviation Training Center at Sor.Bor.Por. 130(7)22 dated 27 February, 2006 and at Sor.Bor.Por. 130(7) /25 dated 27 February, 2006, which Ministry of Transport consent to facts according to committee is proposed. And Civil Aviation Training Center is send case for inspect facts to Ministry of Finance considered according to document of Civil Aviation Training Center at Sor.Bor.Por. 130(7)/87 dated 9 October, 2006.

Afterwards, Ministry of Finance have document at Khor.Kor. 0406.6/21418 dated 29 August, 2007, Civil Aviation Training Center is inquiry involved official and all method of sue perform as principle of Office of the Prime Minister deal with principle of operation deal with infringe admit of official, 1996. Namely, give chance to involved official or person who admit infringe are explain facts and dispute for display evidence is sufficient and fairly and send more evidence to Ministry of Transport to reconsidering.

ตอมากระทรวงการคลงมหนงสอท คค 0206/กน 264 ลงวนท 23 เมษายน 2551 ใหสถาบน การบนพลเรอนออกคำสงใหเจาหนาทผรบผดทงสองคนรบผดชดใชคาสนไหมทดแทน ตามความเหน ของกระทรวงการคลงตามนยมาตรา 10 และมาตรา 8 แหง พ.ร.บ. ความรบผดทางละเมดของเจาหนาท พ.ศ. 2539 ตอไป และใหสถาบนการบนพลเรอนแจงสทธตามกฎหมายวธปฏบตราชการทางปกครองดวย ทางสถาบนการบนพลเรอนไดมคำสงท 124/2551 เรอง ใหชำระคาสนไหมทดแทนลงวนท 13 พฤษภาคม 2551 เจาหนาทผรบผดทงสองคน อทธรณตอผวาการสถาบนการบนพลเรอน ผวาการสถาบนการบน พลเรอนไมเหนดวยกบคำอทธรณ จงไดมหนงสอเรยนรฐมนตรวาการกระทรวงคมนาคม รฐมนตรวาการ กระทรวงคมนาคมไดพจารณาคำอทธรณแลว ไมเหนดวยกบคำอทธรณเหนควรยกอทธรณ เจาหนาท 1 รายไดฟองคดตอศาลปกครอง ขณะนอยระหวางกระบวนการพจารณาคดของศาลปกครองกลาง และ เจาหนาทอก 1 รายมสทธฟองคดตอศาลปกครองภายในเวลา 90 วนนบแตวนทไดรบคำแจงผลอทธรณ หากเจาหนาทรายนไมฟองคดภายในเวลากำหนด และไมนำเงนมาชำระ สถาบนการบนพลเรอนจะ ดำเนนการบงคบคดตามมาตรการบงคบทางปกครองตาม พระราชบญญตความรบผดทางละเมดของ เจาหนาท พ.ศ. 2539 และ พระราชบญญตวธปฏบตราชการทางปกครอง พ.ศ. 2539 ตอไป

Civil Aviation Training Center report to Minister of Transport who appointed Inspection Facts Committee for infringe of official to acknowledged. Afterwards, Minister of Transport has order at 318/2007 dated 28 September, 2007 appointed Facts Committee for infringe of official to more inspect according to opinion of Controller General’s Department, Ministry of Transport.

Facts Committee for infringe of official is report for more facts to Minister of Transport considering to consent according to secret document at Sor.Bor.Por. 130(/)/90 dated 19 November, 2007 and Minister of Transport approved on 20 December, 2007.

Afterwards, Ministry of Transport has document at Kor.Kor. 0206/Khor.Nor. 264 dated 23 April, 2008, that Civil Aviation Training Center issued order to two official who responsible according to opinion of Ministry of Transport as section 10 and 8 of Admit infringe Act, 1996 in further. And Civil Aviation Training Center is notify rights according to operation of govern that Civil Aviation Training Center has order at 124/2008 deal with ask for payment compensation dated 13 May, 2008. Two official are appeal to Governor of Civil Aviation Training Center but not consent to appeal, then send document to Minister of Transport. Minister of Transport is considered appeal not consent then dismiss appeal, 1st official is sue to Administrative Court now during testify at hearing of Central Administrative Court . And another official has rights to sue to Administrative Court within 90 days from date of received result of appeal, if this official not sue in fixed time and not payment, Civil Aviation Training Center is perform enforcement according to standard of govern as Admit Infringe of Official Act, 1996 and Administrative performance Act, 1996 in further.

At 30 September, 2008 Civil Aviation Training Center have capital 726.22 million baht for 48 plane, one of these planes have capital for 243.35 million baht as Beechjet 400A plane that Civil Aviation Training Center is purchase as project of Jet Familiarization according to remark of budget item 3.12 and 3.18.

In the accounting period of 2008, CATC has an annual depreciation of 60.21 million Baht, 47.77 of which is expenses from operations and 12.44 million Baht as the expenses for the jet familiarization prgram.

Due to Civil Aviation Training Center not written confirm from Thai Airways International Public Company Limited is consent to final decision and not contact to payment or payment debt according to final decision to Civil Aviation Training Center in any ways. เมอวนท 29 สงหาคม 2546 สถาบนการบนพลเรอนไดทำสญญากเงนกบธนาคารกรงไทย จำกด (มหาชน) เปนเงน 243.35 ลานบาท เพอจดซอเครองบน Beechjet 400A จำนวน 1 ลำ (ราคาซอขายเครองบน เปนเงน 5,898,028 เหรยญสหรฐอเมรกา อตราแลกเปลยน ณ วนท 29 สงหาคม 2546 จำนวน 1 เหรยญสหรฐ- อเมรกาเทากบ 41.26 บาท) เพอนำมาใชในการฝกอบรมหลกสตร Jet Familiarization ตามตดคณะรฐมนตร เมอวนท 17 มถนายน 2546 ตามหมายเหตประกอบงบการเงน ขอ 3.18 โดยสถาบนการบนพลเรอนเปน

Center is responsible to payment principal and loan interest from income of perform loan contract as mentioned for 10 years from date of made contract (Include period of free payment principal 3 years) , charge interest rate of regular deposit 6 months. For general customer of Commercial Bank average 5 places plus 1.0% per year, payment interest every 3 months, free principal 3 years from date of first withdraw after that pay by installment in every 6 months total 14 times, first pay by installment after due of free principal 3 years.

Civil Aviation Training Center is send document at Sor.Bor.Por. 1311/111 dated 20 December, 2006 for extending period of free principal 243.35 million baht from 3 years as 5 years. For others conditions is same original which Krung Thai Bank Public Co., Ltd. has document at Ror.Tor.Por. 295/2007 dated 15 February, 2007, approved extending free of principal from 3 years as 5 years, payment principal every 5 years for 2 times total 10 times each time 24.335 million baht, start first time 28 February, 2009 for others condition is same original in all aspects.

Civil Aviation Training Center have document at Sor.Bor.Por. 131/165 dated 3 November, 2008 ask for extending free principal from 5 years as 6 years, due of payment first loan on 28 February, 2010 that not affect to age of loan contract. Interest rate and others condition of original contract which Krung Thai Bank Public Co., Ltd. have document at Ror.Tor.Por. 556/2009 dated 2 March, 2010 approved period of free prin-cipal according to more record attach loan contract and consent of guarantor dated 23 February, 2009 from 5 years as 6 years, payment first time on 26 February, 2010 that pay by installment every 6 month total 8 times each time not less than 30.42 million baht and interest charge for regular interest deposit 6 months for general customer (maximum rate) of Commercial Bank 5 places average 2.0 % per year. For others condition and terms is according to loan contract dated 29 August, 2003 and more record attach loan contract and consent of guarantor dated 27 February, 2007.

จากการประชมคณะกรรมการสถาบนการบนพลเรอน ครงท 5/2550 ในวนองคารท 22 พฤษภาคม 2550 คณะกรรมการสถาบนการบนพลเรอนเหนชอบใหสถาบนการบนพลเรอนปฏบตตาม มตคณะกรรมการพจารณาชขาดการยตในการดำเนนคดแพงของสวนราชการและหนวยงานทเกยวของ และเหนชอบใหสถาบนการบนพลเรอนขอรบการจดสรรงบประมาณแผนดนป 2551

ในงวดนสถาบนการบนพลเรอนไดบนทกประมาณการหนสนเพมเตมตามกฎหมาย จำนวน 6.43 ลานบาท และไดชำระใหกรมสรรพากรทงสนแลวจำนวน 103.63 ลานบาท

Afterwards, assessment official of Revenue Office, Bangkok Area 5 is assess to collect value added tax from Civil Aviation Training Center for period of tax month April, 1993 to December, 2000 as value added tax, extra money and fine total 200.81 million baht (exclude extra money according to law) that Civil Aviation Training Center is oppose appeal for assess tax to committee of considering appeal. Afterwards, Revenue Office, Bangkok Area 5 have document at Kor.Kor. 0709.05 (KM.7.4)16878 dated 15 November, 2004, notify result of decision appeal of committee that committee is considering appeal to cancel only fine as 103.61 million baht. For value added tax 51.81 million baht and extra money 45.39 million baht (Exclude extra money according to law) total 97.20 million baht is still responsible to payment tax. Office of the Attorney-General is considering to offered committee for final decision to civil sue of public sector and involved section, for considering Civil Aviation Training Center is gained announced from Ministry of Transport, except value added tax during tax month, April, 1993 to ecember, 2000 as mentioned. จำนวน 7.23 ลานบาท เปนการรบบรจาคอปกรณการศกษารายการเครองมอและเครองยนต จากบรษท โรลสรอยซ จำกด ราคาทน จำนวน 4.27 ลานบาท และรบบรจาคเงนสดจำนวน 2.96 ลานบาท

จำนวน 229.65 ลานบาท เปนรายไดทเกดจากสถาบนการบนพลเรอน ไดรบเงนอดหนนจาก รฐบาลเพอเปนคาใชจายดำเนนงานในงวดน จำนวน 206.93 ลานบาท ทงนรวมเงนทไดรบจากการจดสรร เพอนำมาชำระภาษมลคาเพม จำนวน 103.59 ลานบาท และ รบรเงนอดหนนจากรฐบาลรอการรบรเปน รายไดในงวดน จำนวน 22.72 ลานบาท

3.14.1 Capital from transfer assets for 307.44 million baht as transfer assets of Department of Civil Aviation in part of deal with Civil Aviation Training Center of Thailand on 1 April, 1993 for 298.63 million baht and more transfer of 1994 for 8.81 million baht.

3.14.2 Original capital for 150 million baht as wage from Thai Airways International Public Co., Ltd. For 100 million baht from Airport of Thailand Public Company Limited for 25 million baht and from Aeronautical Radio of Thailand LTD

3.14.3 Capital from government for 672.05 million baht as capital is received from government in budget of 1994 to 2003 for budget of 2004 from now on. Civil Aviation Training Center is record subsidy from government according to standard of accounting volume 55th.

3.15 Excess capital from Donation

For 7.23 million baht as donation for education tools, equipment list and machine from Rolls Roys Co., Ltd. Capital price for 4.27 million baht and donation as cash for 2.96 million baht.

3.16 Income from of government grants

For 229.65 million baht as income is derived from Civil Aviation Training Center is subsidy from government for expense to perform in this time as 206.93 million baht. In addition to, money is received from allocated for payment value added tax for 103.59 million baht and acknowledged subsidy from government or acknowledged as income in this time as 22.72 million baht.

3.18 โครงการ Jet Familiarization

เมอวนท 4 กนยายน 2543 สถาบนการบนพลเรอน ไดทำบนทกความเขาใจระหวางสถาบน การบนพลเรอนกบบรษท การบนไทย จำกด (มหาชน) เกยวกบความรวมมอการฝกอบรมหลกสตร Jet Familiarization มกำหนดระยะเวลาโครงการ 6 ป ซงเรมดำเนนการประมาณเดอน ธนวาคม 2543 เปนตนไป โดยสถาบนการบนพลเรอนจะดำเนนการอบรมหลกสตร Jet Familiarization ใหกบ บรษท การบนไทย จำกด (มหาชน) และ บรษท การบนไทย จำกด (มหาชน) จะสงนกบนเขารบการฝกอบรมในหลกสตร Jet Fami- liarization ทสถาบนการบนพลเรอน ประมาณปละ 1,440 ชวโมงบน โดยสถาบนการบนพลเรอนรบผดชอบ ในการจดหาเครองบนประเภทเครองยนตไอพนขนาดเลก บคลากร ผฝกสอน ตลอดจนอปกรณ และ สงอำนวยความสะดวกตางๆ ทใชในการฝกอบรม ซงสถาบนการบนพลเรอนไดทำสญญาเชาเครองบน Beechjet 400A กบบรษท RK – 294 (UK) จำกด มระยะเวลา 6 ป ตามโครงการ (ธนวาคม 2543 ถง พฤศจกายน 2549)

บรษท การบนไทย จำกด (มหาชน) ไดสงนกบนมาฝกอบรมรนแรกเมอวนท 15 ธนวาคม 2544 และ ฝกอบรมไดจำนวน 3 รนรวมทงสน 605.21 ชวโมงบน โดยรนท 3 ยงอบรมไมแลวเสรจ บรษท การบนไทย จำกด (มหาชน) ไดมหนงสอแจงขอยกเลกการฝกอบรมหลกสตร Jet Familiarization ทำให สถาบนการบนพลเรอนไดรบความเสยหายอนเนองมาจากการแบกรบภาระคาใชจายทเกดขนจากการ เชาเครองบน Beechjet 400A เพอมาดำเนนการโครงการดงกลาวเปนจำนวนเงน 128.55 ลานบาท ตอมา สถาบนการบนพลเรอนไดมหนงสอถงสำนกงานอยการสงสดขอใหพจารณานำเสนอคณะกรรมการ พจารณาชขาดการยตในการดำเนนคดแพงของสวนราชการ และหนวยงานทเกยวของวนจฉยชขาดตาม มตคณะรฐมนตรเมอวนท 4 พฤศจกายน 2540 เพอเรยกรองคาเสยหายทเกดขน

In accounting year of 2008 Civil Aviation Training Center have higher income than expense for 84.41 million baht increase from same period of last year for 100.89 million baht or increase 612.20%, from increase of income and decrease of expense.

Increase income mostly as increase of subsidy from government is allocated for payment value added tax. For decrease expense 84.42 million baht mostly as decrease of expense from performance 73.12 million baht and expense of Jet Familiarization project 11.34 million baht, respectively.

3.18 Jet Familiarization project

On 4 September, 2000 Civil Aviation Training Center is made memorandum between Civil Aviation Training Center and Thai Airways International Public Co., Ltd. deal with cooperate Jet Familiarization training course period 6 years , start around December, 2000 from now on. Civil Aviation Training Center is perform Jet Familiarization training course to Thai Airways International Public Co., Ltd. and Thai Airways International Public Co., Ltd. send pilot to training in course of Jet Familiarization at Civil Aviation Training Center around 1,440 flight hours . Civil Aviation Training Center is responsible to supply small Jet plane, personal, coach throughout tools and any facilities in training. which Civil Aviation Training Center is made contract for rent Beechjet 400A with Rk-294(uk) for 6 years according to project (December, 2000 to November, 2006).

Thai Airways International Public Co., Ltd. send pilot for first training course on 15 December, 2001 and training for 3 generations total 605.21 flight hours. Third generation not complete training , Thai Airways International Public Co., Ltd. is notify for cancel Jet Familiarization training course, that caused damaged to Civil Aviation Training Center due to responsible in expense is derived from rent Beechjet 400A for perform project as mentioned 128.55 million baht. Afterwards, Civil Aviation Training Center is send document to Office of the Attorney-General to considering offered to committee for final consider in civil sue of public sector and involved section deal with final decision as resolution of cabinet on 4 November, 1997 for claim damaged is occurred. From that Thai Airways International Public Co., Ltd. not send pilot to training course according to contract as mentioned. As caused Civil Aviation Training Center is suffer lost income , responsible to rent plane fee and others expense as involved. คาใชจายอนทเกยวของ ทำใหสถาบนการบนพลเรอน ขาดสภาพคลอง จงคางชำระคาเชาเครองบนกบ บรษทผใหเชา และไดรบแจงจากบรษทผใหเชาวาจะดำเนนคดกบสถาบนการบนพลเรอน หากสถาบน การบนพลเรอนถกฟองดำเนนคด บรษทผใหเชาจะใชสทธเรยกรองคาเสยหาย เพอแกไขปญหาดงกลาว กระทรวงคมนาคมจงไดเสนอคณะรฐมนตรพจารณาขออนมตจดซอเครองบน Beechjet 400A และเมอวนท 17 มถนายน 2546 คณะรฐมนตรไดมมตเหนชอบใหสถาบนการบนพลเรอนจดซอเครองบน Beechjet 400A จำนวน 1 ลำไวใชในภารกจฝกบนของสถาบนการบนพลเรอนในวงเงน 260 ลานบาท โดยใหกระทรวง การคลงจดหาแหลงเงนกทมเงอนไขผอนปรนและอตราดอกเบยตำแทนการใชเงนจากงบประมาณ แผนดน และใหสถาบนการบนพลเรอนเปนผรบผดชอบชำระคนเงนตนและดอกเบยเงนกดวยเงนรายได จากการดำเนนงาน และเมอวนท 29 สงหาคม 2546 สถาบนการบนพลเรอนไดทำสญญาเงนกกบธนาคาร กรงไทย จำกด (มหาชน) เปนเงน 243.35 ลานบาท เพอจดซอเครองบน Beechjet 400A จำนวน 1 ลำ เพอ นำมาใชในภารกจฝกบน ตามมตคณะรฐมนตรดงกลาว

ตอมาในป 2548 คณะกรรมการพจารณาชขาดการยตในการดำเนนคดแพงของสวนราชการ และหนวยงานทเกยวของไดตดสนชขาดใหบรษท การบนไทย จำกด (มหาชน) ชำระเงนจำนวน 128.55 ลานบาท ใหแกสถาบนการบนพลเรอน และคณะรฐมนตรไดรบทราบคำตดสนชขาดแลวเมอวนท 1 กมภาพนธ 2548 โดยในงวดบญชป 2548 สถาบนการบนพลเรอนไดบนทกบญชเงนชดเชยคาเสยหาย ทจะไดรบจาก บรษท การบนไทย จำกด (มหาชน) จำนวนดงกลาวไวในบญชลกหนชดเชยคาเสยหาย คกบรายไดชดเขยคาเสยหายทงจำนวน

จากการดำเนนงานโครงการ Jet Familiarization ทผานมา สถาบนการบนพลเรอนประสบผลขาดทน โดยตลอด คณะกรรมการสถาบนการบนพลเรอน ในคราวประชมครงท 4/2550 เมอวนท 27 เมษายน 2550 ไดมมตใหสถาบนการบนพลเรอนเสนอขายเครองบน Beechjet 400A โดยขอรบการสนบสนนเงน งบประมาณจากรฐบาลในสวนทขาดทนเพอนำเงนสวนตางคนใหกบธนาคารกรงไทย จำกด (มหาชน) ทงนเพอลดภาระทางการเงนในเรองดอกเบยจายทเกดขนในแตละป และผลกระทบทางการเงนในเรอง ของสภาพคลองทอาจเกดขนในอนาคต และใหสถาบนการบนพลเรอนทำหนงสอแจงกระทรวงคมนาคม ทราบกอน กระทรวงคมนาคมทำหนงสอนำเรยนคณะรฐมนตร เพอพจารณาใหความเหนชอบ และอนมต ใหสถาบนการบนพลเรอนดำเนนการขายเครองบน Beechjet 400A ได

สถาบนการบนพลเรอน ไดดำเนนการตามมตดงกลาวแลว โดยไดเสนอเรองใหกระทรวงคมนาคม พจารณา ตามหนงสอ สบพ ท 120/019 ลงวนท 17 พฤษภาคม 2550 และเมอวนท 1 มถนายน 2550 ปลดกระทรวงคมนาคมไดบนทกสงการใหสำนกนโยบายและแผนการขนสงและจราจรพจารณาแนวทาง ทสถาบนการบนพลเรอนเสนอ เพอนำเรยนรฐมนตรวาการกระทรวงคมนาคม ตอมาเมอวนท 3 กรกฎาคม 2550 ปลดกระทรวงคมนาคมไดสงการใหสถาบนการบนพลเรอนดำเนนการตามความเหนของ สำนกนโยบายและแผนการขนสงและจราจร ตามหนงสอสำนกนโยบายและแผนการขนสงและจราจร ท คค 0805.4/1351 ลงวนท 26 มถนายน 2550 โดยให สถาบนการบนพลเรอนจดทำเรองขอรบการ สนบสนนงบประมาณจากรฐบาล ในสวนทขาดทนเพอนำเงนสวนตางคนใหแก ธนาคารกรงไทย จำกด (มหาชน) และจดทำแผนการขายเครองบน Beechjet 400A และแผนการจายเงนคนรฐเพอประกอบการ พจารณาของคณะรฐมนตรตอไป

For resolve problem as mentioned, Ministry of Transport have resolution to Civil Aviation Training Center purchase for 1 Beechjet 400A in mission of aviation training of Civil Aviation Training Center for 260 million baht. Ministry of Transport is supply loan source is relent condition and low interest from use money from budget. Moreover, Civil Aviation Training Center is responsible to payment principal and interest from income of performance, and on 29 August, 2003 Civil Aviation Training Center is made loan contract with Krung Thai Bank Public Co., Ltd. as 243.35 million baht for purchase BeechJet 400A in mission according to resolution of cabinet as mentioned.

Next in 2005 committee is final consider in civil sue case of public sector and involved section to final decision Thai Airways International Public Co., Ltd. payment for 128.55 million baht to Civil Aviation Train-ing Center and cabinet acknowledged final decision on 1 February, 2005 in accounting of 2005. Civil Aviation Training Center is record compensation is gained from Thai Airways International Public Co., Ltd. for amount as mentioned in account of debtor for compensation with income of all compensation.

From perform Jet Familiarization project in the past Civil Aviation Training Center is suffer lose . Committee of Civil Aviation Training Center in meeting of 4th /2007 on 27 April, 2007 has resolution to Civil Aviation Training Center offered for sell Beechjet 400A. There are support budget from government in part of lose for return differential to Krung Thai Bank Public Co., Ltd.. In addition to, for reduce interest is occurred in each year and effect to finance deal with liquidity is may be occur in future and Civil Aviation Training Center is written notify to Ministry of Transport to cabinet, for considering to consent and approved Civil Aviation Training Center is sold Beechjet 400A.

Civil Aviation Training Center is performed according to resolution as mentioned, proposed to Ministry of Transport to considering according to document Sor.Bor.Por. at 120/019 dated 17 May, 2007 and on 1 June, 2007. Permanent Secretary of Ministry of Transport is record order to Office of Transport and Traffic policy and planning, and considering method that Civil Aviation Training Center is proposed to Minister of Transport. On 3 July, 2007 Parmanant Secretary of Ministry of Transport is order to Civil Aviation Training Center is performed as opinion of Office of Policy and Transportation Plan and Traffic according to document of Office of Transport and Traffic policy and planning at Kor.Kor. 0805.4/1315 dated 26 June, 2007. Civil Aviation Training Center is setting subject for support budget from government in part of lose for bring differential money return to Krung Thai Bank Public Co., Ltd. and setting sale plan of BeechJet 400A and refund to government for considering of cabinet in further.

Civil Aviation Training Center is made employment contract no. 75/2002 dated 20 September, 2002 with Cyberclub Co., Ltd. employed for development information technology for administrative and management. Information technology for repair plane service total 3.95 million baht, deliver 4 times and last deliver within 17 June, 2003. Civil Aviation Training Center is made for addition contract 3 times, improve guarantee document and for extending to deliver, improve last deliver within 16 October, 2003.

Cyberclub Co., Ltd. is delivered to Civil Aviation Training Center for 3 times, 3th time is delivered on 29 October, 2003. For last 4th time CyberClub Co., Ltd. unable to delivered as due of contract. Civil Aviation Training Center has document to rush company deliver as due of contract and reserve rights to fine as condition of contract. Afterwards, Civil Aviation Training Center is considering that employment contract is long–term on 3 June, 2005 and 12 October, 2005, Civil Aviation Training Center is deliver document to CyberClub Co., Ltd. for notify to cancel guarantee and call for payment fine as 2.34 million baht within 15 days from date of received document.

On 29 July, 2005 and 12 October, 2005 Civil Aviation Training Center have document to Siam Com-mercial Bank Public Co., Ltd., Treepetch branch for inform cancelled contract with Cyber Club Co., Ltd. and for payment guarantee according to contract for 0.20 million baht to Civil Aviation Training Center within 15 days from date of received. Its appeared that when overdue as mentioned , Cyber Club Co., Ltd. (registered as Cyber Club Corporation (1997) Co., Ltd.) and Siam Commercial Bank Public Co., Ltd. is ignored. When on 6 January, 2006 Civil Aviation Training Center is deliver document to Office of the Attorney-General for considering sue with Cyber Club Corporation (1997) Co., Ltd. and Siam Commercial Bank Public Co., Ltd. in further.

On 8 June, 2006 Civil Aviation Training Center is deliver subject to Office of the Attorney-General is bring a charge to Cyber Club Corporation (1997) Co., Ltd. as 1st defendant and Siam Commercial Bank Public Co., Ltd. as 2nd defendant to Civil Court.
